Pollution of Waters by Oil and Noxious Substances Regulations 1993

The Regulations operate mostly by reference. Three core concepts structure the instrument.

• Incorporation by reference to Marine Orders and the Commonwealth Act. Regulation 3 defines “Commonwealth Act” (the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Cwlth)) and “Marine Orders” (orders made under s 34 of that Commonwealth Act). Multiple provisions then make compliance with the Marine Orders the de facto standard for State obligations: prescribed offices are those in Marine Orders (reg 4), forms and record books are those prescribed by Marine Orders (regs 7-11), and the prescribed manner of notification follows Marine Orders (reg 5). The Regulations therefore rely on an external, changing body of Commonwealth subordinate instruments to supply operational detail.

• Prescribed State offices and local port officials. The Regulations map certain State departmental positions, specifically the Chief Executive Officer and the General Manager Marine Safety in the Department,to the Act’s references to prescribed offices for several sections (reg 4(1)-(3), (5)). For incidents and discharges occurring within port boundaries where a harbour master is appointed, the harbour master is explicitly prescribed for particular functions (reg 4(2)(c), (3)(b)). The practical effect is a two-tiered prescription: Commonwealth-prescribed offices remain relevant by virtue of cross-reference, but specified State departmental offices and harbour masters are added as State-prescribed contacts.

• Recordkeeping and reporting architecture. The Regulations set minimum procedural requirements relevant to incident reporting and shipboard logs. They prescribe the accepted manner for notifying incidents to meet the Act’s requirements (in line with Marine Orders and via the Department or port signal station as alternatives) (reg 5), fix a 24-hour deadline for responding to requests for reports under particular Act sections (reg 6), and specify the form of reports and record books by reference to Marine Orders with explicit additional fields where discharges from land are involved (reg 7). They also make specific Marine Orders-prescribed operations and occurrences into State “prescribed operations or occurrences” for both oil and cargo record books (regs 9 and 11).

These concepts produce a regulatory architecture in which compliance detail is largely outsourced to Commonwealth instruments (Marine Orders), while State regulation overlays specific State officials and procedural routes (Department, harbour master, port signal station) and prescribes particular additions for land discharges (reg 7(2)). The Regulations also adopt international Convention content (Annex II, reg 8 of the Convention) to the extent and manner the Marine Orders prescribe (reg 12), making international technical requirements part of the State compliance baseline via the Commonwealth subordinate instrument.

The Regulations affect three broad groups of actors: ship operators and masters, port and State maritime officials, and occupiers of land from which discharges occur.

• Ship operators and masters. The Regulations require ships to carry oil record books and cargo record books as prescribed by the Marine Orders for the corresponding Commonwealth Act provisions (regs 8 and 10). They also treat the specific operations and occurrences prescribed by those Marine Orders as the “prescribed operations or occurrences” for the State Act’s recordkeeping obligations (regs 9 and 11). Practically every commercial vessel subject to the State Act’s recordkeeping obligations will be affected because the Regulations make Marine Orders’ detailed obligations binding in Western Australia.

• Port authorities, harbour masters and the Department. Regulation 4 prescribes who the Act’s “prescribed offices” are for particular sections: the offices prescribed by Marine Orders and, in addition, specified State departmental positions, the Chief Executive Officer and the General Manager Marine Safety, are prescribed for various sections (reg 4(1)-(5)). For prescribed incidents occurring within the boundaries of a port where a harbour master is appointed, the harbour master is also prescribed for the relevant sections (reg 4(2)(c), (3)(b)). Regulation 5 allows notification to be conveyed through the Department or a port signal station (reg 5(1)(b)), which puts port administrative and communication infrastructure in the notification chain. This affects how duty-holders must select recipients and routes for notifications and who may be expected to respond.

• Occupiers of land where a discharge occurs. For discharges from a place on land, the Regulations prescribe that notification must be in the same manner as for ship incidents (reg 5(2)). The report form used for land-based discharges must include the name, address, email, facsimile and telephone numbers of the occupier of the place on land, and the geographical location of the discharge (reg 7(2)(a)-(b)). This places a data-collection obligation on occupiers or those reporting for them and creates an information-based compliance burden for land occupiers subject to the Act.

