Port Kennedy Development Act 2017

Definitions and plan-driven amendments. The Act relies on a small number of definitional anchors and certified plans to locate and operate its changes. The principal defined concepts are Area A and Area B, which are only meaningful by reference to the Port Kennedy Revised Development Plan and the Rockingham development zone plan held and certified by the Commission (s 3(1)). The Commission itself is defined by reference to the Planning and Development Act 2005 (the Planning Act) (s 3(1)). The Metropolitan Region Scheme and the Rockingham local planning scheme are invoked by name (s 3(1)).

Statutory amendment of mapping-based instruments. The Act effects changes of reservation and zoning under the Metropolitan Region Scheme by statutory declaration: Area A is reserved as Parks and Recreation and Area B is zoned Urban where not already Urban (s 4(1)-(2)). It effects corresponding rezoning under the Rockingham local planning scheme by statute, moving land in Area B that is not in the Development Zone into the Development Zone (s 5(1)). The Act treats the certified Commission plans as the operative mapping instruments for definition and provides that a plan purporting to be a copy is admissible evidence in proceedings (s 4(3), s 5(2)).

Interaction with the Planning Act. Section 6(1) states the amendments effected by Part 2 have effect as though enacted under the Planning Act. That imports a legal equivalence between the Part 2 amendments and standard Planning Act amendments. However, s 6(2) creates a specific exception: Planning Act s 126(3) to (6) do not apply to the MRS amendment effected by s 4(2). The effect of that exclusion is operationally significant because it removes the application of those specific Planning Act sub‑provisions to this particular MRS amendment. The Act otherwise preserves the continuing operation of the Planning Act with respect to the amendments (s 6(3)).

Evidentiary and schematic caveats. The Act makes the Commission’s certified plans determinative for boundaries and labels the schedules to the Act “indicative only” (s 3(2), s 3(3), schedules). The evidentiary rule in s 4(3) and s 5(2) means that in litigation or other proceedings a plan purporting to be a copy of the certified plan is admissible as evidence of boundaries; practitioners should therefore treat the certified plan on file at the Commission as the primary source of legal description for Area A and Area B.

Statutory repeal and consequential amendment. The Act repeals the Port Kennedy Development Agreement Act 1992 (s 7) and removes the corresponding clerical reference in the Aquatic Resources Management Act 2016 (s 8(2)). The repeal is expressed without express transitional or savings provisions within the text of this Act.

Commencement mechanics. Part 1 (short title, commencement) commenced on the day of Royal Assent; the remainder commenced on proclamation (s 2). The compilation table records those dates (Royal Assent 15 Sep 2017; remainder by proclamation 27 Feb 2018).

Together, these concepts show the Act functions as a narrow, plan-driven statute that reclassifies land use categories on the MRS and local zoning maps and removes an earlier statutory framework for Port Kennedy while anchoring the exact boundaries and legal descriptions to plans certified and held by the Commission (s 3-6, s 7-8).

Primary statutory actors and maps. The Commission is central: it holds and certifies the Port Kennedy Revised Development Plan and the Rockingham development zone plan that define Area A and Area B (s 3(1)); the evidentiary provisions reference those Commission-held plans (s 4(3), s 5(2)). The Planning Act and the Rockingham local planning scheme are the institutional frameworks within which the amendments operate (s 3(1), s 6(1), s 6(3)). The Rockingham local planning scheme is explicitly identified as the City of Rockingham Town Planning Scheme No. 2 , District Zoning Scheme (s 3(1)), so the City of Rockingham as local government is an implicated administrative actor.

Owners and occupiers of land inside Area A and Area B. Any land that falls within the boundaries certified by the Commission as Area A or Area B is directly affected because the statutory reservation/zoning changes apply to those parcels by reference to the plans (s 3(1), s 4(1)-(2), s 5(1)). The Act alters the statutory land-use classification under the Metropolitan Region Scheme and the local scheme for the identified parcels. The Act itself is the instrument of change; it does not set out compensation or transitional arrangements within its text.

