140 When step-in rights may be exercised The regional harbourmaster for a designated port may exercise step-in rights only if of the opinion that it is necessary to do so: (b) in order to avert or minimise a threat of: (i) actual or potential death, or serious injury, to any person; or (ii) actual or potential loss of, or serious damage to, property; or (iii) actual or potential harm to the environment.