• Entities relying on exemptions. Regulation 13 expressly makes ships exempted by Marine Orders from the Commonwealth Act and Commonwealth regulations likewise exempt from the State Act and these State Regulations (reg 13). Those operating vessels that fall within Marine Orders’ exemption classes will therefore be affected by cross-jurisdictional exemption status determined under Commonwealth instruments.

• Legal and compliance advisors. The Regulations’ heavy cross-referencing to Marine Orders and the Commonwealth Act means advisers and compliance officers must track both State and Commonwealth subordinate instruments and any updates to Marine Orders that change form, recordkeeping or exemption parameters.

In short, the obligations in these Regulations sit at the intersection of ship operators, port and State maritime officials, and land occupiers implicated in discharges. The chain of notification and the recordkeeping requirements mean maritime operators, port signal stations and the Department are operationally implicated when incidents occur, and the specific information required for land discharges imposes direct reporting obligations on occupiers or their agents (regs 4-7, 8-11, 13).

The Regulations instantiate specific duties and give effect to certain statutory rights by setting forms, recipients and timeframes. The duties created by or clarified in the Regulations are primarily procedural and information-based.

Key duties

• Duty to notify incidents and discharges in the prescribed manner. The Regulations specify that, for the Act’s sections dealing with prescribed incidents and discharges, notification is made in the manner prescribed by the Marine Orders or by that manner conveyed through the Department or a port signal station (reg 5(1)(a)-(b)). For a discharge from a place on land (section 12(1) of the Act), the notification must follow the same prescribed manner (reg 5(2)).

• Duty to produce reports within 24 hours of a request. For the sections of the Act that require reports to be provided within a prescribed time, the Regulations fix that prescribed time as 24 hours immediately following receipt of the request (reg 6). This creates an operational duty to be able to collect, prepare and deliver the relevant report within that period.

• Duty to use prescribed forms. For the reporting sections referenced, the Regulations prescribe the form to be used as that provided by the Marine Orders (reg 7(1)). For land-based discharges the form adds mandatory fields specifying the occupier’s contact details and the geographical location where the discharge occurred (reg 7(2)(a)-(b)).

• Duty to carry and keep oil and cargo record books. Ships must carry an oil record book of the kind prescribed by Marine Orders (reg 8), and the cargo record book form is likewise the Marine Orders form (reg 10). The specific operations and occurrences correlated with entries are those set out in Marine Orders (regs 9 and 11).

• Duty to comply with Annex II, reg 8, as applied. Regulation 12 brings Regulation 8 of Annex II to the Convention into force for ships to the extent prescribed by Marine Orders, which creates a duty to meet any substantive technical requirements that reg 8 imposes where Marine Orders make it applicable (reg 12).

Key rights or procedural clarifications

• Right of State to accept notifications via Department or port signal station. Regulation 5(1)(b) explicitly recognises alternative transmission routes, which is a procedural right for a notifier to use those routes where they are recognised by Marine Orders or suitable in practice.

• Right to rely on Marine Orders exemptions. Regulation 13 allows ships exempted by Marine Orders from Commonwealth Act provisions and Commonwealth regulations to be exempt from the State Act and these Regulations as well (reg 13). That creates a right of exemption continuity across Commonwealth and State regimes for those vessels that fall within Marine Orders exemptions.

What the Regulations do not do

• They do not themselves set penalties or describe enforcement measures. Instead, they operate to define and prescribe procedures under particular sections of the parent Act (the Act’s enforcement and penalty provisions remain in the Act itself). The Regulations create duties of reporting, recordkeeping and notification that are to be enforced under the Act.

• They do not define substantive technical thresholds for pollution; those technical definitions and detailed operational triggers for record entries and report content are supplied by the Marine Orders and by the referenced Commonwealth Act and Convention provisions.

For a duty-holder, the practical obligations are to ensure that the vessel or land occupier has the correct record books and forms, that they can produce required reports within 24 hours, and that notifications are sent through the prescribed channels and to the prescribed offices (regs 4-8, 10-12). Compliance rights operate largely through the continuity of Commonwealth exemptions and the defined notification routes.

