Port Management (Prescribed Bodies) Regulations 2022

This instrument rests on a small set of interlocking legal concepts: prescription by regulation, cross-referencing for definitions, commencement and revocation, and sunsetting of subordinate legislation. Those concepts are deployed to achieve a precise administrative outcome: identifying which external authorities receive particular port-related reports.

Prescription by regulation: The Regulations operate by prescribing bodies for specified purposes under the Port Management Act 1995. They do not, within the text of the Regulations themselves, create reporting obligations; they identify recipients for obligations created by the Act. That is explicit in regulations 6 and 7 which say the bodies are "prescribed for the purposes of section 91FA(c)" and "section 91HB(1)" of the Port Management Act 1995 respectively. The logical structure is therefore two-layered. First, the Act imposes duties or requires certain reports to be "provided to prescribed bodies" under particular sections. Second, these Regulations determine which bodies qualify as "prescribed" for those purposes.

Cross-referencing definitions: The Regulations do not attempt to supply standalone definitions of the named recipients. Instead, regulation 5 imports definitions from other instruments and Acts. Environment Protection Authority is given the same meaning as "Authority" in section 3(1) of the Environment Protection Act 2017; WorkSafe Victoria has the same meaning as "Authority" in section 3 of the Workplace Injury Rehabilitation and Compensation Act 2013; Safe Transport Victoria is identified by reference to the Transport Restructuring Order (Establishment of Safe Transport Victoria) No. 1/2022, clause 6. Those links mean the legal identity, functions and structure of the recipients are determined by the referenced enactments or orders rather than by the Regulations themselves.

Revocation and replacement: Regulation 4 revokes the 2012 Regulations, making this instrument the operative rule on which bodies are prescribed for the Act’s reporting purposes from commencement. The Explanatory Details point explicitly to S.R. No. 124/2012 as the revoked instrument.

Statutory-making, commencement and sunset: The instrument was made under the statutory power in section 98 of the Port Management Act 1995 (reg 2). It was made on 4 October 2022 and commenced on 6 November 2022 (Endnote 1 and reg 3). The Explanatory Details also record that the instrument will sunset under the Subordinate Legislation Act 1994 ten years after the day of making, that is 4 October 2032 (Endnote 1). The Interpretation of Legislation Act 1984 provisions noted in the endnotes affect how the Statutory Rule's headings, notes and examples are treated as part of the instrument and confirm that explanatory memoranda and other endnotes do not form part of the Statutory Rule.

Narrow scope and use of Act references: The Regulations are careful in scope. They prescribe bodies "for the purposes of" identified sections only. That creates a bounded legal effect: the named bodies are recipients for the purposes of the specified Port Management Act provisions and may not be the recipients under other provisions that the Act or other subordinate instruments require, unless those other provisions themselves refer to the prescribed-bodies concept or to these Regulations.

Primary affected parties: The immediate operational effect falls on two groups. First, the entities required by the Port Management Act 1995 to produce safety and environment management plan audit reports and annual performance outcome reports will be obliged, to the extent the Act requires provision to prescribed recipients, to provide copies to the three bodies named in regulations 6 and 7. The Regulations do not themselves name those report-producing parties; that detail is in the Act. Second, the three named recipient bodies , Safe Transport Victoria, the Environment Protection Authority, and WorkSafe Victoria , are formally placed on the statutory list of recipients for the Act provisions specified. That gives those agencies a statutory basis to expect copies of the reports described, where the Act requires provision to "prescribed bodies".

List of affected recipients, as prescribed: Regulation 6 lists Safe Transport Victoria, Environment Protection Authority, WorkSafe Victoria for the purposes of section 91FA(c) of the Port Management Act 1995. Regulation 7 repeats the same three bodies for the purposes of section 91HB(1) of the Act. From the perspective of those agencies, those prescriptions mean they are statutory recipients, and that status may affect their operational oversight, recordkeeping and any follow-up compliance activity triggered by receipt of those reports.

Intermediary stakeholders: Port managers, port operators, contractors and auditors who prepare the safety and environment management plans and annual reports will be indirectly affected because the list of prescribed recipients determines where copies must be sent. The Regulations therefore alter the distribution list for statutory reporting. Because regulation 5 ties the names to definitions in other statutes and an Order, entities that prepare and deliver reports must ensure they are sending to the correct legal entities as currently constituted under those other instruments.

