60 Operation of part

Nothing in this part—

(a) affects a person’s liability for an offence relating to the consumption or supply of alcohol, or the use or supply of other drugs, arising under an Act or law, including the following—

(i) the Road Transport Act 2013,

(ii) the Drug Misuse and Trafficking Act 1985, or

(b) affects a power to conduct breath or other tests for the presence of alcohol or other drugs in a person’s body under an Act or law, including the following—

(i) the Road Transport Act 2013,

(ii) the Marine Safety Act 1998, or

(c) affects an obligation or right under an Act or law, including the following—

(i) the Anti-Discrimination Act 1977,

(ii) the Work Health and Safety Act 2011, or

(d) prevents the making of a section 173 order or a section 181D order in relation to another matter associated with the consumption of alcohol, or the use of a prohibited drug or steroid, by a police officer, or

(e) prevents disciplinary proceedings from being taken under an Act in relation to another matter associated with the consumption of alcohol, or the use of a prohibited drug or steroid, by a member of the NSW Police Force who is not a police officer.