The Regulations themselves do not contain standalone penalty clauses or enforcement provisions. Instead, they operate to specify prescribed procedures, offices and forms for duties whose breach would fall to be enforced under the Pollution of Waters by Oil and Noxious Substances Act 1987. This follows from the Regulations’ phrasing “For the purposes of” when referring to specific sections of the Act (for example, regs 4-11 repeatedly state obligations are prescribed “for the purposes of” particular Act sections).

Consequently:

• Enforcement, sanctions, and the processes for notices, investigations, and penalties are matters to be found in the substantive provisions of the Act that the Regulations serve. The Regulations reference multiple Act sections (for example, regs 4(1) refers to sections 8 and 20 of the Act; reg 4(2) refers to sections 11 and 22; reg 8 references section 13(3); reg 10 references section 23(3), and so on). Any penalty for failing to comply with the procedural requirements set out here will therefore be those penalties established by the Act for contraventions of those sections.

• The Regulations do, however, shape enforcement by clarifying who may be notified and who is a prescribed office for particular functions (reg 4). By prescribing the Chief Executive Officer and the General Manager Marine Safety and, in port-boundary incidents, harbour masters for certain functions (reg 4(1)-(3)), the Regulations influence enforcement flow: notifications and reports will routinely be directed to those offices and enforcement action or operational response is coordinated through them.

• The Regulations also affect practical enforcement expectations by fixing the time within which a report must be produced in response to a request , 24 hours from receipt (reg 6). That 24-hour rule is an operational constraint enforcement bodies will rely upon when assessing compliance with report obligations.

• The Regulations’ adoption of Marine Orders’ forms and operations definitions (regs 7-11) means that compliance assessments and evidence collection in enforcement proceedings will routinely reference entries and forms required by Marine Orders. Enforcement officers will expect to see oil and cargo record books conforming to the Marine Orders formats (reg 8, reg 10) and to see the specific operations/occurrences recorded as prescribed (regs 9 and 11).

• Exemptions acknowledged in the Regulations (reg 13) limit the scope of potential enforcement by carrying forward Marine Orders exemptions into State law, so enforcement bodies must check whether a vessel is within a Marine Orders exemption class before proceeding under the State Act for an alleged contravention.

Because the Regulations do not set out fines, infringement processes or criminal sanctions themselves, one seeking the detailed enforcement regime must consult the Act provisions referenced in these Regulations. The Regulations, by fixing recipients, formats and timeframes, shape both the standards against which compliance is judged and the practical evidence that will be relevant in any enforcement action (regs 4-7, 8-11, 13).

The Regulations are explicitly designed to integrate State compliance obligations with Commonwealth legislation, subordinate Commonwealth instruments and an international Convention. The interaction is made by incorporation and cross-reference rather than by independent State technical content.

• Direct incorporation of Commonwealth Act instruments. Regulation 3 defines “Commonwealth Act” as the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Cwlth) “as in force at the commencement of these regulations” and “Marine Orders” as orders made under s 34 of that Commonwealth Act. Multiple substantive regulations then adopt those Marine Orders and Commonwealth-prescribed offices for corresponding State Act purposes (reg 4, reg 5, regs 7-11). This makes the Marine Orders and the Commonwealth Act a primary source of operative detail for State obligations, so changes to Marine Orders at the Commonwealth level will feed into the State compliance baseline where the Regulations reference them.

• Application of international Convention content via Marine Orders. Regulation 12 brings Regulation 8 of Annex II of “the Convention” into force to the extent and in the manner prescribed by Marine Orders (reg 12). Though the Regulations do not state the Convention by name here, the reference to Annex II and its regulation 8 aligns the State regime to international technical obligations through the Commonwealth subordinate instrument pathway. The effect is that certain Convention technical rules apply in State law but only insofar as the Commonwealth’s Marine Orders make them applicable.

• Cross-exemption continuity with Commonwealth regulations. Regulation 13 states that ships exempted by the Marine Orders from the provisions of the Commonwealth Act and the Commonwealth regulations are also exempted from the State Act and these Regulations (reg 13). This makes State exemption status dependent on Commonwealth subordinate instrument determinations, harmonising the exemption field across jurisdictions.