Other legal and administrative stakeholders: The Regulations also intersect with administrative practices in the departments and agencies concerned. For example, the Environment Protection Authority, defined via the Environment Protection Act 2017, may have statutory functions and contact points governed under that Act; WorkSafe Victoria’s statutory identity is fixed by reference to the Workplace Injury Rehabilitation and Compensation Act 2013; and Safe Transport Victoria’s form is determined by the Transport Restructuring Order No. 1/2022. Each named recipient may need to establish internal processes to receive, log and act on reports received under these statutory channels.

Who does not change: The Regulations do not, on their face, impose new duties on private third parties beyond the recipients named. They do not create inspection or enforcement powers in the named recipients; those powers, if any, would derive from the parent statutes of those recipients or from the Port Management Act 1995. The Regulations also do not themselves make changes to the content, timing or frequency of the reports; such requirements remain matters for the Port Management Act 1995 and any subordinate instruments made under it.

Timing and sunset effects: Parties who rely on the list of prescribed recipients must also note the instrument’s commencement date, 6 November 2022, and its sunset date on 4 October 2032. The revocation of the 2012 Regulations means that, from commencement, any statutory obligation to provide copies to prescribed bodies refers to the list now in force. That can affect ongoing compliance processes and archived recordkeeping where historical submissions were made under the previous Regulations.

Statutory placement of duties and rights here is limited because the Regulations function principally as a list. The Regulations do not themselves state who must prepare reports, what their content must be or the timelines for reporting. Those operative duties and any rights to receive and to use reports are contained within the Port Management Act 1995 provisions cross-referenced in regs 6 and 7. What these Regulations do is determine which external statutory bodies will occupy the role of "prescribed bodies" within the meaning of those Act sections.

Duties allocated by implication: Because the Regulations prescribe the recipients for section 91FA(c) and section 91HB(1) purposes, any duty in those sections that requires a report to be provided to "prescribed bodies" will, by operation of the Act read with these Regulations, require provision to Safe Transport Victoria, Environment Protection Authority and WorkSafe Victoria. Therefore, the duty to supply copies, if it exists in the Act provisions, will be owed to the three named bodies. The Regulations place no limitation or qualification on that prescription within their text.

Rights of the prescribed bodies: The named bodies become formal statutory recipients under the relevant Act provisions. That status provides them with a statutory reason to request or expect copies. Whether that status confers additional powers to act on or to disclose the reports depends on the Port Management Act and the functions and powers of each named body under its own enabling statute or order. The Regulations do not expand or reduce those agencies’ statutory powers. They simply ensure those agencies are among the recipients to whom the Act requires copies to be sent.

Definition-linked rights: Because the Regulations define the recipients by cross-reference, the legal person that is entitled to receive copies will be whatever entity is the "Authority" under the cited Acts or the body constituted by the Transport Restructuring Order. For example, if the Environment Protection Act 2017 defines a particular corporate body as the Authority, that corporate body is the correct legal recipient. Changes to those other Acts or Orders that alter the identity, functions or corporate structure of the named recipients would alter who holds the right to receive reports, absent further amendment to these Regulations.

Procedural duties that follow from revocation and commencement: The revocation in regulation 4 creates a transitional duty for reporting parties to ensure they send future copies to the newly prescribed list; the Explanatory Details also make clear the date of making and commencement (Endnote 1 and reg 3). Those factual details affect operational duties such as updating contact lists, compliance checklists and internal governance documentation. There is no express transitional provision in the Regulations about reports prepared before commencement; any transitional obligations or entitlements would arise from the Port Management Act or other administrative practice rather than from these Regulations.

No express enforcement or inspection rights in the Regulations: The instrument is silent on enforcement measures, powers of the prescribed bodies to demand further information, confidentiality or use restrictions on received reports. Any such rights or constraints must be sought in the Port Management Act 1995 or in the statutes or instruments governing the recipients. The Regulations therefore create a directory function without altering underlying enforcement architecture.

