Port Management (Port of Melbourne Safety and Property) Regulations 2020

The Regulations revolve around a small number of core legal and administrative concepts. Understanding these concepts is central to identifying obligations, compliance points and enforcement exposure.

• Hazardous port activity. The Regulations do not define the exhaustive list of hazardous port activities inside the text, but require that a person proposing to carry out a hazardous port activity must obtain an authority from VPCM (reg 10(1)-(3)). The instrument presumes hazardous activities create identifiable risks to people, property or the environment; those risks are the express grounds for refusing, suspending, cancelling or varying an authority (regs 11(3), 13(1), 16(1)). The Regulations link hazardous activities operationally to the notice duty (reg 20) and to the incident and recovery regime (regs 22-23).
• Authority. The authority is a written permission issued by the VPCM for up to three years, valid only as specified for person/classes, vessel/classes, and location in the port (reg 11(1)-(2)). Authorities are the primary instrument by which VPCM regulates activity; they carry conditions and can incorporate VPCM standards, procedures or guidelines (reg 12). The authority is a document a holder must produce on request to VPCM, a port safety officer or a police officer, subject to a 10 penalty unit offence (reg 19).
• Conditions and standards. VPCM may attach conditions relevant to classes of people or vessels and any other matters it considers relevant (reg 12(1)). Conditions can require compliance with VPCM-developed standards, procedures or guidelines (reg 12(2)). This creates a delegated standard-setting mechanism inside the VPCM/authority regime.
• Procedural fairness and immediate effect. The Regulations provide specified grounds for suspension, cancellation or variation, and require VPCM to give written notice and invite submissions with at least seven days for response before cancelling or varying an authority (regs 13-14, 16-17). Notwithstanding that, a suspension is specified to take effect immediately on being sent to the holder or the person carrying out the activity (reg 13(2)(d)). The holder also can request suspension or variation (regs 15 and 18).
• Notice and manifest obligations. Separate from having an authority, the person must notify VPCM each time they intend to undertake the hazardous port activity, at least 24 hours beforehand (reg 20). For transfers of dry or liquid cargo that are dangerous goods, a manifest with type and quantity details and signature by master, owner or agent must be prepared and given to VPCM at least 24 hours before transfer (reg 21(1)-(2)). These are operational, per-event compliance points.
• Incident reporting and cost recovery. The manager of a hazardous port activity must immediately notify VPCM of incidents such as explosion, fire, harmful reaction, spillage or leakage (reg 22). Separately, VPCM has an express power to recover reasonable costs of clean-up action from responsible persons, vessel owners, masters, agents or occupiers; cost items include labour, administrative and overhead costs, and the recovery is enforceable as a debt (reg 23).
• Abandoned things regime. Where VPCM can identify the owner, it may give a written direction to move the thing from the port and must serve specified written notice if VPCM moves and stores the thing under the relevant Act (reg 24). Directions require compliance within five business days and failure to comply is a 10 penalty unit offence. VPCM must keep a detailed register of all removed or disposed abandoned things (reg 25).

The Regulations are linked to other statutory instruments and bodies by express cross-references. Dangerous goods adopts the broader statutory definition from the Dangerous Goods Act 1985 (reg 5). Conflicts with instruments under the Marine Safety Act 2010 are resolved in favour of those instruments (regs 7-9). The criminal penalties in the Regulations reference penalty units within the Sentencing Act 1991 and the Monetary Units Act 2004 for value calculation, and the endnotes set out the current penalty-unit value as at 2020-21 (Endnotes and explanatory details).

These concepts create a regulatory architecture in which the VPCM authorises discrete high‑risk activities, sets operating standards by condition, requires per‑event notice and manifests, triggers immediate incident reporting, and retains cost-recovery and enforcement levers, while deferring in points of inconsistency to marine safety notices and harbour master directions.

The Regulations identify a limited set of persons and entities upon whom legal obligations fall and who are affected by VPCM powers.