Parties involved in the revised project. The Act’s prefatory material states the purpose includes providing for planning changes “to allow a revised Port Kennedy project to proceed”. That is an expressed policy claim in the Act but the statutory mechanism is the rezoning and reservation changes in Part 2 (prefatory lines; s 4-5). Entities with an interest in pursuing development consistent with “Urban” or “Development Zone” zoning may therefore have the statutory conditions necessary to seek development approvals under the Planning Act and the local scheme.

Users of planning information and litigants. The evidentiary rule (s 4(3), s 5(2)) means lawyers, surveyors, title searchers and courts will look to the Commission copy as the authoritative depiction of boundaries. The schedules are expressly indicative only (s 3(2), s 3(3)), so reliance on the schedule images in the Act text is not sufficient to establish boundary lines in proceedings without reference to the certified Commission plans.

Administrations and statutes with cross‑references. The repeal of the Port Kennedy Development Agreement Act 1992 (s 7) and the removal of its entry from the s 377 table of the Aquatic Resources Management Act 2016 (s 8(2)) affect any administrative processes, licences or cross-references that referred to the 1992 Act; those references will need to be reconciled administratively where they previously relied on the repealed statute.

Practitioners and compliance officers. The Act puts a premium on obtaining and reviewing the certified plans from the Commission and understanding the exclusion in s 6(2) of certain Planning Act sub-provisions as they apply to the MRS amendment effected by s 4(2). Anyone advising a client on development potential, planning approvals, or title implications for land in Port Kennedy must consult the Commission file and the local scheme as amended by the Act.

Public and stakeholders. The Act itself does not create a consultation or public-notification mechanism inside its text; it effects the changes by statute. How public participation and discretionary approvals will be handled thereafter is governed by the Planning Act and the local planning instrument, subject to the specific exclusion noted in s 6(2). The Act therefore affects both those with concentrated interests (owners, developers) and those with diffuse claims (neighbourhood or conservation interests) by altering statutory land-use classifications without embedding a statutory consultative pathway in this Act.

Statutory duties and the legal effect of certified plans. The Act does not create new duties expressed as obligations to perform acts, nor does it create new permitting regimes. Its operative legal effects are (a) to impose a statutory change of reservation and zoning for defined parcels by reference to the Commission-certified plans (s 4(1)-(2), s 5(1)); and (b) to make those certified plans admissible as evidence in proceedings (s 4(3), s 5(2)). The immediate legal rights that flow are the ability to rely on the statutory rezoning/reservation in applications and proceedings and the capacity to use a plan purporting to be a copy as evidence of boundaries.

Interaction with existing planning duties and rights under the Planning Act and local scheme. Section 6(1) provides that the amendments have effect as though enacted under the Planning Act, which imports into the legal status of the amendments whatever substantive and procedural effects the Planning Act ordinarily confers on scheme amendments. That means duties, approvals, development control criteria and rights of appeal that the Planning Act and the Rockingham local planning scheme normally provide for “Urban” and “Development Zone” land will be available to apply to the land as rezoned by this Act, subject to the exclusion in s 6(2). Section 6(3) expressly preserves the operation of the Planning Act with respect to the amendments as amended by this Part.

Exclusion of specified Planning Act sub‑provisions. Section 6(2) says Planning Act s 126(3) to (6) do not apply to the amendment to the Metropolitan Region Scheme effected by s 4(2). The Act therefore creates a legal difference in the procedural or substantive landscape for that specific MRS amendment compared with other Planning Act amendments where s 126(3)-(6) would operate. The Act does not itself restate what those Planning Act sub‑provisions require or disapply; practitioners must consult the Planning Act to identify the content and practical implications of the exclusion.

Evidentiary privilege of Commission-held plans. By making a plan purporting to be a copy of the Commission-certified plans admissible as evidence of boundaries (s 4(3), s 5(2)), the Act places an evidentiary burden-lifting mechanism in favour of parties relying on the statutory amendments. The right to tender such a plan in proceedings is a procedural benefit; the duty is to seek the certified plan at the Commission and to ensure any copy tendered is a true copy purporting to be such.

