The Act organises its intervention around a small set of recurring legal and operational concepts; understanding these is necessary to apply the scheme.

1. Prescribed person (s 3(1)). The operative beneficiary class is the person who resigns from the police, transfers without a break in service to the Association on the next working day, was a contributor to the Police Superannuation Fund immediately before transfer (s 2A), and who requested the Minister in writing that s 17(1) of the Police Regulation (Superannuation) Act 1906 not apply to them. The Act repeatedly treats these persons as though they remain, for superannuation purposes, in a special relationship to the Fund.

2. STC approval and discretion (s 3(2), s 4). STC may approve the payment of allowances or gratuities out of the Fund that would otherwise be payable under specific sections of the Police Regulation (Superannuation) Act 1906. STC may withhold payments, determine apportionments among competing spouse or de facto partner claimants, and set employer contribution liabilities on actuarial advice (s 3(2AA)-(2AB); s 4(2)-(4)). That allocates substantive administrative discretion to STC to determine both eligibility and funding requirements.

3. Employee and employer payment obligations (s 3(2AA)). Approval is conditional on the prescribed person paying sums equivalent to what would have been deducted from their salary under the Police Regulation (Superannuation) Act 1906 and on the Association paying employer contributions in amounts STC determines. Section 3(2AC) applies section 5AD of the Police Regulation (Superannuation) Act to those employee payments, meaning deductions may be treated in a familiar administratively enforceable way.

4. Salary of office for executive officers (s 2B). For executive officers of the Association a specific "salary of office" concept applies, to be nominated by the officer and notified to the Association and STC. The rules set minimums and maximums relative to remuneration and remuneration packages, contain default nomination logic if the officer fails to nominate within 28 days, and constrain increases to proportionate package increases (s 2B(1)-(8)). That operationalises how contributions and benefits are calculated for executive officers.

5. Cross-application of the Police Regulation (Superannuation) Act 1906 (s 3(7), (7A), (7B), (14)). The Act does not replicate the 1906 Act; instead it imports many of its provisions by reference and applies them with necessary modifications. For example, section 9A of the 1906 Act applies to prescribed persons, section 9B applies in defined circumstances to lump sum recipients, and Part 3B of the 1906 Act is applied for conversion elections, with specified effects (s 3(7), (7B), (14)).

6. Conversion elections and their effects (s 3(14)). If a prescribed person elects a conversion benefit under the applied Part 3B, the conversion benefit becomes the exclusive entitlement under this Act for that person and beneficiaries, with the conversion benefit paid under the applied Part. The Act also references arrangements and revocation provisions for such elections in the Schedule parts dealing with same sex partners amendments.

7. Survivor entitlements, timing and definitions (s 3(9)-(11A), Schedule Parts). The Act sets fixed survivor shares (for example, 62.5 per cent of the deceased person’s allowance to surviving spouse or de facto partner), but eligibility is tied to relationship timing: survivorship at the date the person attained age 60 or at death, with further rules introduced by later amendments concerning same sex partners and relationships registers. Schedule Parts 2-4 preserve temporal application of definitions where amendments changed the definition of spouse or de facto partner.

8. Withholding and good faith payments (s 4(4)-(6)). STC may withhold payment for 30 days after death or while resolving competing claims, and payments made in good faith to a person purporting to be a spouse are treated as payments to the actual spouse for the purposes of limiting later claims (s 4(4), (6)).

9. Savings and transitional/regulatory power (Schedule 1). Schedule 1 allows regulations and schedules to provide savings and transitional arrangements for a set of amending Acts, and permits regulations to give effect from the date of assent in certain circumstances subject to safeguards, see Schedule 1 Part 1, regs 1(1)-(3).

10. Interaction with family law (s 3A). The Act applies Part 4A of the Police Regulation (Superannuation) Act 1906 and its regulations, with needed adaptations, to prescribed persons and beneficiaries for family law superannuation splitting and related administration.

These concepts establish a framework in which eligibility depends on pre-transfer contributor status and a formal transfer without break in service; STC mediate approvals and funding requirements; payments and contributions are allocated between the individual (prescribed person) and the Association; and many of the detailed benefit rules are supplied by importing provisions of the 1906 Act.

Identify the concrete parties: who pays, who receives, who decides, who must comply.

• Prescribed persons. Primary beneficiaries are persons who resign their office as members of the NSW Police Force and transfer without break in service to employment with the Police Association, provided they were contributors to the Police Superannuation Fund immediately before transfer and have requested the Minister that s 17(1) of the Police Regulation (Superannuation) Act 1906 not apply (s 2A; s 3(1)(a)-(b)). These persons are subject to contribution obligations, eligibility conditions, and benefit rules in this Act.

• Executive officers of the Association. A subset of Association employees designated as executive officers are subject to the "salary of office" nomination rules in s 2B. Those rules determine the base for any deductions, and set constraints on how salary is nominated or changed.

• The Police Association of New South Wales. The Association must receive salary nominations from executive officers and must notify the STC of those nominations, per s 2B(7). Where STC approves benefits under s 3(2), the Association must, in the manner STC directs, pay employer contributions in respect of a prescribed person (s 3(2AA)(b)).

