Police Assistance Compensation Act 1968

The Act rests on several discrete legal concepts that determine eligibility, the quantum and the enforcing machinery. A clear statement of those concepts is useful for advising claimants, the Crown and third parties.

Assisting the police and reasonable inference. The core entitlement is triggered when a non-police person suffers personal injury arising out of or in the course of assisting or attempting to assist a police officer in arresting another person, preserving the peace, or otherwise acting or apparently acting in the execution of the police officer’s duty (s 2(1)). The assistance must have been requested by the police officer, or the assisting person must have reasonably inferred that they were being requested, or reasonably inferred that they would have been requested had the officer been aware and able to request assistance (s 2(1)). The statutory language therefore captures both express requests and situations where a reasonable person would regard assistance as requested. The Act does not define “reasonably inferred” further; interpretation will require reference to ordinary principles of objective reasonableness.

Personal injury and mental injury. The Act uses the term “personal injury” without defining it within the text of the Act itself. The 2021 amendments introduce explicit provisional payment entitlements for mental injury claims (s 2(1AA)) and permit provisional payments to be paid in accordance with the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as the case requires (s 2(2AC)). The Act also contains an exclusion to provisional payments where the claim was made before commencement of the provisional payments provisions or where a claim for the same mental injury has previously been determined (s 2(1AB)). The Act therefore recognises mental injury as a compensable personal injury and connects provisional payment mechanics into the parallel compensation statutes.

Importation of workers/accident law frameworks. The Act is primarily a conduit; it imports the compensation rules of other statutory schemes depending on the date of injury (s 2(2), (2A), (2AB)). For pre-appointed day injuries it applies the Workers Compensation Act 1958; for injuries on or after the appointed day but before 1 July 2014 it applies the Accident Compensation Act 1985; for injuries on or after 1 July 2014 the Workplace Injury Rehabilitation and Compensation Act 2013 governs. In each case the statutory fiction is that the injured person is a Crown-employed worker over 21 at an average weekly wage determined under s 2(2B). This importation means that the substantive entitlements, benefit rates, procedural steps, and dispute-resolution mechanisms are those of the relevant compensation statute rather than bespoke rules in this Act.

Property damage and double recovery. Section 2(3) permits the Minister to authorise compensation for damage to or destruction of property owned by the assisting person where the damage arises out of assisting the police. Section 2(4) prevents double recovery: a person cannot receive both damages and compensation in respect of the same property loss, and any compensation recovered in breach of that rule may be recovered by the Minister as a debt. These provisions create an explicit interaction between tort recovery and Crown compensation in relation to property.

Ministerial recovery and public funding. The Act requires payment out of the Consolidated Fund (s 5), and gives the Minister a statutory right to sue a third party who was liable to pay damages for the injury or loss that gave rise to compensation (s 4). The combination places the immediate financing burden on the State and gives the Crown subrogated rights to recoup payments where a third-party tortfeasor exists.

Jurisdictional and procedural importation. Section 3 grants the County Court, Magistrates’ Court and VCAT jurisdiction to hear questions under the Act (other than ss 2(3) and 2(4)) and requires that those tribunals apply the same provisions as they would when deciding matters under the Workers Compensation Act 1958, the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, with necessary modifications. This links time limits, evidence rules, forms, and appeal pathways to those larger compensation frameworks.

Definitions shaping beneficiaries. Section 1A defines “police officer” by reference to the Victoria Police Act 2013 and defines “partner”, “domestic partner”, “spouse” and “child” for the purposes of entitlement for dependants in the event of death (s 1A, s 2(1A)). The relationships definitions were updated to include registered relationships and to require consideration of the matters in s 35(2) of the Relationships Act 2008 when determining domestic partnerships (s 2(1B)). This controls which family members may claim on death.

False statements and deterrence. Section 6 criminalises wilfully false statements or wilfully misleading conduct in connection with a claim, with a specified maximum penalty. That provision creates an enforcement and deterrence mechanism around claim integrity.

Together these concepts create a targeted, Crown-funded compensation regime that operates by treating eligible civilians as if they were Crown-employed workers for the purposes of an existing workers/accident compensation framework while providing supplementary property compensation and Ministerial recovery powers.

