73S Procedure for taking disciplinary action—show cause notice (1) This section applies if Ports Victoria proposes to take disciplinary action against a licence holder under this Division. (2) Ports Victoria must serve on the licence holder a notice (a ***show cause notice***) that— (a) specifies the proposed disciplinary action (including any proposed period of suspension); and (b) specifies the grounds for the proposed disciplinary action; and (c) contains an outline of the facts and circumstances forming the basis for the grounds for the proposed disciplinary action; and (d) invites the licence holder to make a written submission within a specified period as to why the proposed disciplinary action should not be taken; and (e) states the consequences for the licence holder of not responding to the notice. (3) For the purposes of subsection (2)(d), the period specified in the show cause notice must be a period of at least 20 business days after the day on which the show cause notice is served on the licence holder.