• SAS Trustee Corporation (STC). STC is the central decision-maker. It may approve payments from the Fund equivalent to benefits under the Police Regulation (Superannuation) Act 1906 (s 3(2)); stipulate the manner and amounts of required payments by prescribed person and Association (s 3(2AA)); determine Association employer contribution liability on actuarial advice (s 3(2AB)); apply medical certification and withhold payments; and make determinations between competing spouse or de facto partner claimants (s 3(8), s 4). STC is also empowered to determine effective dates for salary nominations (s 2B(7)) and to set interest rates for certain historical periods referenced in s 3(5).

• Spouses and de facto partners. Surviving spouses or de facto partners of prescribed persons have specific entitlements to survivor allowances or gratuities (s 3(9)-(11A), (10AA)). The Act defines eligibility around the timing of the spouse relationship and the date the prescribed person attained age 60, and the Schedule Parts set temporal application where definitions of spouse or de facto partner have changed by amendment.

• The Treasurer and administrative bodies. The Act cross‑applies sections of the Police Regulation (Superannuation) Act 1906 and provisions dealing with the Treasurer, the Fund, FTC, and STC Board through the applied Part 3B provisions; see s 3(14)(e). The Treasurer and boards will therefore be indirectly affected when conversion elections and applied Part provisions are invoked.

• Potential claimants and personal representatives. Where there is no spouse or de facto partner, STC may direct payment of amounts to personal representatives (s 3(6A); s 4(7)), so executors and estates are within the affected group.

• Family law participants. Because s 3A applies Part 4A of the Police Regulation (Superannuation) Act 1906 and its regulations, parties in family law proceedings who assert an interest in a superannuation interest arising under this Act are affected by the family law splitting, valuation and release processes contained in that Part.

Who bears costs:

• The prescribed person bears the obligation to pay sums equivalent to the employee deductions under the 1906 Act and any amounts that would have been required under section 5A of that Act, per s 3(2AA)(a). These are payable "in such manner as STC may direct", transferring collection and compliance tasks to STC/administration.

• The Association bears employer contribution costs determined by STC on actuarial advice (s 3(2AA)(b), (2AB)). The employer payment obligation is contingent on STC’s actuarial determination, which may vary with the person’s service period and benefit profile.

Who decides:

• STC has gatekeeping power over whether benefits are paid and under what conditions (s 3(2), (2AA), (2AB)). It also makes determinations in the case of competing spouse or de facto partner claims (s 4(2)-(3)), and may withhold payments pending satisfaction of entitlement questions (s 4(4)).

Who must act:

• Executive officers must nominate salary amounts within 28 days of appointment or be subject to default nomination (s 2B(2)-(4)), and must notify the Association which must notify STC (s 2B(7)).

• Prescribed persons must request the Minister as required to remove s 17(1) application and must make payments as directed by STC when seeking STC approval of benefits (s 3(1)(a), (2AA)).

• Association must pay employer contributions as directed by STC (s 3(2AA)(b)) and must not allow employees who are contributing to the Fund to receive benefits from the Association’s retirement gratuity funds (s 3(12)).

The Act therefore concentrates decision authority at STC, places financial obligations on both individual employees (prescribed persons) and their employer (the Association), and impacts estates and family law claimants through survivor and splitting provisions. Temporal distinctions created by amendments mean that the effective definitions of spouse and de facto partner, and the availability of spouse entitlements, depend on the date of death relative to amendment commencements, which affects who can claim.

This section sets out the statutory duties imposed and rights created or preserved by the Act, with direct textual grounding.

Duties and obligations

• Payment obligations on prescribed persons: Before STC will approve payment of benefits under s 3(2), the prescribed person must pay "in such manner as STC may direct" sums equivalent to the deductions that would have been made from their salary under s 5 of the Police Regulation (Superannuation) Act 1906 and the amounts that would have been required under s 5A of that Act had they not resigned from the police (s 3(2AA)(a)). Section 3(2AC) applies s 5AD of the 1906 Act, with necessary modifications, to such employee payments. This imposes an administrative duty to make periodic or lump sum payments as determined by STC.

• Employer contribution duty on Association: STC may require the Association to pay employer contributions, with the amount determined on actuarial advice as STC deems the Association’s liability for the period to which the payment relates (s 3(2AA)(b), (2AB)). That duty is conditional on STC’s approval and actuarial process.

• Executive officer nominations and notice obligations: Executive officers must nominate a salary of office when first appointed or as soon as practicable thereafter and on reappointment, per s 2B(2). The nominated amount must satisfy minimum and maximum constraints in s 2B(3). If the officer fails to nominate within 28 days (or a longer period STC may allow), a default takes effect equal to the monetary remuneration payable at the end of the applicable period (s 2B(4)). The Association must notify STC of nominations or elections (s 2B(7)). Officers may elect to increase or reduce nominated amounts within the limits and rules provided (s 2B(5)-(6)).

• Repayment obligation on re-employment: A person who received amounts under s 3(2) or s 3(5), and who is re-employed by the Association after resigning, retiring or being dismissed before age 60, cannot claim further benefits unless the previously paid amount is repaid into the Fund within six months of re-employment (s 3(6)). That creates a discrete clawback/repayment duty to regain future entitlement.