This Act affects six principal groups of actors; the statutory text indicates who pays, who receives, and who may be pursued after payment.

1. Claimants (assisting civilians). The primary beneficiaries are persons other than police officers who suffer personal injury while assisting or attempting to assist police in arresting someone, preserving the peace, or where the police officer is acting or apparently acting in the execution of duty, provided the assistance was requested or reasonably inferred to have been requested (s 2(1)). The Act’s language expressly covers both actual and apparent police duty and both explicit requests and situations where a reasonable person would infer a request. It includes people who attempt to assist even if the attempt is unsuccessful.

2. Dependants and family members. If the assisting person dies from such injuries, the deceased person’s partner, children or other dependants may be entitled to compensation under s 2(1). The Act defines “partner”, “domestic partner”, “spouse” and “child” in s 2(1A) and links “registered relationship” and criteria for domestic partners to the Relationships Act 2008 (s 2(1B)). The statutory definitions therefore determine who may claim as a dependant.

3. Owners of property injured while assisting police. Section 2(3) permits payment to owners of property damaged or destroyed while assisting police. That covers property belonging to the assisting person or property in their possession or under their control where the damage arises out of assisting.

4. The Crown and the Minister. The State pays compensation and provisional payments out of the Consolidated Fund (s 5). The Minister administers the scheme and is empowered both to authorise payments for property loss (s 2(3)) and to institute proceedings to recover compensated amounts from third-party tortfeasors where another person is liable (s 4). The Crown therefore bears immediate financial responsibility but holds legal rights to recoup losses.

5. Third-party tortfeasors and insurers. Where injury or damage was caused by circumstances that would make a third party liable to pay damages, the Minister may sue that person to recover the compensation paid (s 4). The Act thereby affects insurers and potential tortfeasors to the extent the Minister exercises that right of recovery.

6. Courts and tribunals. The County Court, the Magistrates’ Court and the Victorian Civil and Administrative Tribunal are given jurisdiction to hear matters under the Act (s 3), and they must apply the same provisions that would apply if the matter had arisen under the Workers Compensation Act 1958, the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as applicable. Thus, these dispute-resolution bodies are affected in terms of the procedural law they must apply.

Indirectly affected parties include legal practitioners, medical and psychological service providers whose reports feed into determinations (particularly for mental injury claims), employers and insurers who may be consulted about causal facts, and police forces, because the statutory test for entitlement requires assessment of whether the assisting action was at the request of, or reasonably inferred from, a police officer’s conduct.

The Act does not create an entitlement for police officers themselves. It also does not provide for compensation where an assisting person recovers damages in tort and accepts compensation for the same property loss; the Act prohibits double recovery and authorises the Minister to recover compensation paid in breach of that rule from the recipient as a debt to the Crown (s 2(4)). For mental injury claims, provisional payments are available but subject to the exceptions in s 2(1AB) and the procedural regimes of the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, which will shape actual payment timing and amounts (ss 2(1AA), 2(2AC)).

Finally, the Act’s penalty provision (s 6) imposes criminal consequences on claimants or others who wilfully make false statements or wilfully mislead in connection with claims. That affects the conduct of claimants, representatives and witnesses in claim processes.

The Act sets out a compact list of substantive rights for claimants and corresponding rights and duties for the Minister and courts. Below are the principal rights and duties with cross-references to statutory provisions.

Rights of claimants

• Entitlement to compensation for personal injury suffered while assisting police, where the statutory factual tests are met. The entitlement is available to non-police persons and to dependants on death (s 2(1)).

• Entitlement to provisional payments in respect of mental injury claims, unless excluded by the exceptions in s 2(1AB). Subsection 2(1AA) gives the entitlement and s 2(2AC) directs that provisional payments are to be paid in accordance with and subject to the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as the case requires.

• Entitlement to compensation for damage to or destruction of property belonging to the assisting person, where that damage arises out of assisting the police, subject to Ministerial authorisation (s 2(3)).

