18 Record-keeping and reporting obligations of port operator (1) The port operator of a designated port must keep, in the prescribed manner, records containing the prescribed particulars of all reportable incidents that occur within the port. (2) The port operator of a designated port commits an offence if: (a) a reportable incident occurs within the port; and (b) the port operator fails to keep a record of the incident in accordance with subsection (1). (3) The port operator of a designated port commits an offence if: (a) a reportable incident occurs within the port; and (b) the port operator fails to report, in writing, the prescribed particulars of the incident to the regional harbourmaster for the port within the prescribed period after it occurs. (4) An offence against subsection (2) or (3) is an offence of strict subsection (2) or (3) if the defendant has a reasonable excuse. (6) This section does not affect any requirement to keep a record of any kind, or report an event of any kind, that a port operator has under any other Act. Ports Management Act 2015 14