• Medical certification for early concessionary entitlement: STC may require medical certification if a prescribed person ceases employment before age 60 and seeks an annual superannuation allowance or gratuity; payments are conditional on STC certification of incapacity or unfitness, with medical advice defined and specified (s 3(8)).

Rights and entitlements

• Right to benefits equivalent to police benefits upon STC approval: STC may approve the payment from the Fund of allowances or gratuities “as would be payable” under enumerated sections of the Police Regulation (Superannuation) Act 1906 if the prescribed person had remained a member and been eligible (s 3(2)). That provides the core substantive entitlement, subject to the conditions in s 3(2AA) and STC approval.

• Service-recognition right: Both service as a police member and service with the Association are to be taken into account when calculating any annual superannuation allowance or gratuity under s 3(4). That preserves continuity of service for benefit calculation purposes.

• Conversion election right and exclusivity: A prescribed person may make a conversion election under the applied Part 3B, and if they do, they and their beneficiaries lose entitlement to other benefits under this Act after the conversion election takes effect, except for the conversion benefit (s 3(14)(a), (c), (d)). The applied Part also governs payment of the conversion benefit (s 3(14)(d)).

• Survivor rights: If a prescribed person dies after age 60 but before ceasing employment, or after employment ceases but before an annual allowance is granted, an annual superannuation allowance equal to 62.5 per cent of the allowance that would have been payable to the person is payable to the surviving spouse or de facto partner (s 3(9)). Additional rules extend and modify survivor rights where the allowance had been granted prior to death, for relationships of at least three years, and for temporal application following later amendments (s 3(10), (10AA), (10AA), (9A)). Survivorship rules include suspensions during any period the spouse is married (s 3(11)) and selection rules where multiple claims would otherwise overlap (s 3(11B)).

• Rights in family law contexts: Section 3A imports Part 4A of the 1906 Act and its regulations, with necessary modifications, to prescribed persons or other persons receiving a benefit under this Act, meaning these superannuation interests are subject to the family law splitting and release framework in that Part (s 3A(1)-(2)).

Administrative and protective mechanisms

• STC procedural rights: STC may withhold payment until 30 days after death or until it is satisfied as to entitlement if multiple claimants apply (s 4(4)). Payments made in good faith are protected from later challenge under certain circumstances (s 4(6)). These are procedural rights and protections to manage administration risk.

• Interest and retrospective treatment rules: Section 3(5) prescribes the lump sum payable where a prescribed person leaves employment before age 60 and is not entitled to an allowance; that lump sum is calculated by comparing sums deducted with sums paid into the Fund and adding interest at specified rates for historical periods and by STC-determined rates from 1 July 1990 (s 3(5)-(5A)). STC has a role in determining interest where sums were paid at different times (s 3(5A)(b)).

Absence of criminal penalties or express civil sanctions

• The Act does not provide a penalty schedule, nor does it create criminal offences or civil fines within the text supplied. Compliance and enforcement are effected by conditioning entitlement on payment of required sums, STC approvals, and the application of other statutory enforcement mechanisms by reference (for example, application of s 5AD of the 1906 Act to employee payments, s 3(2AC)). Where the Act imports provisions of the 1906 Act that include enforcement mechanisms, those may apply as adapted by the references in this Act.

In short, duties largely fall on prescribed persons to make payments equivalent to employee deductions, on the Association to meet employer contribution liabilities determined by STC, and on executive officers to perform nomination and notification duties. Rights are primarily conditional entitlement to Fund payments equivalent to specified police superannuation benefits, survivor entitlements, conversion election options, and family law recognition.

The Act contains no stand‑alone penalty provisions in the text supplied. Enforcement is administrative and qualification-driven rather than penal. The following are the operative enforcement and compliance mechanisms.

Administrative gating by STC

• STC approval as entitlement gate. Payment of benefits under s 3(2) is conditional on STC approval and on the prescribed person and Association meeting the payment requirements in s 3(2AA). This creates a functional enforcement mechanism, because failure to satisfy STC conditions results in non-payment of the sought allowance or gratuity.

• Determination and withholding powers. STC may withhold payment of any part of a superannuation allowance until 30 days after the death or until it is satisfied that only one claimant is entitled, or until it has determined apportionment among competing claimants (s 4(4)). STC may determine that allowances are not payable to certain claimants or that amounts be apportioned between multiple claimants (s 4(3)). These powers permit STC to manage competing claims and to protect the Fund against premature or mistaken disbursements.

• Interest calculation and STC rate-setting. For lump-sum payments under s 3(5) the Act prescribes specific historical interest rates for particular periods and leaves later rates to be fixed by STC under the State Authorities Superannuation Act 1987 (s 3(5)-(5A)). That gives STC some enforcement-related discretion in determining the exact quantum of payments where interest calculations are required.