• Persons proposing to carry out hazardous port activities. Any person who proposes to carry out a hazardous port activity in the port of Melbourne must apply for, and hold, an authority before conducting the activity (reg 10(1)-(3)). The statutory duty to hold an authority is an affirmative precondition to activity.
• Holders of authorities and their employees, agents and contractors. Holders of authorities are subject to the conditions attached to authorities and must comply with VPCM standards or guidelines as specified (reg 12). Holders must produce their authority for inspection when requested by VPCM, a port safety officer or a police officer (reg 19). The suspension and cancellation powers, and the notice procedures, apply directly to holders (regs 13-19).
• Masters, vessel owners and vessel agents. The Regulations place duties on masters or require documents to be signed by masters where manifests are required for transfers of dangerous goods; reg 21(1) requires the manifest to be signed by the master, owner or agent of the vessel. Reg 23 allows VPCM to recover clean-up costs from the owner, master or agent of the vessel on which the hazardous port activity has occurred or been permitted to occur, so vessel-connected parties face potential civil exposure post‑incident.
• Persons managing a hazardous port activity. The person managing the hazardous activity, not merely the owner or vessel operator, must immediately notify VPCM of any incident involving the activity (reg 22). That management responsibility is a functional attribution of reporting duties.
• Occupiers of premises or vessels. VPCM may recover clean-up costs from the occupier of any premises or vessel upon which an incident has occurred or been permitted to occur (reg 23(2)(c)). Occupiers therefore carry financial risk for incidents that occur under their occupation.
• Persons who own, move or claim abandoned things. If VPCM can ascertain an owner, that owner may be directed to move the thing within five business days; failure to comply risks a penalty (reg 24(2)-(3)). Persons seeking to collect items moved by VPCM must follow the process stated in the written notice, supply required evidence of entitlement, and may face costs for recovery (reg 24(4)). Anyone who disposes of, sells or otherwise deals with abandoned things will also be affected by the register obligations that VPCM must maintain (reg 25).
• The VPCM and port safety officers. The Regulations are targeted at establishing VPCM’s powers and duties, and require VPCM to keep a register of abandoned things (reg 25). Port safety officers are given inspection roles (reg 19), and VPCM is given rights to recover costs and to set conditions and standards.
• The broader port user community. While not individually named, other authorised port activities and users are implicated in the refusal and suspension criteria: the VPCM may refuse or suspend an authority if the activity would significantly interfere with the orderly operation of the port or other authorised activities (reg 11(3)(b), reg 13(1)(d), reg 16(1)(b)). This creates an effect on scheduling, berth allocation and co‑existence of multiple activities.

Who pays. The immediate monetary exposures in the Regulations fall on holders of authorities for penalties for procedural breaches and on persons responsible for incidents through cost recovery. The penalties are stated in penalty units (for example 20 penalty units for certain breaches) with the Endnotes explaining how penalty unit values are calculated and the value for the 2020-21 financial year (Endnotes and explanatory details). VPCM bears administrative costs of administration and enforcement but can recover certain costs following incidents.

Who decides. VPCM is the decision-maker for authority issuance, conditions, suspensions, cancellations, variations, issuance of directions regarding abandoned things, and cost recovery action (regs 11-19, 23-25). Harbour master directions and Marine Safety Act notices and regulations prevail in cases of inconsistency (regs 7-9), meaning the harbour master and Marine Safety Act instruments can override aspects of VPCM decision-making to the extent of inconsistency.

What behaviour changes. The Regulations require formalisation of previously discretionary port practice into a permit regime, require earlier and recurring disclosure via notices and manifests, create immediate incident notification duties, and attach financial consequences to incidents and noncompliance. Operators must plan and document activity in advance to meet the 24-hour notice and manifest windows, hold and display appropriate authorities, and ensure internal controls and insurance cover to address cost recovery exposure.

This section isolates the explicit duties, powers and rights created by the text and identifies who must act and who may act under the Regulations.

Primary duties imposed on port operators and managers

• Duty to obtain an authority before carrying out a hazardous port activity (reg 10(1)-(3)). This is a precondition to lawful conduct, with a 20 penalty unit offence for noncompliance.
• Duty to provide notice for each proposed hazardous port activity at least 24 hours before activity commencement, with specified content describing type, location, date and time (reg 20(1)-(2)). Failure to provide the notice attracts a 20 penalty unit sanction.
• For transfers of dry or liquid dangerous goods, duty to prepare and deliver a manifest that includes type and quantity and is signed by the master, owner or agent, at least 24 hours prior to loading, unloading or transfer (reg 21(1)-(2)). Breach is a 20 penalty unit offence.
• Duty of immediate notification to the VPCM by the person managing a hazardous port activity in the event of incidents such as explosions, fires, harmful reactions, or escape/spill/leakage of bulk cargo or liquids (reg 22). Penalty 20 units.