Procedural and substantive mechanics

• The claimant’s compensation amount and the form of payments are determined by the applicable workers/accident/workplace injury Act depending on the date of injury (s 2(2), (2A), (2AB)). The Act treats the claimant, for these purposes, as a worker over 21 employed by the Crown with an average weekly wage determined under s 2(2B); that fiction fixes how benefit entitlements and ceilings are applied.

• For calculating the average weekly wage used in the fiction, s 2(2B) prescribes that the amount is the Australian Bureau of Statistics published average weekly total earnings of all employees in Victoria in original terms as at 15 June preceding the financial year concerned, for the most recent reference period in the calendar year last preceding that 15 June. The Act therefore ties levels to an external ABS statistic rather than to an individual claimant’s pre-injury wage.

Ministerial rights and duties

• The Minister may authorise payment for property damage (s 2(3)) and must cause compensation and provisional payments and administration expenses to be paid from the Consolidated Fund (s 5).

• The Minister has a right to recover compensation paid where the injury, damage or destruction was caused by circumstances creating a liability in some person other than a police officer to pay damages; the Minister may take proceedings against that person in a competent court to recover the amount paid (s 4). This creates a subrogated recovery mechanism for the Crown.

Limitations and duties on claimants

• A claimant is not entitled to both damages in tort for property loss and compensation under s 2 for the same loss; the Act prohibits double recovery, and the Minister may recover compensation paid in breach of that prohibition as a debt to the Crown (s 2(4)). The statutory duty here is effectively that claimants must elect remedies or must account to the Crown where they receive both.

• Claimants (or others in connexion with a claim) have a duty not to make wilful false statements or otherwise wilfully mislead relevant decision-makers, including the Minister, courts and tribunals. Breach of that duty is a criminal offence attracting specified penalties (s 6).

Jurisdictional duties

• Courts and tribunals hearing questions under the Act (other than property damage questions under ss 2(3) and 2(4)) must apply the same provisions as they would when deciding matters under the relevant workers/accident Acts, with necessary adaptations (s 3). That imposes a duty on judicial and administrative decision-makers to import principles, procedures and standards from the worker compensation/accident compensation framework.

Rights of third parties

• Third parties who are liable in tort may be sued by the Minister to recover compensation paid (s 4). Insurers or potential tortfeasors thus face contingent liability if the Minister chooses to exercise subrogated rights.

Penalty enforcement

• The State may prosecute a person for wilful false statements or wilful attempts to mislead in connection with a claim. The maximum penalty is set at 5 penalty units or three months imprisonment or both (s 6). The Act therefore provides a criminal enforcement tool to protect the scheme’s integrity.

Taken together, the Act confers statutory rights to compensation and provisional payments where assisting conduct meets objective criteria, sets out how compensation will be quantified by reference to other statutes and an ABS-derived wage figure, gives the Minister both powers to pay and to recover, and imposes duties on claimants to avoid false or misleading conduct.

The Act’s enforcement architecture is compact: criminal penalty for false or misleading claims, civil recovery rights for the Minister, and an administrative funding mechanism. The statutory instruments for enforcement are s 6, s 4 and s 2(4), read with s 3 on jurisdiction and s 5 on funding.

Criminal penalty for false statements

• Subsection 6 creates a criminal offence where a person, in or in connexion with any claim for compensation under the Act, wilfully makes any false statement to or otherwise wilfully misleads or attempts to mislead the Minister, the County Court, the Magistrates' Court, the Victorian Civil and Administrative Tribunal, a police officer or any other person. The maximum penalty is 5 penalty units or imprisonment for three months, or both (s 6). The statutory mens rea is explicit: wilfulness. The provision therefore is targeted to deliberate or intentional misrepresentation or deception in the claims process.

• The Act does not, in its text, set out processes for investigation or for administrative sanctions short of prosecution. The presence of a criminal sanction places an onus on claimants and their advisers to ensure accuracy in claim materials and statements to authorities.

Minister’s civil recovery rights

• Where compensation has been paid pursuant to s 2 and the personal injury, damage or destruction was caused under circumstances creating a liability in a person other than a police officer to pay damages in respect thereof, the Minister may take proceedings against that person in a court of competent jurisdiction to recover the amount of the compensation paid under the Act (s 4). This is a direct statutory right of recoupment that allows the Crown to pursue subrogated recovery against third-party tortfeasors or their insurers.

