86 General

(1) This part is subject to the following—

(a) an award or enterprise agreement under the Industrial Relations Act 1996,

(b) an agreement under the Act, section 87,

(c) an agreement under the Act, section 86 as in force before 1 December 2006,

(d) an applicable award, industrial agreement or determination under the Act, Schedule 4, clause 8.

(2) For the purpose of calculating the entitlement of a member of the NSW Police Force to leave under this part, any period served by the member before the commencement of this part as a member of the NSW Police Force or as a Public Service employee must be taken into account as if it were service as a member of the NSW Police Force.

Note—

Current awards such as the Crown Employees (Police Officers—2024) Award and the Crown Employees (NSW Police Force Administrative Officers and Temporary Employees) Award 2009 generally provide for leave entitlements for members of the NSW Police Force to whom this part applies.