Powers and discrete rights provided to VPCM

• Power to issue written authorities for hazardous port activities for periods not exceeding three years, on a risk-assessed basis (reg 11(1)-(2)). The authority may be confined to particular persons or classes, vessels or locations.
• Power to attach conditions to authorities, including mandating compliance with VPCM-developed standards, procedures or guidelines (reg 12(1)-(3)). Noncompliance with conditions attracts a 20 penalty unit penalty (reg 12(3)).
• Power to suspend, cancel or vary authorities on enumerated safety, environmental or port-management grounds, including when a holder has contravened these Regulations (regs 13 and 16). Suspension takes immediate effect on issuance (reg 13(2)(d)). Procedural obligations for notice and opportunity to submit written responses apply (regs 14 and 17).
• Power to require the production of an authority for inspection by VPCM, a port safety officer or a police officer, under penalty (reg 19).
• Power to recover reasonable costs incurred in clean-up actions following incidents from responsible parties and to enforce recovery as a debt in court (reg 23).
• Power to give directions to owners of identifiable abandoned things to move them from the port within five business days, and to serve notices if VPCM removes and stores items (reg 24).
• Duty to keep a register of all abandoned things removed or disposed of, with specified fields (reg 25).

Procedural and remedial features

• Procedural notices. Before suspending, cancelling or varying an authority on VPCM-identified grounds, VPCM must give written notice that sets out the opinion and reasons and must invite written submissions, allowing not less than seven days for response (regs 14(1)-(2); 17(1)-(2)). This is a required procedural step prior to cancelling or varying an authority under regs 16 and 17.
• Request-based changes. The holder may request suspension, cancellation or variation of an authority (regs 15 and 18).
• Immediate enforcement measures. Suspensions are specified to take effect immediately on being sent to the holder or the holder’s employee, agent or contractor carrying out the activity (reg 13(2)(d)). Cancellation or variation can take place during a period of suspension (reg 16(2)).
• Cost recovery as civil remedy. VPCM’s cost recovery is framed as a civil action, recoverable as a debt in a court of competent jurisdiction (reg 23(4)). Recoverable costs include labour, administrative and overhead costs (reg 23(3)).

Rights and limits of other actors

• Harbour master's primacy in inconsistencies. Where a direction under these Regulations is inconsistent with a harbour master's direction under Part 6.4 of the Marine Safety Act 2010, the harbour master prevails to the extent of the inconsistency (reg 9). Similarly, instruments made under the Marine Safety Act 2010 (s 184 notices and s 309 regulations) prevail over these Regulations to the extent of any inconsistency (regs 7-8).
• Rights of owners of abandoned things. Where VPCM removes and stores items, owners have the right to receive the written notice specified in reg 24(4), setting out collection procedures, evidence required to claim items, and the intended date of disposal. Owners have five business days to comply with directions to move things when a direction is served (reg 24(2)(c)).

Penalties and monetary framing

• The Regulations specify penalties by reference to penalty units. Multiple offences attract a 20 penalty unit penalty (for example regs 10(3), 12(3), 20(1), 21(1)-(2), 22). The obligation to produce an authority on request attracts a 10 penalty unit penalty (reg 19). The Endnotes set out the statutory mechanism for calculating penalty unit dollar amounts and show the value of a penalty unit for the financial year commencing 1 July 2020 as $165.22 (Endnotes and explanatory details).

These duties, powers and rights create an administrative landscape in which VPCM is the central regulator of hazardous activities and abandoned things, with procedural safeguards in the Regulations balanced against immediate operational response powers and civil recovery routes.

The Regulations specify a combination of criminal penalties expressed in penalty units and administrative enforcement mechanisms, together with civil remedies for cost recovery.

Criminal penalties by reference to penalty units

• 20 penalty units apply to several offences:
  • Conducting a hazardous port activity without an authority (reg 10(3)).
  • Failure by a holder to comply with conditions of an authority (reg 12(3)).
  • Failing to provide the notice for a proposed hazardous port activity at least 24 hours before the activity (reg 20(1)).
  • Failing to prepare or provide the required manifest for transfers of dangerous goods, and performing loading, unloading or transfer without prior provision of the manifest (reg 21(1)-(2)).
  • Failing to immediately notify the VPCM of an incident involving a hazardous port activity (reg 22).
• 10 penalty units apply to the obligation to produce an authority on request (reg 19) and to failure to comply with a direction to move an abandoned thing where the owner has been given that direction (reg 24(3)).

The Endnotes provide the statutory context for penalty units, explaining that penalty unit dollar values are set by the Monetary Units Act 2004 and the Sentencing Act 1991. For the financial year commencing 1 July 2020 the value of a penalty unit is $165.22 (Endnotes and explanatory details). Users should therefore calculate monetary exposure by multiplying the number of penalty units by the applicable penalty unit dollar value for the relevant financial year.