Repeal and the absence of explicit savings. The Act repeals the Port Kennedy Development Agreement Act 1992 (s 7) with no express transitional or saving clauses in this Act text. Where rights, duties or instruments derived from the 1992 Act previously existed, their continued operation, extinguishment or replacement is not addressed by express provision in this Act. That absence is itself a legal fact to be treated as potentially relevant to questions of residual rights and obligations.

No new fees, approvals or enforcement powers in this Act. The text contains no provisions imposing new financial obligations, creating regulatory offences, or conferring enforcement powers beyond the ordinary enforcement framework of the Planning Act and local scheme. The Act is narrowly focused on statutory rezoning, evidentiary provision and repeal (Part 2 and Part 3).

Who decides. The Act vests the authoritative description of the affected areas in the Commission-certified plans (s 3(1)). The Commission’s role in certifying the plans is pivotal because the statutory rezoning/reservation operates by reference to those plans. Subsequent planning approvals, conditions and enforcement will follow the Planning Act and local planning scheme mechanisms, which remain in operation except where s 6(2) carves out Planning Act s 126(3)-(6) for the specific MRS change.

No new offences or penalty regime in this Act. The Port Kennedy Development Act 2017 contains no express criminal or civil penalty provisions, no infringement framework and no bespoke enforcement powers. It effects planning changes and statutory repeal; it does not create new sanctioning mechanisms in its text.

Enforcement will therefore be exercised under the existing Planning Act and local planning scheme regimes. Section 6(1) states the Part 2 amendments “have effect as though the amendments were enacted under the Planning Act” and s 6(3) reserves the operation of the Planning Act with respect to the amendments. Consequently, any penalties, enforcement notices, compliance actions, or appeal rights that the Planning Act and the Rockingham local planning scheme provide for breaches of planning controls on land zoned Urban or in a Development Zone will apply to the reclassified land. The Act does, however, exclude Planning Act s 126(3)-(6) for the s 4(2) MRS amendment (s 6(2)); if any enforcement or appeal mechanisms would have been located in those sub‑sections, they will not be available in relation to that narrow MRS amendment. The Act itself does not replicate or restate those provisions.

Evidentiary effect and litigation posture. The evidentiary provisions in s 4(3) and s 5(2) make a plan purporting to be a copy of the Commission-certified plans admissible evidence of the boundaries in proceedings. This evidentiary backing is likely to streamline disputes about whether a parcel falls within Area A or Area B in enforcement or development litigation because courts may accept such a copied plan as evidence of boundaries without a more elaborate provenance requirement. The Act does not specify standards for proving authenticity beyond the phrase “purporting to be a copy”, so litigants may still litigate authenticity or relevance depending on the circumstances.

Repeal consequences and administrative enforcement issues. The repeal of the Port Kennedy Development Agreement Act 1992 (s 7) may affect enforcement or compliance frameworks that previously relied on provisions in that Act. Because this Act does not set out transitional enforcement arrangements or savings for instruments, licences, easements or powers created under the 1992 Act, questions may arise in administrative practice about the continuing validity of instruments issued under the repealed statute and the appropriate enforcement mechanisms where compliance relates to historical obligations. Those questions will need to be resolved under general statutory interpretation and administrative law principles or, if necessary, by reference to other statutes that continue to provide enforcement powers.

No express civil remedies created. The Act does not create private rights of action or new statutory remedies. Any civil consequences arising from the amendments will derive from the operation of general planning law under the Planning Act and the local planning scheme, and from existing property law principles.

Practical enforcement implication. In short, enforcement mechanisms relevant to land after the rezoning and reservation changes will be those already present in the Planning Act and Rockingham local planning scheme, applied to land that is, by statute, newly classified or rezoned under this Act. The only in‑Act enforcement-like mechanism is the evidentiary rule for Commission-certified plans in proceedings (s 4(3), s 5(2)).