The Regulations themselves do not prescribe offences, penalties or specific enforcement mechanisms. They are instrumentally narrow: their text identifies recipient bodies for the purposes of specific sections of the Port Management Act 1995 but does not create penalties or enforcement powers within the text of the Statutory Rule.

Where penalties and enforcement arise will depend on the Port Management Act 1995 and on the enforcement capacities of the named recipient bodies under their own statutory regimes. The Regulations designate who is to receive copies of audit reports and annual reports where the Act requires provision to "prescribed bodies". If the Act includes sanctions for failure to provide copies to prescribed bodies under sections 91FA(c) or 91HB(1), then those enforcement provisions will apply to the duty to provide copies to the three bodies named in regs 6 and 7. The Regulations do not modify, remove or add to any such sanctions; they merely specify the recipients.

Because the Regulations cross-reference entities defined in other Acts and an Order, the enforcement environment may be multi-layered. For example, WorkSafe Victoria’s statutory powers and enforcement mechanisms flow from the Workplace Injury Rehabilitation and Compensation Act 2013 and related instruments. The Environment Protection Authority’s investigative and enforcement tools derive from the Environment Protection Act 2017. Safe Transport Victoria’s powers will be established by the Transport Restructuring Order and associated transport legislation. Where the Port Management Act gives rights to prescribed recipients (for instance, to require further information or to act upon receipt of a report), the recipient will typically exercise such powers under its own statutory regime.

Administrative consequences: Practically, the named recipient bodies may adopt administrative procedures to log, acknowledge and, where appropriate, escalate matters identified in reports. Those procedures can lead to compliance action either through the Port Management Act’s enforcement provisions or through enforcement powers under each recipient agency’s enabling statute. The Regulations do not prescribe administrative responses, timelines, records retention or audits of compliance with the duty to deliver copies.

Sunset and revocation considerations for enforcement: The endnotes state the Regulations will sunset on 4 October 2032 under the Subordinate Legislation Act 1994. If the Regulations are not remade before that date, a lapse in the statutory list might create ambiguity about which bodies are "prescribed" going forward. Enforcement of duties that require provision to prescribed bodies would, in that scenario, require careful legal analysis of whether the sunset creates a gap or whether other mechanisms fill it. The Regulations do not include transitional enforcement provisions to cover sunsetting; any such issues would need to be resolved under the Port Management Act or by replacement subordinate instruments.

No litigation provisions in the instrument: The Regulations do not create a private right of action or an adjudicative route. Rights of enforcement or challenge remain matters for the Port Management Act and the statutory frameworks of the recipient bodies.

The Regulations operate as a subordinate instrument under section 98 of the Port Management Act 1995 (reg 2). Consequently their legal effect depends on the Act’s provisions that refer to "prescribed bodies". The Regulations explicitly link to two sections of the Port Management Act 1995: section 91FA(c) and section 91HB(1), by prescribing recipients for those sections (regs 6 and 7). The Regulations therefore function as a definitional adjunct to the Act, filling the Act’s cross-reference to "prescribed bodies".

Cross-reference to recipient statutes and instruments: Regulation 5 imports meanings from other Acts and instruments. The phrase Environment Protection Authority in the Regulations is assigned the same meaning as "Authority" in section 3(1) of the Environment Protection Act 2017. WorkSafe Victoria is assigned the same meaning as "Authority" in section 3 of the Workplace Injury Rehabilitation and Compensation Act 2013. Safe Transport Victoria is identified by reference to clause 6 of the Transport Restructuring Order (Establishment of Safe Transport Victoria) No. 1/2022. Those cross-references mean that the Regulations do not themselves set the scope or functions of the named bodies; instead, their identity and statutory capacity are determined by the other Acts and the Transport Restructuring Order. Any amendments to those enabling instruments that materially alter the legal identity of those bodies would also change which legal entity is the recipient of reports under the Port Management Act, absent amendment to these Regulations.

Revocation of earlier subordinate law: Regulation 4 revokes the Port Management (Prescribed Bodies) Regulations 2012 (S.R. No. 124/2012). That removal of the earlier list completes a direct statutory replacement: references to prescribed bodies under the Port Management Act that fall to be satisfied by these Regulations will now be satisfied by the entities named in the 2022 Regulations. The Explanatory Details in the endnotes expressly link reg 4 to S.R. No. 124/2012.