Administrative enforcement powers

• Authority management. VPCM can refuse, issue, suspend, cancel or vary authorities (regs 11, 13, 16). The instrument sets out the grounds for refusal, suspension, cancellation or variation (safety, environmental risk, interference with port operations, non‑compliance with conditions, contravention of Regulations). VPCM may suspend an authority where it reasonably believes carrying out a hazardous port activity under the authority could cause significant risk to persons, property, the environment, or interfere with port operations (reg 13(1)). Suspension takes immediate effect on being sent to the holder or the holder’s employee, agent or contractor (reg 13(2)(d)).
• Procedural requirements. Although VPCM has immediate suspension power, the Regulations require prior written notice and the opportunity to make written submissions with a minimum seven-day period before suspension or cancellation (regs 14 and 17), establishing a baseline procedural fairness requirement that VPCM must follow before taking non‑routine enforcement steps.
• Inspection. VPCM, port safety officers and police officers can request production of an authority for inspection (reg 19), supporting on-site enforcement and allowing identification of unauthorised activity.
• Cost recovery. VPCM may recover reasonable costs incurred in taking clean-up action resulting from incidents attributable to hazardous port activities (reg 23). Potential defendants for cost recovery include the person managing the hazardous port activity whose act or omission caused the incident, the vessel owner, master or agent, and the occupier of premises or vessel where the incident occurred or was permitted to occur (reg 23(2)). Recoverable costs expressly include labour, administrative and overhead costs (reg 23(3)), and may be recovered as a debt in a court of competent jurisdiction (reg 23(4)). VPCM thereby has a civil remedy in addition to enforcement through criminal penalties.
• Enforcement of abandoned things directions. Failure to comply with a direction to move an abandoned thing is a 10 penalty unit offence (reg 24(3)). VPCM also notifies owners after moving an item and may give notice of intended sale or disposal, and has the ability to recover costs associated with moving or storing the thing in the Magistrates' Court per the contents of the notice (reg 24(4)(e)-(f)).

Interaction with other enforcement bodies and instruments

• Harbour master and Marine Safety Act primacy. The Regulations explicitly subordinate to marine safety notices under s 184 and regulations under s 309 of the Marine Safety Act 2010 such that those instruments prevail to the extent of any inconsistency (regs 7-8). They also provide that where a direction under these Regulations conflicts with a harbour master’s direction under Part 6.4 of the Marine Safety Act 2010, the harbour master’s direction prevails to the extent of the inconsistency (reg 9). Practically, this means that VPCM’s enforcement actions and orders may be displaced or constrained by marine safety instruments and harbour master directions.
• Court enforcement. Criminal offences will be prosecuted in the relevant jurisdiction for penal enforcement. Cost recovery is civil and recoverable in a court as a debt (reg 23(4)). The notice for abandoned items explicitly references recovery in the Magistrates' Court for costs (reg 24(4)(f)).

Implementation details relevant to enforcement risk

• Penalty unit valuation. Monetary exposure in dollar terms requires conversion from penalty units. The Endnotes set out the mechanism and the 2020-21 value of $165.22 per penalty unit (Endnotes and explanatory details). Practitioners should check the current penalty unit value applicable for the relevant offence date.
• Evidential and procedural compliance. Several enforcement powers rely on documentary proof: manifest signatures (reg 21), production of an authority (reg 19) and written notices (regs 14 and 17). Enforcement action may hinge on demonstrable service and receipt of notices, and on proof of timeliness of 24-hour notices and the sending/receiving of suspension/cancellation notices, emphasising record-keeping and process for both VPCM and regulated parties.
• Cost recovery scope. Recoverable costs include labour and administrative overheads (reg 23(3)), but the Regulations do not list an exhaustive cost schedule. The absence of a prescribed tariff means that cost recovery will depend on reasonableness and proof of actual costs, subject to judicial scrutiny if disputed.

In summary, enforcement under the Regulations combines criminal penalties for breach, administrative sanctions over authorisations, on-site inspection powers and a civil cost-recovery route for incidents. The primacy rules with the Marine Safety Act and harbour master directions create an external check on VPCM authority where marine safety instruments apply.

The Regulations are not a stand-alone instrument; they operate explicitly within a web of other Victorian maritime and administrative statutes. The text sets out direct cross-references and priority rules that affect interpretation and operational application.