• Section 2(4) also contains a separate recovery mechanism addressing double recovery: if a person recovers both damages in tort and compensation under s 2(3) in respect of the same property damage, the amount of the compensation may be recovered from the person by the Minister by proceedings in a court of competent jurisdiction as a debt due by that person to the Crown. This provision imposes an obligation on claimants to account for compensation received where tort damages are also obtained.

Jurisdiction and procedural enforcement

• Section 3 grants jurisdiction to the County Court, Magistrates’ Court and Victorian Civil and Administrative Tribunal to hear and determine questions and matters under the Act other than matters arising under ss 2(3) and 2(4). Those tribunals must apply the same provisions as if the matter had arisen under the Workers Compensation Act 1958, the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as applicable, with necessary adaptations. Enforcement of rights and obligations therefore proceeds through the same procedural channels and standards applicable in those compensation regimes.

Funding and payment obligations

• Section 5 requires the amount of any compensation or provisional payments under s 2 and any administrative expenses to be paid out of the Consolidated Fund. This makes the State immediately responsible for meeting payments, subject to later civil recovery from third parties. The practical enforcement implication is that claimants receive Crown-funded relief but the Crown can pursue statutory causes of action against liable private parties.

Practical enforcement consequences and limits

• The Act does not contain express time limits or notice requirements for claim initiation; by importing the jurisdiction and procedures of the workers/accident Acts (s 3), the limitation and procedural regimes of those Acts will govern the practical enforceability of claims and of Ministerial recovery actions. Practitioners must therefore consult the relevant compensation statute for time bars, required forms, dispute resolution steps and appeals processes.

• Criminal enforcement requires prosecutorial exercise. The Act sets the offence and maximum penalty, but the text does not specify prosecutorial guidelines or administrative processes for referral and investigation. That may create implementation discretion in enforcement.

In short, enforcement under the Act is a mix of criminal sanction for fraudulent conduct, civil recovery powers for the Crown against third parties, and adjudication by the tribunals and courts used in the broader Victorian compensation system. Funding is immediate Crown responsibility via the Consolidated Fund, but the Crown may recoup through s 4 and s 2(4).

The Act is explicitly designed to sit with, and to import entitlements from, a suite of other Victorian statutes. The text repeatedly cross-refers to the Workers Compensation Act 1958, the Accident Compensation Act 1985, the Workplace Injury Rehabilitation and Compensation Act 2013, the Victoria Police Act 2013 and the Relationships Act 2008. These connections determine eligibility, quantification, procedural rules, definitions and jurisdiction.

Importing compensation regimes

• Temporal application: The Act delegates the calculation of compensation and procedural matters to different statutes depending on the date of injury. For injuries before the appointed day it applies the Workers Compensation Act 1958 (s 2(2)). For injuries on or after the appointed day but before 1 July 2014 it applies the Accident Compensation Act 1985 (s 2(2A)). For injuries on or after 1 July 2014 it applies the Workplace Injury Rehabilitation and Compensation Act 2013 (s 2(2AB)). The Act therefore functions as a gateway, instructing that claimants under this Act are to be treated as equivalent to Crown-employed workers for the purposes of those Acts. Practically this means that statutory benefit levels, definitions of injury, procedural mechanisms, appeals and limitation periods will be those in the relevant Act.

• Provisional payments and mental injury: The 2021 amendments link provisional payments for mental injury to the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as the case requires (s 2(2AC)). The provisional payments mechanism is therefore not native to this Act but is governed by the procedural and substantive rules of the accident/workplace injury statutes.

Definitions and other statutory cross-references

• Police officer definition: The Act defines “police officer” by reference to the Victoria Police Act 2013 (s 1A). This imports the statutory definition of “police officer” from that Act. Changes to the Victoria Police Act’s definitional scope will therefore alter the class of persons whose request for assistance can trigger entitlement under this Act.

• Relationship definitions: For dependants’ claims on death, the Act uses a combination of in-text definitions and cross-reference to the Relationships Act 2008. “Domestic partner” is defined in s 2(1A) and s 2(1B) makes “registered relationship” and the matters in s 35(2) of the Relationships Act relevant to assessing whether persons living together are domestic partners. Thus, the legal recognition of relationships under the Relationships Act directly affects who qualifies as a partner and hence who may claim as a dependant.