Statutory layering with the Planning Act. The Act explicitly anchors its amendments to the Planning Act regime by stating the Part 2 amendments “have effect as though the amendments were enacted under the Planning Act” (s 6(1)). That language gives the amendments the same legal status as Planning Act amendments in substantive effect, subject to the specific exclusion in s 6(2). Therefore, the wider body of rights, duties, approval pathways, and enforcement mechanisms in the Planning Act and the Rockingham local planning scheme are engaged by the reclassification of Area A and Area B.

Targeted carve-out from the Planning Act. The Act disapplies Planning Act s 126(3)-(6) with respect to the MRS amendment effected by s 4(2) (s 6(2)). The Act does not reproduce or redefine those Planning Act sub‑provisions; it merely excludes their application to that particular amendment. Practitioners must therefore read the Planning Act in combination with this Act to determine which Planning Act processes and protections persist and which do not for the s 4(2) amendment.

Local planning scheme interaction. Section 5(1) operates directly on the Rockingham local planning scheme by rezoning Area B (if not already in the Development Zone) to the Development Zone. The Rockingham local planning scheme identified in s 3(1) is the City of Rockingham Town Planning Scheme No. 2 , District Zoning Scheme. The Act therefore operates at both the metropolitan regional scale (Metropolitan Region Scheme changes) and the local scale (local planning scheme changes).

Evidentiary interaction and judicial procedures. The admissibility rule for copies of the Commission-certified plans (s 4(3), s 5(2)) interacts with standard rules of evidence and procedure in litigation and administrative review. It effectively streams admissibility of plan copies as evidence of boundaries, altering the practical evidential burden in disputes about whether land falls within Area A or Area B. The schedules to the Act are expressly “indicative only” so they do not displace the primacy of the Commission-held certified plans (s 3(2), s 3(3)).

Consequential amendment to an unrelated statutory schedule. Section 8(2) deletes the entry relating to the Port Kennedy Development Agreement Act 1992 from the table in s 377 of the Aquatic Resources Management Act 2016. That is a clerical consequential amendment to remove a reference to the now-repealed 1992 Act. The Act does not otherwise amend the Aquatic Resources Management Act substantively.

Repeal and potential cross‑statutory gaps. The Act repeals the Port Kennedy Development Agreement Act 1992 without inserting express savings or transitional provisions within this Act. If other statutes or subordinate instruments previously cited or relied upon the 1992 Act, those cross‑statutory references will now fail or require administrative adjustment. The Act’s silence on transitional arrangements means readers must check for lingering references in other legislation or in existing administrative instruments or titles that may have been created under the repealed Act.

Commencement interaction. Part 1 (short title and commencement) comes into effect on Royal Assent; the rest is by proclamation (s 2). Practitioners must note that timing because interactions with other statutory processes or approvals may depend on the precise commencement date of the amendments. The compilation table records the commencement of the rest of the Act by proclamation on 27 February 2018.

No express amendment of other substantive statutes. Beyond s 8(2), the Act does not directly amend any other statute’s substantive provisions. Its principal interactions are with the Planning Act regime, the Rockingham local planning scheme, and the administrative processes of the Commission.

Commencement and dating. Section 2 provides a two-step commencement: Part 1 (preliminary) commences on the day of Royal Assent and the rest of the Act on a day fixed by proclamation (s 2). The compilation table in the Act indicates Royal Assent occurred on 15 September 2017 and the rest of the Act commenced by proclamation on 27 February 2018. These dates are internal to the Act’s compilation metadata.

No in‑Act amendments after enactment recorded in the text provided. The text supplied is a single consolidated compilation of the Port Kennedy Development Act 2017 as at the compilation date in the source. The Act itself contains no provisions that amend earlier statutes other than the repeal of the Port Kennedy Development Agreement Act 1992 (s 7) and the deletion of the corresponding entry in s 377 of the Aquatic Resources Management Act 2016 (s 8(2)).