Statutory references inside the Regulations

• Port Management Act 1995. These Regulations are made under s 98 of the Port Management Act 1995 (reg 2). Multiple procedural references invoke sections of the Act for notice requirements and for removal powers, notably reg 20 is expressed to be "for the purposes of section 88M(2) of the Act", and reg 24 refers to movement under section 88Q(1) or (2) of the Act.
• Marine Safety Act 2010. The Regulations include three conflict-resolution provisions. If a provision of these Regulations is inconsistent with any notice published under s 184 of the Marine Safety Act 2010, the Marine Safety Act notice prevails to the extent of inconsistency (reg 7). Likewise, regulations made under s 309 of the Marine Safety Act 2010 prevail to the extent of inconsistency (reg 8). If a direction under these Regulations is inconsistent with a harbour master’s direction under Part 6.4 of the Marine Safety Act 2010, the harbour master’s direction prevails to the extent of the inconsistency (reg 9). These provisions mean that marine safety instruments and harbour master actions are higher-order controls in areas of overlap.
• Dangerous Goods Act 1985. The Regulations adopt the definition of dangerous goods from the Dangerous Goods Act 1985 when referring to dangerous goods transfers and manifests (reg 5). That incorporation means the scope of manifest and transfer duties depends on the statutory definition and classification regime in the Dangerous Goods Act 1985.
• Marine (Drug, Alcohol and Pollution Control) Act 1988. The definition of "master" is sourced from this Act (reg 5). This matters for signature obligations on manifests and for potential liabilities attributed to masters in reg 21 and reg 23.
• Sentencing Act 1991 and Monetary Units Act 2004. Penalties in the Regulations are specified in penalty units (regs 10(3); 12(3); 19; 20(1); 21(1)-(2); 22; 24(3)). The Endnotes set out that the Sentencing Act 1991 governs penalty units and that monetary calculation is governed by the Monetary Units Act 2004, with the 2020-21 penalty unit value published as $165.22 (Endnotes and explanatory details). Practitioners must use the correct, current penalty unit value to compute dollar amounts for fines.
• Subordinate Legislation Act 1994. The Endnotes note that the Regulations will sunset ten years after making under s 5 of the Subordinate Legislation Act 1994 (Endnote 1), which affects long-term regulatory planning and the likely need for renewal or replacement before October 2030.
• Interpretation of Legislation Act 1984 (ILA). The Endnotes remind readers that the ILA affects headings, notes, punctuation and the treatment of legislative items, and that certain style and interpretation features are in force (Endnote 1, Interpretation section). This matters for reading notes, examples and penalties as part of the statutory instrument.

Operational interactions and consequences

• Division of authority with the harbour master. Because harbour master directions under the Marine Safety Act prevail in cases of inconsistency (reg 9), a harbour master exercising powers under Part 6.4 of the Marine Safety Act can override a VPCM direction or requirement. Practically, this means port users must be attentive to both VPCM authorities and harbour master directions, and must prioritise the latter where conflicts arise.
• Dangerous goods classification and manifest obligations. The manifest and transfer duties turn on whether cargo is "dangerous goods" under the Dangerous Goods Act 1985 (reg 5; reg 21). The substantive classification, labelling and storage regimes in that Act therefore become operationally relevant to compliance with reg 21; compliance with the Dangerous Goods Act 1985 will intersect with manifest accuracy, timing and signature requirements.
• Interface with Port Management Act powers. The default statutory powers for removal and storage of goods (including between ss 88M and 88Q of the Port Management Act 1995 as invoked) are given procedural detail by these Regulations, for example by specifying notice contents and timeframes for owner compliance (reg 24) and the requirement that VPCM maintain a register (reg 25).
• Criminal and civil enforcement complementarity. The Regulations create both criminal offences and a civil recovery mechanism for clean-up costs (reg 23). The ability to pursue civil recovery as a debt complements typical criminal enforcement and creates a route for VPCM to recoup expenditures even where criminal prosecution may not proceed or be successful.

Limits and delegation

• Standards, procedures and guidelines. The Regulations permit VPCM to develop, publish or nominate standards, procedures or guidelines that may be imposed as conditions on an authority (reg 12(2)). Those instruments are not created by the Regulations themselves; their legal force, within the authorised delegated scope, arises when they are attached as authority conditions. Because the Regulations allow conditions to "include" VPCM standards, the substance of those standards is delegated and will determine practical compliance requirements.
• Priority structure. The explicit priority clauses (regs 7-9) make marine safety instruments and harbour master directions legally higher in the operational hierarchy. That affects conflict resolution and careful drafting of VPCM conditions to avoid inconsistency with marine safety instruments.

In sum, the Regulations must be read and applied against a backdrop of other Victorian maritime and administrative statutes. Duty-holders should not treat these Regulations in isolation; compliance requires attention to the Dangerous Goods Act 1985 for classification and the Marine Safety Act 2010 instruments and harbour master directions for operational priority, as well as to the Port Management Act 1995 for statutory removal powers invoked by the Regulations.

