130 Indexation—weekly payments

(1) The amount of a weekly payment to an incapacitated police officer under section 128(1)(b)(ii) or 129(8)(b)(i) or (ii) in relation to an injury must be adjusted on each review date after the day on which the police officer became entitled to payments under section 128 or 129 by reference to the CPI for Sydney for the 12-month period immediately before the review date.

(2) The Commissioner must declare, by order published in the Gazette on or before each review date, the formula that must be used for calculating the amount of the adjustment required to be made on the review date under subsection (1).

(3) However, if the adjustment of the amount of the weekly payment in accordance with the formula declared under subsection (2) results in the amount being—

(a) increased by more than 5%—the amount must be adjusted by increasing the amount by 5%, or

(b) decreased—the amount must be adjusted by 0%.

(4) A declaration made by an order published in the Gazette after a review date for the purposes of the adjustment required for the review date has effect as if the order were published before the review date.

(5) In this section—

review date means 1 October in each year.