Jurisdictional and procedural importation

• Section 3 gives courts and VCAT the same jurisdiction they have under the Workers Compensation Act, the Accident Compensation Act or the Workplace Injury Rehabilitation and Compensation Act, and requires those tribunals to apply provisions of those Acts with necessary adaptations. That means procedural rules, evidence standards, forms, time limits and appeal routes are to be drawn from those other Acts. Practitioners must therefore consult those statutes for procedural compliance.

Interaction with tort law

• Property damage and subrogation: Section 2(3) allows Ministerial authorisation of payment for property damage. Section 2(4) prevents double recovery where a claimant has also recovered damages in tort; the Minister may recover compensation wrongly paid as a debt. Section 4 explicitly empowers the Minister to sue a third-party tortfeasor if the circumstances creating liability in that person caused the injury, damage or destruction for which compensation was paid. These provisions create a direct interaction with the law of torts and with insurers, giving the Crown subrogation-like recovery rights but leaving tort law intact as a source of primary liability.

Practical consequences of cross-references

• The Act’s reliance on external statutes means changes to those statutes may change the practical operation of this Act without amendment to its text. For example, changes to the Accident Compensation Act or the Workplace Injury Rehabilitation and Compensation Act in relation to mental injury tests, thresholds, or provisional payment rules will change how claimants under this Act fare. Likewise, changes to the definition of “police officer” in the Victoria Police Act or to relationship recognition in the Relationships Act will affect eligibility.

• The Act does not replicate or restate the procedural detail, limitation periods, appeal rights or benefit rates. Practitioners and administrators therefore must handle claims with reference to both this Act and the relevant compensation statute that applies to the injury date.

In summary, the Act is deliberately interstitial: it defines the Crown’s responsibility for injuries sustained assisting police, but it depends on the broader Victorian compensation and relationship statutes to define eligible persons, measure entitlements and determine procedural pathways.

The Act’s endnotes and table of amendments record a series of amendments stretching from 1983 to 2021. The table of amendments in the source provides statutory references, assent dates and commencement dates for each amending Act that affected provisions in the Police Assistance Compensation Act 1968. Below is a timeline and an explanation, based on the Act’s own endnotes, of the main amendments and what the text shows they changed.

Key amendments and dates

• 1983 Statute Law Revision Act (No. 9902/1983), assent 15 June 1983. This Act appears in the table as having made stylistic or other revisions; the entry in the Act’s table records commencement dates related to s 2(2) and other provisions.

• 1985 Accident Compensation Act (No. 10191/1985), assent 30 July 1985, s 276 commenced on 31 August 1985. This amending Act inserted s 2(2A) and later related provisions that connected the Police Assistance Compensation Act to the Accident Compensation Act 1985 for injuries on or after the appointed day. The endnotes mark that this information relates only to provisions amending the Police Assistance Compensation Act.

• 1987 Equal Opportunity (Amendment) Act (No. 46/1987), assent 25 August 1987, commencement 1 December 1987. Listed in the table of amendments as making changes now reflected in the consolidated text.

• 1994 Accident Compensation (Amendment) Act (No. 50/1994), assent 15 June 1994, s 128 commenced 24 June 1994. Noted in the table as having amended this Act.

• 2000 Statute Law Revision Act (No. 74/2000), assent 21 November 2000, with certain items commencing on 22 November 2000.

• 2001 Statute Law Amendment (Relationships) Act (No. 27/2001), assent 12 June 2001, s 4 commenced 23 August 2001. This Act amended definitions relating to partners and relationships; s 2(1A) in the current text distinguishes partners depending on whether the death occurred before or on/after the commencement of the Relationships Act amendment. The table shows the relationships amendments in 2001.

• 2004 Monetary Units Act (No. 10/2004), assent 11 May 2004, commenced 1 July 2004 for certain provisions. This is recorded in the table and likely relates to penalty unit or monetary references.

• 2006 Statute Law (Further Revision) Act (No. 29/2006), assent 6 June 2006, with certain commencement dates.