Interpretation and legislative form: The Endnotes include a summary of how the Interpretation of Legislation Act 1984 affects the Statutory Rule. That material records that headings, examples, diagrams and punctuation are part of the Statutory Rule and clarifies that explanatory memoranda and endnotes do not form part of the substantive rule. This matters for legal interpretation because it restricts the materials courts and decision-makers will treat as statutory text versus explanatory background.

Sunset under the Subordinate Legislation Act 1994: The Explanatory Details note that the Regulations will sunset on 4 October 2032 under section 5 of the Subordinate Legislation Act 1994. This statutory interaction imposes a temporal constraint on the Regulations and requires either remaking or disallowance decisions by that date for continued effect.

Administrative law and agency functions: The Regulations create an administrative link between the Port Management Act’s reporting requirements and the statutory agencies named. The interaction is practical as well as legal. Receipt of reports by the Environment Protection Authority, WorkSafe Victoria or Safe Transport Victoria may trigger action under those agencies’ own statutory regimes. For example, an environmental compliance issue identified in an audit report, once received by the Environment Protection Authority under the Port Management Act channel, could be actionable under the Environment Protection Act 2017. The Regulations do not create or limit those powers; they merely identify recipients.

No express conflict resolution mechanism: The Regulations do not provide for resolving conflicts between duties under the Port Management Act and duties under the other Acts referenced. That means account holders should examine the respective statutes to reconcile obligations where they intersect.

The Regulations are the Version No. 001 instrument, made on 4 October 2022 and commenced on 6 November 2022 (reg 3 and Endnote 1). They expressly revoke the preceding Port Management (Prescribed Bodies) Regulations 2012 (reg 4). The Explanatory Details identify the old instrument as S.R. No. 124/2012 (Explanatory details, reg 4 note). The Table of Amendments in the Endnotes records there are no amendments made to the Port Management (Prescribed Bodies) Regulations 2022 by statutory rules, subordinate instruments or Acts (Endnote 2). That means, as of the version date recorded here (version as at 6 November 2022), no subsequent statutory rule or Act has altered the 2022 Regulations.

Sunset timetable: The Explanatory Details and Endnote 1 indicate the Regulations will sunset ten years after the day of making, specified as 4 October 2032, under section 5 of the Subordinate Legislation Act 1994. Unless remade before that date, the Regulations will lapse. The sunset is a statutory consequence of the Subordinate Legislation Act rather than of the Port Management Act.

Interpretation Act changes and style notes: The Endnotes include a block summarising the Interpretations of Legislation Act 1984 (ILA) effects on the Statutory Rule, including style changes and that headings, examples, diagrams, notes and punctuation are part of the instrument (Endnote 1, Interpretation of Legislation Act 1984 (ILA) section). That material is explanatory about statutory form and does not amend operative content, but it is recorded because the ILA provisions affect how later amendments and readings of the Regulation might be interpreted or reformatted.

No recorded amendments as at version date: The Table of Amendments states there are no amendments made to the 2022 Regulations by later instruments or Acts. That record is part of the official Endnotes and is relevant to audits and legal research because it confirms the listed provisions are current as at the version date.

Possible future amendment paths: Although not stated in the Regulations themselves, the normal paths to amend the prescriptions would be either a further Statutory Rule made under the Port Management Act 1995 power in section 98, or an amendment to the Port Management Act that changes how "prescribed bodies" are identified. The revocation of the 2012 Regulations illustrates that the Governor in Council may remake or replace such lists by subordinate instrument. The statutory sunsetting deadline creates periodic legislative housekeeping pressure to either remake or to let the rule lapse.

The Regulations themselves contain no recorded litigation history in their text or endnotes. The Explanatory Details and Table of Amendments (Endnotes 2 and 3) record no subsequent amendments or judicial proceedings mentioned in this instrument. There are no cases cited in the Regulations and no mention of judicial interpretation or challenge of these particular provisions.