Statutory cross-application of enforcement provisions

• Application of Police Regulation (Superannuation) Act enforcement. The Act applies by reference certain sections of the Police Regulation (Superannuation) Act 1906, and further applies s 5AD of that Act "with any necessary modifications" to amounts required under s 3(2AA)(a) (s 3(2AC)). Section 5AD of the 1906 Act deals with deductions and the treatment of amounts in certain contexts; its application is an enforcement mechanism because it prescribes the administrative consequence of non-payment or collection of required sums. The Act therefore leverages the 1906 Act’s existing collection and compliance architecture.

Conditionality and clawback mechanism

• Repayment condition on re-employment. A person who has received a payment under s 3(2) or s 3(5) and is re-employed by the Association before age 60 must repay the amount into the Fund within six months if they want further benefit entitlement under this Act (s 3(6)). That acts as a clawback mechanism and a practical enforcement tool: the statutory right to future benefits is contingent on repayment.

Administrative certification requirements

• Medical certification. STC requires medical certification for the grant of certain allowances or gratuities where the person ceases employment before age 60 (s 3(8)). The Act specifies the sources of medical advice (Police Medical Board members or medical practitioners nominated by STC) and conditions the grant on STC’s certification. That places procedural hurdles on claimants, with STC controlling admissible medical evidence.

Protections and good-faith payments

• Good faith payment protection. Section 4(6) provides that an amount paid in good faith by STC to a person purporting to be the spouse or de facto partner is taken to have been paid to the spouse or de facto partner. That provision reduces STC’s exposure to adverse claims when it pays in good faith, and sets an effective administrative cut-off where payments were made without malicious intent.

Absence of criminal penalties

• No criminal offences. The Act text supplied does not create criminal offences or specify fines for non-compliance. Enforcement therefore relies heavily on administrative controls, contractual and employment consequences, the operation of deductive and collection rules imported from the 1906 Act, and the Association’s own employment arrangements.

Practical enforcement implications

• Administrative burden and discretion. STC’s centralised approval and actuarial determination role concentrates enforcement and funding decisions in one body, which may increase administrative workload for STC and create centralised discretion when quantifying employer liabilities and setting conditions of payment.

• Risk allocation. The Act shifts funding and compliance risk onto the Association for employer contributions and onto the prescribed person for employee-equivalent deductions. STC’s discretion to set amounts and withhold payments allows it to manage risk to the Fund but increases uncertainty for the affected persons and the Association.

In summary, enforcement under the Act is administrative: STC holds approval, withholding and determination powers, the 1906 Act’s deduction and collection machinery is applied for employee-equivalent payments, and repayment/clawback conditions exist for post-payment re-employment. The Act does not set out specific criminal penalties or a civil penalty regime within its own text.

This Act is explicitly cross-referential. The governing architecture depends on imported provisions and on later amendment Acts. The key interactions are:

Police Regulation (Superannuation) Act 1906

• Primary operative text by reference. The Act repeatedly uses the Police Regulation (Superannuation) Act 1906 as the substantive source of rights and obligations for prescribed persons. Section 3(2) allows STC to approve payments from the Fund "as would be payable" under specified sections of the 1906 Act (sections 7, 7AA, 8A, 9B, 12F, 12G, 13 or 14) if the prescribed person had been a member of the police force and eligible. The Act also applies sections 9A, 9B, 9C, 18B and Part 3B (conversion) and Part 4A (family law) of the 1906 Act to prescribed persons, with necessary modifications (s 3(4), (7), (7A), (7B), (13), (14); s 3A).

• Collection and deduction provisions. Section 3(2AC) applies s 5AD of the 1906 Act to amounts required to be paid by prescribed persons under s 3(2AA)(a). This imports the 1906 Act’s machinery for the treatment of deductions and their recovery into the present Act.

State Authorities Superannuation Act 1987 and State Authorities Non-contributory Superannuation Act 1987

• Interest and STC powers. Section 3(5) refers to the rate fixed by STC under s 16 of the State Authorities Superannuation Act 1987 for interest calculations after 1 July 1990, and s 2B(3) references employer contributions under the State Authorities Non-contributory Superannuation Act 1987 in defining the limits of "salary of office." Those cross-references connect rates and contribution regimes administered under State Authorities legislation to the obligations under this Act.

Superannuation Administration Act 1996

• STC continuity. The Act defines STC as the SAS Trustee Corporation continued under the Superannuation Administration Act 1996 (s 2). The role, powers and administrative arrangements for STC therefore derive from that Act, which determines STC’s corporate form and governance.

Family law and Part 4A application

• Family law superannuation splitting. Section 3A expressly applies Part 4A of the Police Regulation (Superannuation) Act 1906 and regulations under that Part to prescribed persons and beneficiaries (s 3A(1)). The section then maps non‑contributor spouse, superannuation interest and administration cost references into the context of this Act (s 3A(2)). This makes superannuation interests arising under this Act subject to family law processes for valuation, splitting and release in the same way as contributor spouse interests under the 1906 Act.

Relationships Register Act 2010 and same-sex partner amendments

• Temporal application of relationship definitions. The Schedule Parts reproduce transitional rules that control how amended definitions of spouse and de facto partner apply depending on date of death relative to commencement of the amendments made by the Superannuation Legislation Amendment (Same Sex Partners) Act 2000 and the Relationships Register Act 2010 (see Schedule 1 Parts 2-4, and s 3(4)-(5) in those Parts). This creates a temporal dependency , whether a person is eligible as a spouse or de facto partner can depend on which statutory definition applied at the time of death.

