Police officers and senior police officers. Front-line police officers gain a clear statutory power to require scanning in relevant places without a warrant (s 39BA(1)). Senior police officers retain and are explicitly tasked with deciding when a hand held scanner authority should be issued for other public places; the decision must be grounded in a finding that the use is likely to be effective to detect or deter weapon offences (s 39C(3)) and, where issued, the authority must include start/end times, place identification and reasons (s 39D(1)(a)-(c)). Operators and occupiers of the listed premises and businesses located there. The Bill does not impose express statutory duties on businesses to permit scanning; however, by authorising police to require persons on or in these premises to submit to scanning, businesses that operate licensed premises, retail premises, shopping centres, sporting venues, or public transport infrastructure will see police activity authorised on their premises in the ordinary course. That can have operational implications for property owners, event organisers and managers of transport infrastructure even if no new statutory duty is placed on them by this Bill.

Marine Rescue Queensland (MRQ). MRQ is statutorily declared a charitable institution for the purpose of gifts, donations, bequests or legacies made under a trust instrument or other document (new s 28A). Donors, trustees and estate planners who give to MRQ under a trust instrument or similar document are directly affected: the Bill removes statutory uncertainty by declaring MRQ’s status in that narrow context.

Former and purported members of the SES. The Bill validates certain past purported appointments and their acts under ss 58-59 of the State Emergency Service Act 2024. • Section 39H imposes safeguards on exercise of the powers. Form of authority and adequacy of reasons (s 39D(1)(a)-(c)). The authority must state start and end, the address/place description and the reasons. “Reasons” is not defined. That absence can create administrative law exposure; if a reviewing court deems the reasons inadequate, authorisations might be impugned. Agencies should adopt clear templates that capture factual bases and evidence supporting the “likely to be effective” standard in s 39C(3).

Linkage to search without warrant (ss 29, 30(1)(l), 39G, 39H). The Bill makes it explicit that scanner indications or failure to comply can engage s 30(1)(l) and thereby permit warrantless searches under s 29. Narrow charitable declaration for MRQ (s 28A). MRQ is declared a charitable institution “in relation to a gift, donation, bequest or legacy to MRQ under a trust instrument or other document” (s 28A). The statutory charitable status is limited to gifts under trust instruments or other documents; its interaction with broader charity law, tax treatment, or statutory grants is not addressed and may require clarification in practice.

Validation temporal detail (ss 58-59). Section 58(3) distinguishes between a purported appointment that had already ended before the "relevant commencement" and one that had not. For police services and senior officers

1. Ensure proclamation timing is monitored. Part 3 commences on proclamation (s 2). Operational roll-out plans for the new scanning regime should align with the proclamation date to avoid unauthorised practice prior to commencement.

2. Establish an authorisation template that meets s 39D. Any hand held scanner authority issued under s 39C must state:

   • the start and end time (s 39D(1)(a));
   • the address, place name or description of the public place (s 39D(1)(b));
   • the reasons for which the authority is issued for the public place (s 39D(1)(c)). Create a contemporaneous record capturing factual bases and evidence supporting the “likely to be effective” consideration required by s 39C(3). The authority should be stored and indexed for reporting and potential review.

3. Develop internal decision-making standards for s 39C(3). Senior officers must “consider” the use is likely to be effective to detect or deter possession or use of a knife or other weapon (s 39C(3)). Policymakers should provide guidance on evidence types that qualify (crime data, intelligence, event-specific risk assessments) to ensure consistent and reviewable decisions.

4. Train frontline officers on the scope of s 39BA and continuance under s 39BA(2). Officers must apply the place-based power only in the enumerated relevant places (s 39BA(1)), and must understand the conditions and limits of continuing the power after a person leaves the place (s 39BA(2)).

5. Ensure procedural safeguards in s 39H are followed. Officers must inform the person of the relevant matters specified in s 39H as amended, including that failing to comply is a prescribed circumstance under s 30(1)(l) (s 39H(4)(e)). Create checklists and scripts to ensure the statutory information requirement is consistently given.

6. Integrate search decision-making with existing s 29 and s 30 processes. When a scanner indicates metal or a person fails to comply, the pathway to search without warrant is governed by ss 29 and 30(1)(l) as amended (s 39G notes; s 39H(4)(e)). Ensure operational protocols specify when a search is authorised and how to document the prescribed circumstance.

2. Consider signage and public communications. Operators may choose to disclose to patrons that police may conduct scanning in the premises pursuant to law; this is an operational choice rather than a statutory requirement.

For Marine Rescue Queensland and donors

1. For gifts, bequests or legacies made under a trust instrument or other document, treat MRQ as a charitable institution in the sense declared by s 28A. Trust instruments and estate planners should record that the Bill provides statutory clarity on MRQ’s status in that narrow context.

For State Emergency Service administering agencies

1. Apply validation automatically where sections 58-59 operate. If a person was purportedly appointed under the former Fire Services Act 1990 or under section 16 by a person purporting to perform delegated functions, treat the person as validly appointed within the timeframes in s 58(3)-(4) or s 59(2)-(3). Update personnel and historical records to reflect the statutory validation.

For agencies that use the Terrorism (Preventative Detention) Act 2005

1. Note the new expiry date. The Act will expire on 16 December 2040 (s 83(1) as amended). Plan oversight, review cycles and training with that horizon in mind.