Implications for litigation risk: Because the Regulations are primarily administrative and definitional, litigation that involves them would typically arise in one of two ways. First, a dispute could arise over whether a given entity is a prescribed body for the purposes of the Port Management Act because of changes to the other Acts or Orders to which the Regulations refer. Such a dispute would require close reading of the cross-referenced Acts and orders, and the Interpretation of Legislation Act 1984 rules about incorporation by reference. Second, litigation could arise about compliance with reporting obligations in the Port Management Act that require provision to prescribed bodies, for example whether a report was properly delivered or whether a recipient’s statutory powers attach to the report. In both scenarios the Regulations would be referenced as the instrument that names recipients, but the substantive causes of action, remedies and enforcement provisions would come from the Port Management Act and the statutory regimes of the named recipient bodies.

No declaratory history: The instrument does not record any prior declaratory rulings or tribunal interpretations about its meaning. That absence suggests any novel interpretive issues are likely to be resolved against the backdrop of the parent Act and the statutes governing the named recipients.

Practical consequence for litigators and compliance counsel: Where a dispute involves whether an agency was entitled to a report as a "prescribed body", counsel should rely on the express wording of regs 6 and 7 and the definitions in reg 5, and then consult the Environment Protection Act 2017, the Workplace Injury Rehabilitation and Compensation Act 2013, and the Transport Restructuring Order No. 1/2022 to map corporate identity and statutory functions. The Endnotes’ statement that explanatory material does not form part of the Statutory Rule is a useful reminder in litigation about which parts of the printed instrument are arguable as statutory text (Endnote 1, Other material).

Definition-by-reference traps: Regulation 5 does not give contact details, corporate numbers or addresses. It links the names to other instruments and Acts. That means compliance depends on accurately identifying who, in law, the named recipients are at the relevant time. If one of the referenced Acts or the Transport Restructuring Order is amended, or if an agency is restructured, the legal recipient may change. Practitioners should not assume that the literal name on the Regulations corresponds to a single, unchanging office. The Regulations tie the identity of the recipient to external instruments, so attestation of receiving entities requires checking those instruments.

Narrow prescription scope: The Regulations prescribe bodies "for the purposes of section 91FA(c)" and "for the purposes of section 91HB(1)" only. If the Port Management Act or other statutes require provision of reports to other recipients under different sections or contexts, this instrument may not cover those cases. Assuming the Regulations create universal recipients for every reporting requirement under the Port Management Act is a risk. Confirm which Act sections refer to "prescribed bodies" and whether those sections are the ones modified by these Regulations.

Revocation timing and transitional obligations: Regulation 4 revokes the 2012 Regulations effective on commencement. Parties managing their compliance calendars should not assume continuity of the old list. The transition from the 2012 list to the 2022 list occurred on 6 November 2022. There is no transitional provision in the Regulations about reports prepared before commencement. Reliance on earlier submission lists for archival purposes could cause confusion about whether obligations were discharged.

No express confidentiality or use restrictions: The Regulations require no specific confidentiality protections or information-handling rules for recipients of the reports. If the reports contain commercially sensitive material, intellectual property, or personal information, those protections must be sought in the Port Management Act, the statutes that govern the recipients, or general privacy and evidence laws. Do not assume the recipient’s receipt under these Regulations triggers a confidentiality duty beyond whatever the recipient’s statutory regime imposes.

Sunset and continuity risk: The Regulations will sunset on 4 October 2032. If they are not remade, the statutory list of prescribed bodies as currently set will lapse. That could introduce ambiguity in mid-term reporting cycles about to whom copies should be provided. Parties should monitor the statutory lifecycle and any replacement instruments before the sunset date.

Assumed duties not in the Regulations: The Regulations do not specify how reports must be delivered, whether electronically or in hard copy, nor do they specify timing or form. Those operational details are commonly found in the parent Act or agency procedures. Ensure that delivery methods comply with the Port Management Act’s procedural requirements rather than presuming the Regulations provide delivery rules.

Interpretation materials excluded: The Endnotes explicitly state explanatory memoranda and other material printed after the Endnotes do not form part of the Statutory Rule. Practitioners should not rely on explanatory text printed with the Regulations as a source of legal obligation or authority. Use those materials only as interpretive aids, recognising they do not constitute statutory text (Endnote 1, Other material).

Multiplicity of agency powers: Receipt of a report by a prescribed body can lead to actions under different statutory regimes. For example, an environmental issue in a port audit that is sent to the Environment Protection Authority might produce a different remedial or enforcement pathway than a workplace safety issue sent to WorkSafe Victoria. Reporting parties should not treat all recipients as passive file-keepers; recipients may be statutory regulators with powers to investigate and to take administrative or enforcement action.