Other amending Acts and regulations

• Regulations and retroactive commencement. Schedule 1 Part 1 allows regulations to contain savings or transitional provisions consequent on specified amending Acts, and to make such provisions take effect from the date of assent or later, subject to safeguards that they not operate prejudicially to private persons before Gazette publication (Schedule 1, Part 1 regs 1(1)-(3)). This gives the executive the capacity to manage the transitionary effects of superannuation law reforms across several named Acts.

Interpretation Act and definitions

• De facto partner definition. The Act relies on the Interpretation Act 1987 (s 21C) for the definition of "de facto partner" when it notes in s 3(9) the cross-reference to that Act for the term "de facto partner". This means interpretive rules from the Interpretation Act may affect the meaning and scope of spouse and de facto partner references when not otherwise amended.

Consequences of these interactions

• The Act is not self-contained. It imports detailed benefit, procedural and enforcement rules from the Police Regulation (Superannuation) Act 1906 and attaches operational and governance attributes from State Authorities and Superannuation Administration Acts. Users must consult the 1906 Act and the STC governing legislation to determine rates, detailed certification regimes, and enforcement mechanisms.

• Temporal complexity. Amendments to definitions of spouse and de facto partner and the Schedule’s transitional parts create date-dependent outcomes. For instance, the benefits available to a surviving partner can differ depending on whether the prescribed person died before or after the commencement of amendments referenced in Schedule 1 Parts 2-4.

• Centralised actuarial determinations. Employer contribution liabilities and, in some instances, interest where STC must decide, will be calculated on actuarial advice, linking entitlement quantum to actuarial process and policy set by STC under the wider superannuation governance regime.

• Family law entanglements. Because Part 4A of the 1906 Act is applied to prescribed persons, superannuation entitlements under this Act are susceptible to family law splitting orders and procedures. That requires pension administrators and legal advisers to integrate family law processes with the STC approval processes specified here.

In practice, compliance and benefit analysis under this Act requires cross-referencing at least the Police Regulation (Superannuation) Act 1906, the State Authorities Superannuation Act 1987, the Superannuation Administration Act 1996 and the relevant amendment Acts cited in Schedule 1.

The Act’s marginal notes record a long series of amendments; Schedule 1 records further amendment-derived transitional provisions. The Act as presented shows multiple insertions and substitutions which materially affect scope and operation. The text itself enumerates amendment sources against particular sections. The following is a condensed timeline and mapping of major textual changes as recorded in the Act text.

Early and mid 20th century origins

• The marginal notes indicate the Act was originally enacted in 1969, cited as the Police Association Employees (Superannuation) Act 1969 (s 1). The present text has been amended repeatedly since enactment.

Key insertions and substitutions

• Section 2: The definitions section records numerous amendments across decades, with recorded marginal entries including 1974 No 46, 1981 No 25, 1984 No 75, 1987 No 222, 1990 No 48, 1991 Nos 94-96, 1993 No 111, 1996 No 39, 2000 No 114, 2002 No 51, 2006 No 94, 2010 No 19, and 2018 No 28. Those marginal references indicate iterative changes to defined terms and the incorporation of later superannuation and relationships law developments.

• Section 2A: This provision, limiting the Act to contributors to the Police Superannuation Fund, was inserted in 1987 (Ins 1987 No 222, Sch 1 (2)). It narrows applicability and is a structural amendment.

• Section 2B: The executive officers’ salary nomination machinery was inserted in 1991 (Ins 1991 No 95, Sch 4 (2)) and subsequently substituted in 1993 (Subst 1993 No 42, Sch 2) with further amendments in 1996, 2005 and 2007 per marginal notes. These changes refined the nomination, default, and change rules for executive officers’ salary of office.

• Section 3: The main operative section dealing with employees transferring from the police has an extensive amendment history. The marginal note lists amendments across the 1970s, 1980s, 1990s and 2000s, including insertions and repeals for various subsections (e.g., repeals in 1993 and insertions in 1997). The Schedule references multiple Acts that modified s 3, including the Superannuation Legislation (Further Amendment) Act 1993, and changes related to same-sex partner recognition and other modernisation.

Schedule 1 and Parts 1-4 (Savings and transitional provisions)

• Schedule 1 was inserted in 1993 (Ins 1993 No 111, Sch 7) and has itself been amended in 1999, 2000, 2003, 2005 and 2010 per the sch note. Schedule 1 contains:

  • Part 1 Regulations: Permits regulations to contain savings/transitional provisions consequent on named amending Acts (Reg 1), listing specified Acts including the Superannuation Legislation (Further Amendment) Act 1993, Superannuation Legislation Amendment Acts 1999 and 2000, the Same Sex Partners Act 2000 (as it amended this Act), the Superannuation Legislation Amendment Act 2005 (to the extent it amends this Act) and the Relationships Register Act 2010.