The Regulations themselves state the immediate statutory history that is relevant and provide an Endnotes section that records amendments and revocations.

• Revocations. The Regulations expressly revoke the Port Management (Port of Melbourne Safety and Property) Regulations 2010 and its 2012 amendment (reg 4(a)-(b)). The Explanatory details in the Endnotes identify the revoked instruments by statutory rule number: S.R. No. 115/2010 as amended by S.R. No. 125/2012 and S.R. No. 125/2012 respectively (Endnotes, Explanatory details).
• Entry into force. These Regulations were made on 6 October 2020 and came into operation on 18 October 2020 (reg 3; Endnotes).
• Sunset. The Endnotes state that the Regulations will sunset 10 years after the day of making, on 6 October 2030, in accordance with s 5 of the Subordinate Legislation Act 1994 (Endnote 1). That sunset provision is a statutory consequence of the Subordinate Legislation Act and is not an operative clause within the body of the Regulations themselves.
• Subsequent amendments. The Endnotes include a "Table of Amendments" which in this version indicates there are no amendments made to these Regulations by statutory rules, subordinate instruments or Acts (Endnote 2). The "Amendments Not in Operation" section confirms that this version does not contain amendments that are not yet in operation (Endnote 3).

Practical implications of the amendment history

• Replacement, not incremental change. The instrument replaced the prior regulatory regime rather than amending it incrementally. Users familiar with the 2010/2012 instruments should treat the 2020 Regulations as the operative text as of 18 October 2020 (reg 3).
• No amendment history to date. The Endnotes show no further amendments as at the version date (18 October 2020). This means that, absent later statutory rules or Acts, the obligations, penalties and procedures set out in this instrument are the current legal position until a statutory amendment or replacement.
• Review and renewal considerations. The statutory sunset on 6 October 2030 makes it predictable that before that date either the Regulations will be remade, extended, or replaced, or alternative arrangements provided. Regulated parties should plan for potential change as that date approaches.

Because the statutory text contains no subsequent amendment entries, the best available record for changes is the Endnotes’ assurance that no amendments have been made as at the version date. Practitioners should check for any statutory rules or Acts made after 18 October 2020 to identify amendments not contained in this source.

The source material supplied contains no case law, judicial decisions or recorded litigation relating to these Regulations. The Endnotes and Explanatory details list legislative provenance, revocations and the absence of amendments, but do not record any judicial commentary, appeals, or reported prosecutions arising from the Regulations.

Implications for practitioners and researchers

• No reported judicial interpretation in the source. Because the Regulations are presented without accompanying litigation history, there is no judicial construction of terms such as "hazardous port activity", "reasonable belief", "reasonable costs", or the interplay between immediate suspension and the procedural notice requirements. That leaves key textual points open to interpretation in future disputes if enforcement actions are challenged.
• Evidentiary and interpretive questions likely to arise. In future litigation, typical contested issues would likely include the meaning of "reasonably believes" for suspension or cancellation grounds (regs 13 and 16), the scope of "reasonable costs" recoverable by VPCM (reg 23), the adequacy of procedural notice and the seven‑day minimum for submissions (regs 14 and 17), and conflicts between VPCM conditions and harbour master directions or Marine Safety Act instruments (regs 7-9). Absent judicial guidance, those points will initially be matters for administrative practice and for negotiation between VPCM and regulated parties.
• Monitoring required. Practitioners advising affected parties should monitor Victorian court reports, administrative tribunal decisions, and any VPCM published guidelines or standards for authoritative content that will likely shape enforcement practice in the absence of case law.

In sum, the Regulations do not carry a litigated history within the supplied text. Future litigation could develop around interpretative and procedural tensions identified in the Regulation text, and practitioners should treat this as an untested statutory regime at the time of the version supplied.

This section flags points in the Regulations that are likely to cause practical compliance problems, commercial surprises or that generate legal ambiguity from the text as written. Each is grounded in the statutory wording or in the absence of explicit text.

1. Authority vs per-event notice. The Regulations require both a standing authority to carry out hazardous port activities (reg 10(1)-(3); reg 11) and a per-event notice at least 24 hours before each proposed activity (reg 20(1)). Practically, holding an authority does not remove the need to provide a 24-hour event-specific notice. Failure on either front exposes to a 20 penalty unit fine (reg 10(3), reg 20(1)). Parties must integrate both regimes into operational planning.

2. Manifest timing and signature requirements. For transfers of dangerous goods the manifest must be signed by the master, owner or agent and provided to VPCM at least 24 hours beforehand (reg 21(1)-(2)). This can be logistically challenging for short-notice vessel operations, bunkering, or last-minute ship substitutions. There is no provision for reducing the 24-hour window or for emergency exceptions in the text.