• State departmental and local port roles layered over Commonwealth prescription. Regulation 4 prescribes each of the offices prescribed by the Marine Orders for corresponding Commonwealth Act sections, but also prescribes the State Department’s Chief Executive Officer and General Manager Marine Safety and, for port-boundary incidents where a harbour master is appointed, the harbour master (reg 4). This is a layering effect: the Marine Orders provide a baseline set of prescribed offices, while the Regulations add State officials and local port officials to the roster of persons/offices for notice and action under the Act.

• Interaction with Act-based enforcement. As set out above, the Regulations do not prescribe penalties but create procedural duties that the Act enforces. Thus the Regulations operate as subsidiary instruments that populate the Act’s procedural environment; enforcement mechanisms, liability definitions and sanctioning remain within the Act’s text.

The practical consequence is that compliance in Western Australia under these Regulations requires tracking instruments at three levels: State Act provisions, Commonwealth Marine Orders (and the Commonwealth Act for definitions and authority), and the international Convention provisions as applied through Marine Orders. Entities affected must therefore monitor Commonwealth subordinate instruments as a material and shifting source of State obligations (regs 3-5, 7-12).

The compilation table and embedded amendment footnotes record how these Regulations have been updated since their initial gazettal.

• Original enactment and commencement. The Pollution of Waters by Oil and Noxious Substances Regulations 1993 were gazetted 29 June 1993 and commenced 1 July 1993 (see Compilation table).

• Reprint. There is a recorded Reprint 1 of the Regulations as at 7 May 2004 (Compilation table), indicating the instrument has been reprinted at least once to consolidate amendments up to that date.

• 2006 amendments. The Regulations were amended by the Pollution of Waters by Oil and Noxious Substances Amendment Regulations 2006, gazetted 6 October 2006, which commenced on that gazettal date (Compilation table). The text evidences specific amendments with marginal notes: for example, the definition section (reg 3) and numerous later provisions carry a bracketed note “[Regulation 3 amended: Gazette 6 Oct 2006 p. 4361.]” and similar notes for regs 4, 5, 7-13 indicating amendments on 6 October 2006 (each relevant regulation carries a comparable note stating the amendment and Gazette citation). The Compilation table lists the Gazette pages (p. 4361-3) as the authoritative public record.

• Nature of amendments indicated in the text. The marginal notes specify that regulation 3 was amended and regulations 4, 5, 7-13 were amended by the 2006 instrument, but the Regulations as compiled here do not include a legislative history of the pre-amendment texts or the detailed change-trace beyond the fact of amendment and the Gazette citation. The reprint as at 7 May 2004 suggests there were prior consolidations before the 2006 amendment.

• No subsequent amendment entries in the provided compilation. The provided compilation table records the 1993 enactment, the 2004 reprint and the 2006 amendment. The Regulations’ own footnotes repeatedly cite the 2006 Gazette for amendments to numerous regulations (see regs 3, 4, 5, 7-13 notes). The compilation does not show further amendments beyond 2006 in the material supplied.

Practically, the amendment record shows that the Regulations have been materially revised at least once since inception and that the 2006 amendments updated definitions and multiple operative provisions to align the State framework with changing Commonwealth Marine Orders or administrative arrangements. Any compliance or advisory practice should check the up-to-date Consolidated Regulations and the current Marine Orders because the Regulations’ substantive obligations repeatedly import Marine Orders’ content.

The compiled Regulations text supplied does not record any litigation history. There are no case citations, references to judicial decisions, or notes of judicial interpretation included in this compilation document. The textual compilation contains only the statutory/regulatory provisions, marginal amendment notes and the compilation table listing gazettal and amendment dates.

Because the Regulations primarily incorporate and rely on Commonwealth Marine Orders and reference Act sections for enforcement, any litigation that arises in practice may reference the State Act, the Marine Orders or the Commonwealth Act and potentially engage questions of cross-jurisdictional interpretation or the validity of delegated instruments. However, the instrument itself does not list or summarise judicial consideration.

If one requires precedential or contested-law guidance on how the procedural duties in these Regulations have been interpreted or enforced, the next step, outside the text of these Regulations, would be to search reported decisions under the Pollution of Waters by Oil and Noxious Substances Act 1987, the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Cwlth) and decisions addressing Marine Orders and the Convention provisions referenced (Annex II, reg 8). None of that material is included in the Regulations compilation provided.