  • Part 2: A specific transitional provision stating that the 1993 amendments do not entitle spouses to benefits for deaths occurring before 1 January 1994.

  • Part 3: Provisions arising from the Superannuation Legislation Amendment (Same Sex Partners) Act 2000, including definitions and the temporal application of the substituted definition of spouse (inscribed as Part 3 of Schedule 1).

  • Part 4: The Relationships Register Act 2010 related transitional rule restricting the application of the de facto partner definition to prescribed persons who die on or after the commencement of that amendment.

Other notable amendments

• Amendments in the 1990s and early 2000s dealt with same-sex partnerships and family law alignment. Part 3 of Schedule 1 reflects the 2000 Same Sex Partners Act changes, including revocation of conversion elections provisions and definitions for that amendment.

• The 2003 insertion of s 3A (Ins 2003 No 77, Sch 6) aligns this Act with family law superannuation legislation by applying Part 4A of the 1906 Act to prescribed persons.

• The Relationships Register Act 2010 amendments are reflected in Schedule 1 Part 4 and the marginal notes to s 2 and other sections, indicating temporal application of new de facto partner definitions.

Interpretation of amendment notes

• The marginal notes attached to sections track which subsections were inserted, substituted or amended by which Acts and schedules. Those notes are the authoritative pointers to legislative history for practitioners using the consolidated text. A practitioner needing to know exactly when a provision changed must consult the listed amending Acts and their commencement provisions.

Practical impact of amendment history

• Temporal rules matter. The Schedule’s transitional clauses mean entitlement outcomes and the definition of spouse or de facto partner can depend materially on the date of death or other specified dates relative to the commencement of particular amending Acts. Practitioners must check the effective dates recorded in the amending Acts and the Gazette notices to determine which definition applied to a given claim.

• Iterative refinement of executive remuneration rules. The insertion and later substitutions of s 2B reflect an evolving approach to defining salary of office for executive officers, with repeated adjustments to limit, increase and notification mechanics. This matters for contribution calculations and for litigable points where a nominated salary affects deduction bases.

• Conversion and revocation mechanics. The Superannuation Legislation (Further Amendment) Act 1993 and the 2000 same-sex partners amendments introduced or modified conversion election and revocation rules, with Schedule 1 cross-applying specific clauses of the Police Regulation (Superannuation) Act 1906 and allowing arrangements to be tailored to prescribed persons.

For precise historical detail affecting a particular claim, practitioners must consult the original amending instruments listed in the marginal notes and Schedule 1 and check the exact commencement dates for those amending provisions.

The Act text supplied does not record any judicial decisions, reported litigation or case citations arising from this statute. The document names Acts and provisions it imports and applies, but does not cite any case law or judicial interpretation. As a consequence:

• The Act contains no embedded case law or judicial gloss within the statutory text supplied. No cases are named in the provided material.

• Absent judicial authorities in the text, authoritative interpretation of ambiguous terms, contested STC exercises of discretion, or disputes over actuarial determinations will depend on subsequent case law, administrative review, and the applied provisions of the Police Regulation (Superannuation) Act 1906 and other cross-referenced statutes.

Implications for practitioners

• Reliance on primary statutes. Because the Act relies heavily on the Police Regulation (Superannuation) Act 1906 and on STC determinations, practitioners handling disputes or novel issues will need to consult case law that interprets the 1906 Act and related superannuation statutes, and review STC administrative practice.

• Areas likely to generate disputes. Based on the Act’s mechanics, disputes might arise around:

  • STC refusals to approve payments or the conditions attached to approval (s 3(2), (2AA), (2AB)).
  • Determination of amounts the Association must pay under STC actuarial advice (s 3(2AB)).
  • Interpretation of "without break in service" for transfer timing (s 3(1)(b)).
  • Applications of definition timing for spouse and de facto partner when amendments changed definitions (Schedule 1 Parts 2-4).
  • Apportionment decisions where multiple spouse or de facto partner claimants exist (s 4(2)-(3)).

• Administrative review routes. Challenges to STC determinations will likely proceed through administrative law channels and any internal review mechanisms established under STC governance or the Superannuation Administration Act 1996, with potential access to judicial review on legitimate error, procedural fairness or jurisdictional grounds. The Act’s text does not itself prescribe dispute resolution beyond STC’s determinations and protections for good faith payments (s 4(6)).

Practical research steps

• To establish litigation history or precedent a practitioner must search reported decisions concerning:
  • The Police Regulation (Superannuation) Act 1906 as applied to prescribed persons.
  • STC determinations under this Act and the Superannuation Administration Act 1996.
  • Family law decisions interpreting Part 4A applications to prescribed persons or the effect of conversion elections.
  • Any disputes involving timing rules in Schedule 1.

Because the Act as supplied contains no litigation history entries, any legal argument or advice must rely on external case law searches and administrative decision records beyond the statutory text.

This Act contains a number of technical traps and timing pitfalls that can create practical consequences for employers, claimants and advisers. These are concrete, source-grounded issues drawn from the statutory text.

