83 Other breaches of code of behaviour

The Commissioner may take section 80 dismissal action, or make a section 173 order or a section 181D order, in relation to a police officer if the police officer breaches the code of behaviour by—

(a) consuming alcohol while wearing a police uniform and while not rostered on duty, or

(b) consuming alcohol while on police premises and while not rostered on duty, or

(c) refusing or failing to undertake a breath test when required to do so under this part, or

(d) refusing to submit to a breath analysis or to provide a sample of urine or hair when required to do so under this part.

Note—

Sections 62 and 64 contain exemptions to compliance with the code of behaviour and to breath testing or providing samples in certain circumstances.