• 2008 Relationships Act (No. 12/2008), assent 15 April 2008, s 73(1) commenced 1 December 2008. This further clarified registered relationships and the matters to consider when assessing domestic partners; s 2(1B) in the current text references s 35(2) of the Relationships Act 2008.

• 2013 Workplace Injury Rehabilitation and Compensation Act (No. 67/2013), assent 12 November 2013, with s 649 commencing on 1 July 2014. This Act is recorded in the table as introducing s 2(2AB) into the Police Assistance Compensation Act, thereby setting the post-1 July 2014 compensation regime as the Workplace Injury Rehabilitation and Compensation Act 2013.

• 2014 Victoria Police Amendment (Consequential and Other Matters) Act (No. 37/2014), assent 3 June 2014, with commencement 1 July 2014 for specified items. The consolidated text shows several amendments attributed to this Act, including changes to s 2(1) and related definitions.

• 2014 Treasury Legislation and Other Acts Amendment Act (No. 44/2014), assent 27 June 2014, commencement 30 June 2014 for specified items. Section 2(2B) as to average weekly wage was substituted by an item from this amending Act.

• 2021 Workplace Injury Rehabilitation and Compensation Amendment (Provisional Payments) Act (No. 5/2021), assent 23 February 2021, with ss 51-53 commencing 1 July 2021. This is the most recent listed amendment in the table; the consolidated text shows that ss 51-53 of that Act inserted the definition of “police officer” into s 1A and added the concept of “provisional payments” as well as ss 2(1AA), 2(1AB) and s 2(2AC) to provide provisional payment treatment for mental injury claims and to set exceptions.

Textual effects recorded in the Act

• Relationship and partner definitions: The consolidated text shows the Act was amended to expand partner definitions to include domestic partners and registered relationships, and to use the Relationships Act 2008 criteria for assessing domestic partner status (s 2(1A), s 2(1B)). These changes reflect the 2001 and 2008 relationships legislation entries in the table.

• Temporal scaffolding for compensation regimes: The Act’s current s 2 contains successive subsections (2, 2A, 2AB) that map the operative compensation regime across time. The 1985 Accident Compensation Act inserted a link for the post-appointed day regime; the 2013 Workplace Injury Rehabilitation and Compensation Act inserted the post-1 July 2014 regime. The table documents these intervention points.

• Provisional payments for mental injury: The 2021 amendment introduced explicit provisional payment entitlements for mental injury claims and provided that provisional payments are to be paid in accordance with the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as appropriate (s 2(1AA), s 2(2AC)). The table of amendments identifies the 2021 Act as the source.

• Average weekly wage calculation: Section 2(2B) was substituted by the 2014 Treasury Legislation and Other Acts Amendment Act and ties the average weekly wage to the ABS published figure as at 15 June. That substitution is recorded in the table.

What the table does not record

• The table is confined to the amending Acts and their assent and commencement information. It does not provide the legislative debates, policy rationales or select committee material that accompanied those changes. The Explanatory details section of the endnotes is empty in the version supplied.

For practitioners, the critical practical effect of the amendment history is that the Act’s operation is time-contingent and sensitive to changes in the external statutes it references. The 2021 provisional payments amendment, the 2014 rework to align with the Victoria Police Act and the 2013 insertion of the Workplace Injury Rehabilitation and Compensation Act link are examples where the Act’s operation was materially changed by external legislative reform.

The Act as provided contains no reported cases or judicial decisions in its text or endnotes. The source includes only the statutory text, explanatory endnotes and a table of amendments; it does not list litigation history or reported judicial interpretation. Consequently this section sets out likely categories of dispute that the text itself will generate if litigated and the specific points that tribunals and courts will need to resolve when applying the Act. All issues flagged below flow from the Act’s language and the interaction with the compensation statutes the Act imports.

1. Factual test: “requested” and “reasonably inferred” (s 2(1)). A common cause of litigation will be the factual determination whether the assisting person was actually requested to assist, or whether the person reasonably inferred that they had been requested. The Act explicitly allows both actual requests and reasonable inferences. Courts will need to resolve whether the proper test is objective reasonableness of the person’s inference or some hybrid. Adjudicators will also need to assess the relevance of the police officer’s conduct, words, surrounding circumstances and the assisting person’s perception.

