What it does
The Police Service Regulations 2023 prescribe the leave entitlements and associated administrative obligations for members of the Tasmanian Police Service. They operate as delegated legislation under the Police Service Act 2003. Mechanically, the regulations set two primary categories of leave: sick leave and recreation leave. Sick leave is fixed at 410.4 hours per year of service for police officers, trainees and junior constables, subject to a crucial carve-out: that entitlement does not apply to absence caused by an illness or injury contracted or sustained in the execution of duty. That carve-out effectively pushes those cases into other compensation schemes (most likely workers’ compensation legislation) rather than the sick leave bank under these regulations. For ex-service persons - defined by prior membership in an “applicable force” during an “applicable war” or “applicable warlike operation” and suffering from a qualifying sickness - the regulations create a separate, more generous sick leave regime with an initial credit of nine weeks and cumulative accrual of up to a further nine weeks. That regime is only available to officers not appointed under an “instrument of appointment” under the Act; officers appointed under such an instrument receive whatever additional sick leave that instrument specifies, creating a two-tier structure. Recreation leave is set at 228 hours per year for police officers who are entitled to a shift and penalty allowance under the Police Award and who are not appointed under an instrument of appointment; for others, the entitlement is whatever the instrument of appointment says. The Commissioner has broad discretion over the manner of applications, records and procedures for recreation leave, can direct an officer to take leave, can recall an officer from leave, and can override the standard accumulation cap of two years’ worth of leave. The regulations do not address other common leave types such as long service leave, parental leave, carer’s leave or study leave; they are a partial leave code confined to the two categories named. The regulations also do not set out any penalties for non-compliance, leaving enforcement to the underlying Act or industrial instruments. In effect, the regulations formalise a state-determined leave allocation for police officers while granting the Commissioner considerable unilateral power to adjust timing and accumulation. The net effect on the Police Service budget is a mandated minimum labour cost for leave time; for officers, the benefit is a defined entitlement but with reduced flexibility because the Commissioner can compel or interrupt leave. The regulations do not index any amounts to inflation, so the real value of the 410.4-hour and 228-hour allowances erodes over time unless the Police Award or the Act is amended separately.
