99 Accrual of annual leave generally

(1) Annual leave does not accrue to a NSW Police Force senior executive for any period of absence from duty without pay or without leave.

(2) Despite subsection (1), annual leave accrues for the following—

(a) a period of leave without pay granted on account of incapacity for which compensation has been authorised to be paid under the Workers Compensation Act 1987,

(b) a period of sick leave without pay,

(c) any other period of leave without pay, not exceeding 5 working days in a period of 12 months.

(3) If a NSW Police Force senior executive takes extended leave on half pay, only half of the period of leave must be counted in calculating the member’s accrual of annual leave.