Repeal of the 1992 Act. The Act repeals the Port Kennedy Development Agreement Act 1992 (s 7). The Act does not contain express transitional provisions preserving rights and obligations that may previously have been created under the 1992 Act; the repeal is expressed in a straightforward manner.

Consequential amendment. Section 8 amends the Aquatic Resources Management Act 2016 by deleting from the table in s 377 the item relating to the 1992 Act (s 8(2)). That is the only consequential legislative amendment recorded within this Act.

Schedules and indicative plans. The Act inserts or attaches two schedules containing indicative depictions: Schedule 1 for the Port Kennedy Revised Development Plan and Schedule 2 for the Rockingham development zone plan. Those schedules are expressly “indicative only” (s 3(2), s 3(3)). The Act’s operative definitions require reference to the plans “held at the office of the Commission and certified by the Commission” (s 3(1)). Thus the operative amendment history for mapping takes place at the moment the Act commenced and when the Commission certified the plans and held them on its file.

No amendment of the Planning Act within this Act. The Act does not itself amend the Planning and Development Act 2005 textually; it instead provides that the Part 2 amendments have effect as if enacted under the Planning Act (s 6(1)). The only express textual carve-out is the non-application of Planning Act s 126(3)-(6) to the s 4(2) amendment (s 6(2)).

No recorded subsequent legislative changes within the supplied text. The compilation contains only the original Port Kennedy Development Act 2017 text and its immediate consequential deletion in the Aquatic Resources Management Act 2016; no subsequent amendments to the Port Kennedy Development Act itself are shown in the supplied material.

No reported judicial decisions are recorded in the Act text. The supplied legislation contains no case law, references to litigation, or notes of judicial interpretation relating to the Port Kennedy Development Act 2017. The compilation as supplied does not include any annotated case history.

Potential litigation loci implied by the Act. Although the Act itself does not record cases, the statutory provisions create a number of potential issues that could give rise to judicial or administrative review, depending on factual disputes and subsequent administrative action. Those issues include, by reference to the Act’s text:

• Authenticity and admissibility of copies of the certified plans. Sections 4(3) and 5(2) make a plan “purporting to be a copy” of the Commission-certified documents admissible as evidence of the boundaries. Disputes may arise about whether a document “purports to be a copy” and about the authenticity or accuracy of the copy in particular cases.

• Validity or legal effect of the statutory rezoning and reservation. Because the Act effects rezoning and reservation by statute rather than through the ordinary Planning Act administrative amendment process, parties could litigate questions of construction or effect, for example whether a particular parcel falls within the boundaries described on the certified plans.

• Consequences of the repeal of the Port Kennedy Development Agreement Act 1992. Litigation or administrative proceedings could occur about whether instruments, easements, development approvals or contractual rights that were dependent on the 1992 Act survive the repeal or require separate statutory or administrative recognition. The Act does not contain express savings clauses, which can be a litigable point where parties contend rights were extinguished.

• Interaction with the Planning Act and the s 126(3)-(6) carve-out. Because s 6(2) disapplies Planning Act s 126(3)-(6) for the s 4(2) MRS amendment, disputes could arise about the intended scope of that carve-out and its consequences for procedural rights or obligations. Any litigation about administrative process likely would require reference to the Planning Act text.

Absence of recorded litigation. The Act text as provided does not report any decisions or challenges. Practitioners and researchers seeking a litigation history will need to search court and tribunal databases and the records of administrative reviews after verifying the relevant commencement date(s) set out in s 2 and the compilation table.

Practical note for litigators. If proceedings are contemplated, the Commission-held certified plans are the primary documentary source to tender or challenge (s 3(1), s 4(3), s 5(2)). Where a claim depends on the applicability of Planning Act procedures, counsel must check the Planning Act text for s 126(3)-(6) to assess what rights or processes have been disapplied by s 6(2) of this Act.

