165 Allowance for acting in executive role
165 Allowance for acting in executive role
(1) If, under the Act, section 33(5), the Commissioner appoints a member of the NSW Police Force to act in the role of a NSW Police Force senior executive, the member is entitled to be paid an allowance for acting in the role.
(2) Subject to subsections (3) and (4), the amount of the allowance is the difference between the salary of the member’s usual role and the notional salary of the NSW Police Force senior executive role to which the member is appointed to act.
(3) The amount of the allowance to be paid must be—
(a) proportionate to the duties to be performed by the member in the NSW Police Force senior executive role, and
(b) determined by the Commissioner before the member starts acting in the role.
(4) No allowance is payable—
(a) for acting in a NSW Police Force senior executive role for a single period of less than 5 ordinary working days, unless otherwise determined by the Commissioner, or
(b) if the appointment to act is for a period of less than 3 months—for an unbroken period of leave of more than 5 ordinary working days taken by the member during the period the member is appointed to act in the NSW Police Force senior executive role.
(5) Subsection (4)(a) does not prevent an allowance being paid under this section to a person who works part-time.
(6) In this section—
notional salary, in relation to a NSW Police Force senior executive role to which a person is appointed to act, means the total amount of the remuneration package corresponding to a point, as determined by the Commissioner for the acting appointment, within the remuneration range for the role, less the superannuation guarantee amount payable for a person employed in the role at the remuneration point.
superannuation guarantee amount means the minimum amount payable to a superannuation fund or scheme sufficient to avoid an individual superannuation guarantee shortfall, within the meaning of the Superannuation Guarantee (Administration) Act 1992 of the Commonwealth, for the person.
