97 Entitlements to payment of gratuity for accrued annual leave on termination
(1) This section applies in relation to a NSW Police Force senior executive if—
(a) the senior executive retires or resigns, or
(b) the senior executive’s services are terminated, other than because of the death of the senior executive.
(2) The senior executive is entitled, immediately on the resignation, retirement or termination, to be paid the money value of annual leave accrued by the senior executive that remains untaken or unforfeited at that time as a gratuity.
(3) The senior executive may elect to take either the whole or part of the annual leave referred to in subsection (2) as annual leave on full pay instead of taking the money value of the leave as a gratuity.
(4) If payment of the money value of leave has been made under this section, no proceedings may be brought against the Commissioner or the State for payment of any amount in relation to the leave.