Certified plans are decisive, schedules are only indicative. The Act defines Area A and Area B by reference to certified plans held at the Commission (s 3(1)). The schedules in the Act are expressly “indicative only” (s 3(2), s 3(3) and the schedule headings). Practitioners who rely on the visual schematics in the schedule images without consulting the certified plans at the Commission risk acting on non‑authoritative depictions. For boundary questions in proceedings, the statutory evidentiary rule points to the Commission copies (s 4(3), s 5(2)).

Evidentiary wording is narrow but consequential. Sections 4(3) and 5(2) state that a plan “purporting to be a copy” of the certified plans is evidence of the boundaries. That language is helpful but not absolute: it permits a copy to be admitted as evidence but does not immunise it from challenge on authenticity or accuracy in particular circumstances. A party relying on a copied plan should ensure proper chain of custody and provenance to avoid contested authenticity issues.

Carve‑out of Planning Act sub‑provisions. Section 6(2) disapplies Planning Act s 126(3)-(6) for the MRS amendment effected by s 4(2). The practical implications depend entirely on what s 126(3)-(6) provide. Users of this Act cannot assume the usual Planning Act processes for that amendment; they must inspect s 126 in the Planning Act to understand what procedural or substantive protections have been removed for this particular MRS change. The Act itself provides no explanation of the consequences of the carve-out.

No express savings for the repealed Act. The Act repeals the Port Kennedy Development Agreement Act 1992 (s 7) and deletes the entry in the Aquatic Resources Management Act 2016 (s 8(2)) but contains no express transitional or saving provisions concerning rights, approvals, contracts or instruments made under the repealed 1992 Act. Where instruments or obligations were created under the 1992 Act, their status after repeal is a live legal question not settled by this Act’s text.

No new approvals or conditions in the Act text. The statute changes reservations and zonings but does not itself provide planning approvals, development conditions, levy mechanisms, or infrastructure funding arrangements. Parties seeking to rely on the rezoning to implement projects must proceed through the applicable Planning Act and local scheme approval pathways; this Act creates the statutory zoning framework but not the downstream approvals in itself.

Potential mismatch between MRS and local scheme zonings. The Act amends both the Metropolitan Region Scheme and the Rockingham local planning scheme for Area B (s 4(2), s 5(1)). Where the MRS and local scheme maps need to be read together, practitioners must ensure consistency between the Commission-certified MRS depiction and the Rockingham development zone plan. The statutory definition of Area B requires it to be shown on both certified plans (s 3(1)(b)), but any discrepancy in practice would need to be resolved by reference to the Commission‑certified documents and, if necessary, legal argument.

Reliance on procedural silence. Because the Act does not set out consultation, notification or appeal mechanisms within its own text, parties might assume the usual Planning Act processes remain in force. That is generally correct (s 6(3)), but the disapplication in s 6(2) creates an exception for the s 4(2) amendment; do not assume universal operation of Planning Act processes without checking the Planning Act provisions in question.

Timing and commencement. The Act’s two-stage commencement (s 2) means that anyone relying on the statutory rezoning must confirm the operative commencement date for the provisions that change zoning and reservation. The compilation table records commencement of the rest of the Act by proclamation on 27 February 2018. Misreading commencement dates can lead to incorrect assumptions about the legal status of planning changes at a given time.

Clerical amendment to another statute. Section 8(2) deletes a cross-reference in the Aquatic Resources Management Act 2016. If other statutes or administrative instruments still reference the repealed 1992 Act, administrative housekeeping will be required; do not assume those references have been comprehensively cleaned up by this Act.

Practical checklist for advisers and practitioners acting for owners, developers, local government, or interested parties:

1. Obtain the Commission‑certified plans. The operative legal descriptions for Area A and Area B are the Port Kennedy Revised Development Plan and the Rockingham development zone plan “held at the office of the Commission and certified by the Commission” (s 3(1)). Do not rely on the schedule images in the Act; they are indicative only (s 3(2), s 3(3)). Secure certified copies from the Commission file.