Step 1 , Identify the reporting duty in the Port Management Act: These Regulations function to name recipients for reporting duties located in the Port Management Act 1995 at sections 91FA(c) and 91HB(1). The first practical step is to read the relevant Act sections to determine which entity is obliged to produce safety and environment management plan audit reports and annual reports on performance outcomes, and to confirm the timing, content and format requirements in those provisions.

Step 2 , Use the prescribed list: Where the Act requires provision to "prescribed bodies" for the purposes of section 91FA(c) or section 91HB(1), provide copies to the three bodies named in the Regulations: Safe Transport Victoria; Environment Protection Authority; and WorkSafe Victoria (regs 6 and 7). Ensure transmissions are addressed to the legal entities identified by the cross-references in regulation 5 rather than only to the common names. For example, confirm the Environment Protection Authority’s legal identity via section 3(1) of the Environment Protection Act 2017 and confirm WorkSafe Victoria’s legal identity via section 3 of the Workplace Injury Rehabilitation and Compensation Act 2013. For Safe Transport Victoria, consult clause 6 of the Transport Restructuring Order No. 1/2022 to determine the constituted entity and its contact or corporate details.

Step 3 , Verify delivery particulars and retain proof: The Regulations do not specify delivery method or form. Use the delivery methods permitted or mandated by the Port Management Act or by administrative guidance from the named recipients. For compliance evidence, retain proof of transmission and receipt, such as an acknowledged email, registered post receipt, or agency acknowledgement. Document the date and the version of the report transmitted.

Step 4 , Protect confidential or personal information appropriately: Because the Regulations do not impose confidentiality rules, apply relevant privacy and information-handling laws and any applicable contractual confidentiality protections when transmitting reports that contain personal data or commercially sensitive material. If in doubt, consult the recipient agency’s published guidance or legal advisers to avoid inadvertent disclosure.

Step 5 , Update internal compliance registers and governance documents: Revocation of the 2012 Regulations and the commencement date (6 November 2022) require updating internal compliance policies, reporting checklists and audit trails so that the new list of recipients is used for all reports delivered after commencement. Where organisational procedure documents specify a statutory list of recipients, amend those materials to name the agencies as prescribed in regs 6 and 7 with references to reg 5 for definitions.

Step 6 , Monitor linked statutes and instruments: Because the Regulations import definitions from other statutes and orders, maintain a monitoring process for changes to the Environment Protection Act 2017, the Workplace Injury Rehabilitation and Compensation Act 2013, and the Transport Restructuring Order No. 1/2022. Amend internal procedures if the identity or corporate form of any of the named recipients changes. Also watch for any repeal or remaking of these Regulations approaching the sunset date, 4 October 2032.

Step 7 , Consider recipient-specific obligations: After sending reports, anticipate that the recipient agencies may have separate statutory regimes that allow them to act on the information. Prepare for potential follow-up requests by keeping supporting documentation, audit trails and contact points ready. If a report raises issues that could trigger enforcement action under an agency’s enabling Act, seek early legal or regulatory advice.

Step 8 , Recordkeeping and historical reports: If you are responsible for reports produced before the commencement of the 2022 Regulations, note that the 2012 Regulations were revoked on commencement. Maintain a clear archival record that shows where past reports were sent and under which instrument, to avoid disputes about compliance for historical periods.

Step 9 , Seek confirmations where necessary: If there is any uncertainty about whether a report has been accepted by the prescribed body, seek written confirmation or acknowledgment from the recipient agency. Where the functional recipient is a statutory corporation with a changing structure, ask the agency to confirm its role as the legal recipient under the cross-referenced enactment.

Step 10 , Legal review for contested scenarios: If a organisation faces ambiguity about whether a report needs to be provided to a particular body , for example where an issue might fall within but is not clearly situated in sections 91FA(c) or 91HB(1) , obtain a legal review of both the Port Management Act provisions and these Regulations to establish whether the duty to supply copies is engaged. The Regulations only specify recipients for those particular Act provisions; do not assume they apply outside those contexts.