1. Narrow application condition: contributor immediately before transfer (s 2A). The Act applies only to a member who was a contributor to the Fund immediately before transfer. If a transferring police member was not a contributor immediately prior to transfer, the Act does not apply. This is a binary fact that determines access to the whole regime.

2. "Transfer without break in service" defined functionally (s 3(1)(b)). The Act deems a transfer to be without break in service if the person resigns and commences employment with the Association on the Association’s next working day. Small timing errors in resignation or commencement dates can therefore disqualify a person.

3. Ministerial request requirement (s 3(1)(a)(ii)). The person must have requested the Minister in writing that s 17(1) of the 1906 Act not apply to them before they resign. Failure to make that written request prior to resignation or to retain proof could be decisive against an otherwise eligible claim.

4. Conditionality on STC approval (s 3(2), (2AA)). Even where a person meets the transfer and request conditions, STC must still approve the payment and can condition approval on payments by the prescribed person and employer. Thus, administrative compliance and STC discretion can block entitlement even where the statutory category is met.

5. Payment demands by STC can be actuarially determined and potentially large (s 3(2AB)). Employer contribution requirements are "the amounts that STC, on actuarial advice, determines to be the Association’s liability." That introduces uncertainty and potentially significant employer cost exposure. There is no fixed employer rate in the Act.

6. Executive officer nomination traps (s 2B). Executive officers must nominate salary of office within 28 days of appointment or face a default equal to monetary remuneration at the end of the period (s 2B(2)-(4)). Increases are limited to the percentage by which the remuneration package increases since last nomination (s 2B(6)), and decreases cannot be below monetary remuneration (s 2B(5)). These rules can have unintended tax and superannuation consequence if nominations are overlooked or poorly timed.

7. Conversion election excludes other benefits (s 3(14)(c)). A conversion election under the applied Part 3B gives rise to a conversion benefit and extinguishes other entitlements under this Act. Making a conversion election without full analysis can therefore eliminate potentially more valuable entitlements.

8. Survivor eligibility depends on relationship timing and definition amendments (s 3(9), (9A), Schedule Parts). Whether a surviving partner qualifies can depend on the date the prescribed person attained age 60 or the date of death and on which statutory definition of spouse or de facto partner applied at that date. The Schedule Parts make these outcomes date-sensitive, raising evidentiary pitfalls on chronological facts and the interpretation of relationship status.

9. Suspension of spouse allowance during marriage (s 3(11)). A spouse or de facto partner’s allowance is suspended during any period they are married. Practitioners must check marital status timing and interplay with remarriage or de facto relationships.

10. Good faith payment finality (s 4(6)). If STC pays out in good faith to a person purporting to be the spouse, later claimants may be excluded for that paid period. STC must therefore be cautious, but payees may rely on that protection.

11. Repayment requirement on re-employment within six months (s 3(6)). If a person receives a benefit and is later re-employed by the Association, they must repay the amount into the Fund within six months of re-employment to regain entitlement to further benefits. Missing this deadline removes entitlement.

12. Restriction on receiving Association gratuity if paying into Fund (s 3(12)). A person who has commenced paying into the Fund cannot contribute to or be entitled to receive any benefit from a retirement gratuity or provident fund established by the Association. This forbids parallel receipt of Association gratuities and Fund benefits and may surprise employees accustomed to association-specific benefits.

13. Regulations can be made to operate from date of assent with safeguards (Schedule 1 Part 1 reg 1(2)-(3)). Regulations may be backdated to assent, but only insofar as they do not prejudicially affect private persons before publication in the Gazette. Administrative practitioners should track Gazette publication dates because regulatory backdating can affect eligibility.

14. Interest calculation complexity (s 3(5)-(5A)). The lump-sum formula requires historical interest compounding at specified rates for discrete past periods and then STC-determined rates thereafter. Calculating the correct quantum requires access to historical deduction records, and STC has latitude to determine calculation methodology where sums were deducted or paid at different times.

15. Absence of statutory penalties but reliance on collection provisions (s 3(2AC)). The Act does not create penalties for non-payment; instead it relies on the deduction and collection machinery of the 1906 Act, as applied by s 3(2AC). Practitioners must therefore be familiar with enforcement mechanisms in the 1906 Act and any other applied statutes.

In practice, these "gotchas" require carefully documented transfer timing, written Ministerial requests, prompt salary nominations by executive officers, pre-approval financial modelling of employer contribution liabilities, and clear communication between prescribed persons, the Association and STC. Record-keeping on relationship status and dates is critical given temporal rules for survivor entitlements.

This section sets out practical, source-grounded steps for the key actors who must implement or comply with this Act: prescribed persons, executive officers, the Police Association, STC administrators, and advisers. The actions below are tied to specific sections.

For prospective prescribed persons (transferring police employees)

1. Confirm contributor status immediately before transfer. Verify and record that you were a contributor to the Police Superannuation Fund immediately prior to resignation, as s 2A makes this a precondition to the Act applying.

2. Make the required Ministerial request in writing. Before resigning, serve the written notice requesting the Minister that s 17(1) of the Police Regulation (Superannuation) Act 1906 not apply to you. Keep dated proof of delivery and receipt. s 3(1)(a)(ii) makes this a statutory condition.