The Regulations are concise but create several practical pitfalls because they operate largely by reference and delegation.

• Substantive obligations are not spelled out in the State instrument. Many key compliance elements (what entries to make in oil or cargo record books, the exact content and layout of prescribed forms, who the Commonwealth-prescribed offices are in detail, specific exemption classes) are left to Marine Orders (regs 3, 8-11, 13). A common practical risk is relying on the State text alone and failing to consult the current Marine Orders. Because the Regulations repeatedly state that the Marine Orders’ forms/operations/offices are “prescribed” for State purposes (reg 4, regs 7-11), an up-to-date compliance program must incorporate the current Marine Orders.

• Dynamic external rule changes. The Regulations adopt Marine Orders “as in force from time to time” (reg 3). This means the detailed regime that operators must follow can change with revisions to Marine Orders without a further State amendment. The practical implication is a monitoring burden: operators and compliance teams must watch Commonwealth subordinate instrument updates, not only State legislative changes.

• Port-boundary harbour master prescription is conditional. The harbour master is prescribed for certain functions only if a prescribed incident or discharge occurs within the boundaries of a port for which a harbour master is appointed (reg 4(2)(c), (3)(b)). A compliance error can arise if duty-holders assume the harbour master is the default prescribed office in all circumstances; the harbour master is prescribed only in that spatially-limited circumstance.

• Notification routes offer alternatives that can create uncertainty. Regulation 5 allows notification in the Marine Orders’ manner or that manner “but conveyed through” the Department or a port signal station (reg 5(1)(a)-(b)). That creates multiple acceptable routes. However, in an incident response, variation in the route used may affect who receives the report first and which operational chain responds. Duty-holders should confirm which route is practical and which will be treated as timely by the Department and port authorities.

• Tight reporting clock. The prescribed time for producing reports in response to a request is 24 hours from receipt (reg 6). In many incident scenarios, gathering requisite information (cargo manifests, precise geographical coordinates, occupier contact details for land-based discharges) can be operationally difficult. The 24-hour rule imposes a stringent internal logistics requirement.

• Additional data required for land discharges. The State-prescribed modifications to the reporting form for land discharges require specific occupier contact details and the geographical location where the discharge occurred (reg 7(2)(a)-(b)). Where landowners or occupiers are not well identified, the obligation to provide these data can be challenging. That also raises confidentiality and access-to-site issues when the occupier is remote, not an on-site operator, or a tenant.

• Exemption dependency on Commonwealth instruments. Ships exempted under Marine Orders from Commonwealth provisions are exempt from the State Act and these Regulations (reg 13). If an operator assumes exemption but does not verify current Marine Orders, they risk non-compliance. Exemptions may be narrow and conditional.

• International Convention content is only applied via Marine Orders. Regulation 8 of Annex II to the Convention is applied only “in the manner and to the extent prescribed by the Marine Orders” (reg 12). If the Commonwealth does not implement a particular Convention paragraph in its Marine Orders, the corresponding Convention obligation may not be state-enforceable under these Regulations.

• No standalone remedies or penalties in the Regulations. Because the Regulations do not state enforcement mechanisms, party compliance obligations must be read in tandem with the Act. Practitioners unfamiliar with the Act could overlook the linkage and misunderstand the consequences of breach.

Each of these points is grounded in the text of the Regulations: the reliance on Marine Orders (reg 3), the prescription of State offices and conditional harbour master role (reg 4), the notification manner options (reg 5), the 24-hour reporting period (reg 6), the added fields for land discharge reports (reg 7(2)), the oil/cargo record book prescriptions (regs 8-11), the limited application of Annex II via Marine Orders (reg 12) and cross-jurisdictional exemptions (reg 13). Addressing these “gotchas” requires active tracking of Marine Orders, clear operational notification protocols, recordkeeping processes that satisfy Marine Orders formats, and internal procedures for rapid information collation to meet the 24-hour reporting clock.

Compliance under these Regulations requires operational steps that recognise the Regulations’ heavy incorporation of Commonwealth instruments and the State-specific additions. The following is a practical checklist derived from the Regulations’ operative provisions.