3. Immediate suspension coupled with pre-suspension notice. Regulation 13(2)(d) provides that a suspension "takes effect immediately on being sent to the holder"; but regs 14 and 17 require VPCM to give written notice and allow a minimum seven-day period for written submissions "before suspending" or "before cancelling or varying". The text therefore appears to require VPCM to give the notice and allow submissions before taking suspension/cancellation action, but the immediate effect clause could apply where the notice itself is sent and suspension takes effect at that moment. The practical effect is that a suspension can be immediate when the notice is served, but VPCM must have given the preliminary written notice and allow the minimum seven-day submission period before cancelling or varying the authority. The precise procedural sequencing may become contested in enforcement disputes where a holder claims insufficient opportunity to respond.

4. Unspecified content of VPCM standards and guidelines. The Regulations permit conditions to include compliance with VPCM-developed standards, procedures or guidelines (reg 12(2)), but do not require those instruments to be published, accessible, or subject to consultation as part of the Regulations. If VPCM attaches standards by reference, regulated parties may face uncertainty about the content and enforcement of those standards until they are explicitly provided. This creates a practical compliance risk where a condition refers to a non-public document.

5. Broad civil recovery of costs with minimal specification. VPCM can recover "reasonable costs" including labour and administrative overheads for clean-up (reg 23(1)-(3)). The Regulations do not provide a detailed cost schedule or method of calculating overheads. Disputes may arise over what is "reasonable" and whether certain categories of cost are recoverable. Recovery as a debt in court (reg 23(4)) provides a civil remedy, but also presents litigation risk where the scope of recoverable costs is contested.

6. Ambiguity about who is the "person managing" an activity. The incident notification duty is placed on "the person managing a hazardous port activity" (reg 22). The text does not define that term; it could include the holder of the authority, a contractor, a ship operator or an on-site manager. In multi-party arrangements the allocation of notification duties should be clarified contractually to avoid regulatory and civil exposure.

7. Penalty unit dollar value changes. Monetary exposure is calculated by reference to penalty units and the Monetary Units Act 2004, with the value of a penalty unit changing each financial year (Endnotes and explanatory details). Practitioners must ensure they use the applicable penalty unit value when advising on potential fines.

8. Interaction with Marine Safety Act instruments and harbour master directions. Where a VPCM direction conflicts with a harbour master direction or a Marine Safety Act notice or regulation, the marine safety instruments prevail (regs 7-9). Parties must therefore check harbour master notices and marine safety regulations in addition to VPCM authorities to ensure compliance, and cannot assume that compliance with a VPCM condition is sufficient where marine safety instruments require something different.

9. Abandoned things timing and rights. A VPCM direction to move an abandoned thing takes effect immediately on being sent to the owner and requires movement within five business days (reg 24(2)(d)-(c)). If VPCM moves a thing under s 88Q of the Port Management Act 1995, it must serve a written notice "as soon as reasonably practicable" after the thing is moved (reg 24(1)(b)). The timelines for collection and the evidence required to claim goods are specified in witnessable detail in reg 24(4), and VPCM can indicate an intended sale or disposal date. Owners should act quickly on any such notices.

10. No judicial guidance in the text. As noted in Litigation history, there are no cases included in the source. Therefore key interpretive questions remain untested until disputes arise.

For regulated parties the practical takeaways are: implement integrated procedures that cover authority acquisition, per-event notice and manifest submission; ensure clarity in contracts about who is the managing person for incident reporting; maintain rapid response processes for notices from VPCM; and budget for potential clean-up cost recovery and penalty-unit exposure.

This section sets out concrete steps and controls that holders, vessel operators, masters, agents and occupiers should adopt to comply with the Regulations, with references to the relevant provisions.

1. Obtain and maintain the appropriate authority

• Apply for an authority in the VPCM-approved form well before operations commence (reg 10(1)-(2)). Because authorities may run for up to three years and are subject to a VPCM risk assessment (reg 11(1)), start the application early to allow for assessment and incorporation of conditions.
• Keep the authority document physically and electronically accessible, and ensure nominated persons can produce it on request by VPCM, a port safety officer or a police officer (reg 19). Non-production is a 10 penalty unit offence.

2. Design and implement per-event notification processes

• Create an operational protocol that ensures 24-hour notices for each proposed hazardous port activity are prepared and delivered to VPCM in compliance with reg 20(1)-(2). The notice must include type of activity, precise proposed location in the port, and date and time. Automate reminders and approvals to avoid last-minute lapses that would attract a 20 penalty unit fine.
• For transfers of dry or liquid dangerous goods, maintain manifest procedures that ensure the manifest lists type and quantity, and is signed by the master, owner or agent of the vessel (reg 21(1)). Ensure the manifest is provided to VPCM at least 24 hours before loading, unloading or transfer (reg 21(2)).