3. Time the resignation and new employment carefully. Ensure resignation and commencement with the Association occur so as to constitute "transfer without break in service"; the Act deems this to occur where the person commences employment on the Association’s next working day after resignation (s 3(1)(b)).

4. Prepare to meet STC payment conditions. If you seek STC approval for benefits under s 3(2), be ready to pay sums equivalent to what would have been deducted under s 5 and required under s 5A of the 1906 Act, in the manner STC directs (s 3(2AA)(a)). Early engagement with STC to understand the payment profile and schedule will reduce the risk of approval delays.

5. Understand conversion election consequences. Before making a conversion election under the applied Part 3B, obtain actuarial and legal advice, because s 3(14)(c) extinguishes other entitlements under this Act once a conversion election takes effect.

For executive officers of the Association

1. Nominate salary promptly. On appointment or designation as an executive officer, nominate an amount for "salary of office" to the Association as soon as practicable and within 28 days where possible. s 2B(2) requires nomination.

2. Observe nomination limits. Ensure the nominated amount is at least the monetary remuneration payable at the date of nomination and no more than the total value of your remuneration package less the cost of employer superannuation contributions and any performance payments, expressed as an annual rate (s 2B(3)).

3. Use the Association’s notification process. The Association must notify STC of nominations or elections under s 2B(7). Confirm that the Association has made the required notification and that STC has accepted any effective date.

4. If you do not nominate, check default nomination. If you miss the 28‑day period, the default nomination equals your monetary remuneration at the end of the applicable period, potentially altering contribution bases (s 2B(4)). Corrective nominations are possible but time-limited under s 2B(9) for transitional circumstances.

For the Police Association

1. Establish internal processes for transfers. Keep records proving transfer without a break in service and written Ministerial requests. Confirm employee status as a contributor immediately prior to transfer as s 2A requires.

2. Coordinate with STC on employer contribution liability. Recognise that STC will determine employer contribution liability on actuarial advice (s 3(2AB)). Budget for potential actuarial determinations and establish procedures for paying contributions "in such manner as STC may direct" (s 3(2AA)(b)).

3. Notify STC of executive salary nominations. Where executive officers make nominations under s 2B, ensure prompt notice to STC and record the effective date determined by STC. Failure to notify may delay STC approvals tied to salary bases.

4. Control participation in Association gratuity funds. Do not allow employees who have commenced paying into the Fund under this Act to contribute to or become entitled to benefit from Association retirement gratuity or provident funds (s 3(12)). Put this rule into employment contracts and payroll systems.

For STC and administrators

1. Define approval and payment rules clearly. When approving payments under s 3(2), provide written directions to prescribed persons and the Association regarding the timing and method of required payments under s 3(2AA). Provide actuarial justification for any employer liability determinations (s 3(2AB)).

2. Use withholding power prudently. Where multiple spouse or de facto partner claims exist, consider withholding payments until 30 days after death or until entitlement is determined (s 4(4)). Document the reasons and the basis for any apportionment under s 4(3).

3. Apply medical certification consistently. Where s 3(8) applies, specify acceptable medical evidence in line with the Act’s definition of medical advice and ensure procedural fairness in certification decisions.

4. Calculate interest and lump sums per statutory rules. For s 3(5) payments, apply the prescribed historical interest methodology and STC-fixed rates for post-1990 periods, and document methodology in any written determinations. Use s 3(5A) methodology where sums were paid at different times and be transparent in valuations.

For legal and tax advisers

1. Check temporal definitions for spouse/de facto partner. Confirm which legislative definition of spouse or de facto partner applies to the date of death or other relevant date for your client, because Schedule 1 Parts 2-4 create date-dependent outcomes.

2. Evaluate conversion elections. Before advising a prescribed person on making a conversion election under applied Part 3B, obtain actuarial comparisons between conversion benefits and entitlements available under this Act, and advise on the effect that conversion has in extinguishing other entitlements (s 3(14)(c)).

3. Integrate family law processes. If family law splitting is at issue, apply Part 4A of the 1906 Act as adapted by s 3A. Coordinate superannuation splitting orders and valuations with STC procedures and ensure that administration costs and fees are addressed per s 3A(2)(d).

Operational checklist

• Documentation: retain the Ministerial request notice, resignation and commencement dates, STC communications, salary nominations and STC approvals.

• Timing: observe the 28‑day nomination window for executive officers and the six‑month repayment window on re-employment (s 2B(4); s 3(6)).

• Communication: notify STC early if a benefit is to be sought; ensure the Association and STC have clear payment instruction channels.

• Budgeting: plan for possible actuarially determined employer contributions and for the possibility that STC conditions may impose lump-sum or ongoing payment obligations.

• Records of relationship statuses: maintain evidence of the timing and nature of spouse and de facto partner relationships to support survivor claims or to defend competing claimant situations.

Complying with the Act therefore requires contemporaneous administrative practice: precise date records, prompt nominations and notices, early engagement with STC for determinations and actuarial calculations, and integration of family law processes where relevant. The statutory text assigns obligations both to individuals and to institutional actors; adherence to the Act’s procedural steps is essential to secure entitlement.