1. Identify applicable Marine Orders and the Commonwealth Act provisions. Regulation 3 defines the Commonwealth Act and Marine Orders as the sources of forms, offices and prescribed operations. Start by obtaining the current Marine Orders made under s 34 of the Commonwealth Act that correspond to the State Act sections referenced in regs 4, 7-11 and reg 12.

2. Confirm whether your vessel is subject to any Marine Orders exemption. Regulation 13 carries Commonwealth exemptions into the State regime. Before relying on an exemption, obtain the current Marine Orders text specifying exemption classes and ensure your vessel falls squarely within any claimed exemption (reg 13).

3. Ensure the correct oil and cargo record books are carried and maintained as per Marine Orders. Regulation 8 requires ships to carry an oil record book of the kind prescribed by Marine Orders; regulation 10 prescribes the cargo record book form likewise. Implement shipboard procedures to make the required entries for the “prescribed operations or occurrences” identified in the Marine Orders (regs 8-11).

4. Establish notification channels and recipients. Regulation 5 prescribes notification manners consistent with Marine Orders and allows notification to be conveyed via the Department or a port signal station (reg 5(1)(b)). Confirm the current Marine Orders’ prescribed manner, and set standard operating procedures to notify, as appropriate, the Chief Executive Officer, General Manager Marine Safety, the Commonwealth-prescribed offices, the Department, and, where applicable, the harbour master (reg 4).

5. Prepare for the 24-hour report deadline. Regulation 6 sets the prescribed time for report production at 24 hours following receipt of a request for a report. Maintain accessible records and a pre-populated incident reporting pack that contains vessel particulars, contact details, oil/cargo log extracts and any likely data required, so that a report can be prepared and dispatched within 24 hours (reg 6).

6. Use the prescribed report forms and include required land-discharge fields. Regulation 7 prescribes the Marine Orders’ forms for report sections, and for land discharges mandates inclusion of occupier contact details and the geographical location of the discharge (reg 7(1)-(2)). Keep a master copy of the Marine Orders forms and ensure shore-based personnel or the vessel master can complete the additional land-discharge fields promptly.

7. Map responsibility for notifications and records internally. Regulation 4 prescribes the Chief Executive Officer and General Manager Marine Safety in the Department for various sections and, within specified port boundaries, the harbour master (reg 4). Assign internal roles for who in your organisation is responsible for notification, who liaises with the Department or port signal station, and who manages record book maintenance.

8. Train crew and shore staff on the interplay between State and Commonwealth instruments. Because many detailed duties are found in Marine Orders, training should include how Marine Orders define “prescribed operations or occurrences” and what entries those require (regs 9 and 11). Drill incident-reporting procedures so that all involved understand the 24-hour deadline and the permitted notification routes (reg 5).

9. Maintain audit trails and evidentiary logs. Since enforcement will depend on entries in oil and cargo record books and timely notifications, preserve copies of reports, transmission receipts (emails, facsimiles, logbook copies), and any departmental acknowledgements. Keep records showing which Marine Orders version applied at the time of any incident.

10. Monitor Marine Orders and the Commonwealth Act for changes. Regulation 3’s “as in force from time to time” language makes it essential to track amendments to Marine Orders. Set up legal/regulatory alerts to capture changes to Marine Orders, the Commonwealth Act, and any alterations to the Convention implementation by the Commonwealth that affect reg 12’s application of Annex II.

11. Coordinate with port authorities where ports have appointed harbour masters. If your operations involve ports where harbour masters are appointed, confirm how notifications are received within those port boundaries and whether additional port-level procedures are required (reg 4(2)(c), (3)(b)).

12. Seek legal advice when in doubt on exemption scope or cross-jurisdictional questions. Regulation 13 makes State exemptions contingent on Commonwealth Marine Orders exemptions. Where exemption scope is ambiguous or contested, obtain a formal legal opinion referencing the current Marine Orders language.

In short, compliance consists of: (a) integrating Marine Orders-mandated recordkeeping and forms into company processes (regs 8-11); (b) implementing clear notification procedures that route through the Department or port signal station when appropriate and identify the correct prescribed office or harbour master per reg 4 and reg 5; (c) ensuring the ability to prepare a report within 24 hours (reg 6); and (d) keeping up to date with Marine Orders and the Commonwealth Act because the Regulations source much of their operative content there (reg 3).
