88N Hazardous port activity direction (1) If a port safety officer for the port of Melbourne is satisfied that a hazardous port activity is being carried out or is proposed to be carried out in port of Melbourne waters or on port of Melbourne land, the officer may give a direction in writing to the person who is carrying out or who proposes to carry out the activity. (2) A direction under subsection (1) may— (a) direct a person who is carrying out an activity to cease carrying out the activity; or (b) direct a person within a specified area of the port to leave the area; or (c) direct a person in the port to leave the port. (3) A port safety officer for the port of Melbourne may, if it is reasonable to do so, give an oral direction about any matter on which a direction may be given under subsection (1) to any person who is carrying out or who proposes to carry out a hazardous port activity.