2. Verify whether specific parcels fall within Area A or Area B. Use the Commission-certified plans to determine whether a parcel is within Area A (to be reserved Parks and Recreation) or Area B (to be zoned Urban and to be in the Development Zone under the local scheme where not already so) (s 4(1)-(2), s 5(1)). The statutory rezoning/reservation applies by reference to those plans.

3. Check the Planning Act and the Rockingham local planning scheme for applicable approval processes and conditions. Section 6(1) gives the Part 2 amendments the effect of Planning Act amendments and s 6(3) preserves the operation of the Planning Act in relation to the amendments. Identify the development approval pathways, application requirements, and timing under the Planning Act and the local scheme for land now classified as Urban or in the Development Zone.

4. Identify the impact of the s 6(2) carve‑out. Specifically inspect Planning Act s 126(3)-(6) to determine what processes or protections are disapplied for the s 4(2) MRS amendment. Advice or action that depends on those sub‑provisions should be adjusted accordingly (s 6(2)).

5. Use the evidentiary rule in proceedings. Where litigation or tribunal proceedings are contemplated concerning boundaries, tender a plan purporting to be a copy of the Commission-certified plan as evidence of boundaries (s 4(3), s 5(2)). However, prepare for potential challenges as to authenticity or accuracy given the “purporting to be a copy” phrasing.

6. Review any instruments or rights under the repealed 1992 Act. Because the Port Kennedy Development Agreement Act 1992 is repealed by s 7 and the Act contains no express savings, identify any approvals, easements, agreements, licences or other instruments that might have derived from the 1992 Act. For each such instrument, determine whether it survives repeal by operation of other statutory provisions, contract law, or requires administrative confirmation.

7. Check for cross‑references in other legislation or instruments. The Act deletes the 1992 Act entry from the s 377 table in the Aquatic Resources Management Act 2016 (s 8(2)). Search for and catalogue other legislative or administrative cross‑references to the 1992 Act that may need updating or administrative action.

8. Confirm commencement dates. Do not assume immediate effect from Royal Assent for the rezoning and repeal provisions. Section 2 provides that only Part 1 commences at Royal Assent; the rest is by proclamation. The compilation table indicates the remainder commenced by proclamation on 27 February 2018. Confirm the operative commencement dates relevant to your matter (s 2; compilation table).

9. Advise clients about planning outcomes rather than statutory guarantees. The Act changes statutory land-use classifications, which enables development under the Planning Act and local scheme regimes; it does not itself grant development approvals, funding, or infrastructure commitments. Any project-specific approvals will need separate applications in accordance with the Planning Act and the local scheme, subject to any applicable exemptions or procedures.

10. Record and tender proper evidence in applications. When lodging planning applications or objecting to proposals, ensure the correct, certified plan is lodged or relied on, and keep documentary proof of communications with the Commission and local government concerning the certified plan boundaries.

11. Document chain of title and any earlier instruments. Where prior instruments or contractual arrangements referenced the 1992 Act or pre-existing scheme classifications, document the chain of title and any conditions precedent or ongoing obligations that may be affected by repeal. Consider stabilising arrangements (e.g. deed-based agreements, consents) where continuity is commercially important.

12. Monitor administrative follow-up. Expect administrative housekeeping: map layer updates by the Commission and the City of Rockingham, updates to planning portals, and possible clarifying instruments or policies. Keep records of when the Commission’s certified plans were made available, any accompanying administrative notes, and communications with planning authorities.

Each of the above steps follows directly from the statutory text: reliance on Commission-certified plans (s 3(1), s 4(3), s 5(2)); zoning and reservation changes (s 4(1)-(2), s 5(1)); the Planning Act treatment and carve-out (s 6(1)-(3)); the repeal of the 1992 Act and consequential deletion from the Aquatic Resources Management Act 2016 (s 7, s 8(2)); and the commencement mechanics (s 2; compilation table).