3. Integrate VPCM standards and authority conditions into operational manuals

• When an authority is issued, identify any conditions attached and embed them in the company’s operational manuals and crew briefings. Conditions may require compliance with VPCM standards, procedures or guidelines (reg 12(2)). Request copies of any referenced standards from VPCM if not provided.
• Maintain records demonstrating compliance with conditions, including checklists, training records and equipment maintenance logs, to show due diligence in case of enforcement action.

4. Incident preparedness and reporting

• Designate the person or role that is "the person managing a hazardous port activity" for each operation, and document this in contracts and operational plans. That designated manager must immediately notify VPCM of any incident involving the hazardous port activity, including explosions, fires, harmful reactions, and escapes/spills/leakages of bulk cargo or liquids (reg 22).
• Develop an incident-response protocol that includes immediate notification templates, containment actions, and evidence preservation, as well as procedures for liaising with VPCM. Keep records of notifications and acknowledgements.

5. Financial planning for cost recovery exposure

• Arrange insurance that covers potential clean-up costs and consider contractual indemnities for third-party contractors and vessel operators. VPCM may recover reasonable clean-up costs, including labour and administrative overheads, from the person managing the activity, the owner/master/agent of the vessel, or the occupier (regs 23(1)-(3)). Ensure contract clauses allocate responsibility and insurance cover for incidents.
• Maintain records and time sheets to document costs where a party may be subject to recovery claims; clear documentation will be necessary if VPCM seeks recovery and the matter proceeds to court.

6. Respond to VPCM notices and procedural steps

• If VPCM issues a written notice indicating that it considers a ground for suspension, variation or cancellation may exist, respond with a written submission within the time specified, noting that VPCM must allow not less than seven days for submission (regs 14(1)(a)(iii); 17(1)(a)(iii)). Prepare factual and legal points addressing the VPCM’s stated reasons.
• If a suspension is received, comply immediately with its terms given that suspensions take effect on being sent (reg 13(2)(d)). Simultaneously prepare a written response and remedial plan.

7. Abandoned things handling

• If notified under reg 24 to move an abandoned thing, comply within five business days or retain documentary evidence of any reasonable excuse for failure to comply (reg 24(2)-(3)). Keep a clear chain of title, receipts and storage information in case VPCM moves the item.
• If VPCM has moved and stored an item, follow the notice instructions for claiming the item and provide the evidence required to establish entitlement, as set out in the written notice (reg 24(1)(b); reg 24(4)(d)(iv)). Be prepared to cover costs associated with moving or storing the thing; the notice will explain the VPCM’s intended disposal date.

8. Contractual allocation and clarity

• Ensure contracts with contractors, stevedores, vessel owners, masters and agents clearly allocate responsibility for obtaining authorities, preparing manifests, providing notices, managing operations and incident reporting. Because obligations fall on different parties depending on role and on who is the "person managing", contractual clarity can prevent regulatory exposure and ease cost-recovery allocation.

9. Maintain an audit trail and compliance documentation

• Keep copies of all applications, authorities, notices sent and received, manifests, incident reports, correspondence with VPCM, and invoices for clean-up costs. Given that VPCM may seek to recover costs as a debt in court (reg 23(4)), contemporaneous records will be essential to contesting or quantifying alleged exposures.
• For businesses holding multiple authorities or operating across multiple locations in the port, maintain a central compliance register mapping authorities, conditions, expiry dates, and notices provided.

10. Monitor related instruments and roles with primacy

• Regularly check Marine Safety Act notices under s 184, regulations under s 309 of the Marine Safety Act 2010, and harbour master directions under Part 6.4, since those instruments prevail to the extent of inconsistency with these Regulations (regs 7-9). Ensure that operational controls satisfy both VPCM authority conditions and any applicable marine safety or harbour master requirements.

11. Update penalty calculations annually

• When advising on fines or budgeting for potential exposure, convert penalty units to dollar amounts using the applicable penalty unit value for the relevant financial year, as required by the Monetary Units Act 2004 and the Sentencing Act 1991 (Endnotes and explanatory details).

Following these steps will materially reduce regulatory and enforcement risk under the Regulations. The central practical controls are process discipline for authorities and 24-hour notices/manifests, incident readiness for immediate notification, contractual clarity on roles, and good record-keeping for both compliance and potential cost-recovery disputes.