2. “Otherwise acting or apparently acting in the execution of duty” (s 2(1)). The Act covers assistance to officers “otherwise acting or apparently acting in the execution of that police officer’s duty.” Disputes are likely over when an officer’s conduct is sufficiently “apparently acting in the execution of duty” to attract compensation for an assister. The scope of “apparently acting” overlaps with the police statute’s definition of police powers and the public’s perception of police authority.

3. Causation and “arising out of or in the course of assisting” (s 2(1)). Adjudicators will be required to apply causation principles to ask whether the injury arose out of and in the course of the assisting conduct. The imported compensation regimes contain causation jurisprudence that will be applied via s 3. Litigants may contest whether antecedent conditions or unrelated events broke the causal chain.

4. Mental injury and provisional payments (ss 2(1AA), 2(1AB), 2(2AC)). Litigation may focus on whether a claimant’s injury qualifies as a “mental injury” under the relevant compensation Act, whether provisional payments are available (particularly where a claim was made before commencement of the provisional payments amendment and thus excluded by s 2(1AB)(a)), and what procedural preconditions must be met to secure provisional payments. Determinations under the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013 will be decisive.

5. Dependants’ entitlement and relationship status (s 2(1A), s 2(1B)). Cases may arise regarding whether an alleged partner qualifies under the Act’s definitions, particularly where the relationship status is contested or falls into the “living as a couple on a genuine domestic basis” category. Section 2(1B) requires consideration of the matters in s 35(2) of the Relationships Act 2008; litigation may therefore involve factual findings about cohabitation, financial interdependence and other relationship indicators.

6. Property damage, double recovery and recovery as debt (ss 2(3), 2(4)). Disputes may arise about whether particular property damage “arose out of” assisting, whether its owner is entitled to compensation, and whether a claimant obtained damages in tort and compensation for the same property, triggering the Crown’s recovery rights. The legal characterisation of the Minister’s recovery as a debt and the applicable limitation period will be matters for resolution.

7. Ministerial recovery against third parties (s 4). Litigation under s 4 will mirror ordinary subrogated claims in tort, but the Minister’s statutory right to sue may produce disputes over priority, timeliness and whether the Minister’s payment discharged or implicated other third-party obligations. The imported compensation regimes’ overlap with tort remedies may be litigated.

8. Jurisdictional and procedure issues (s 3). As the Act requires courts and VCAT to apply the relevant workers/accident Acts “with the necessary adaptations and modifications” disputes may arise about what adaptations are necessary, which procedural provisions apply, and whether particular matters are excluded from s 3 (specifically ss 2(3) and 2(4) are carved out).

9. Penalty cases (s 6). Prosecutions for wilful false statements or wilful attempts to mislead will require courts to adjudicate on the existence of wilfulness and the sufficiency of evidence. These criminal prosecutions will be shaped by normal criminal procedure and proof standards.

Because the Act imports complex compensation statutes, much litigation will be hybrid in nature: statutory interpretation of the Police Assistance Compensation Act’s eligibility tests combined with the substantive law under the relevant compensation Act governing causation, injury types, medical evidence and quantification. Practitioners should be prepared to cross-reference those Acts’ jurisprudence and procedural rules when litigating under this Act.

Note: The source text supplies no case law, reported decisions, or litigation summaries. The issues listed are logical extrapolations from the Act’s language and the statutory points that adjudicators will be asked to resolve.

The Act is compact but contains several practical traps and implementation risks that advisers and administrators should note. Each “gotcha” below is tied to the Act’s text and the way it imports external statutes.

1. Eligibility hinges on factual inferences and ambiguous phrases (s 2(1)). The statutory test allows compensation where the assisting person either was requested to assist or reasonably inferred a request. That opens the door to a range of factual disputes about the reasonableness of the inference. Advisers should be careful to gather contemporaneous evidence of the police officer’s words, gestures, presence, radio communications and any witnesses. Failure to document the circumstances will make it harder to prove entitlement.

2. Temporal complexity: which compensation Act applies depends on the injury date (s 2(2), (2A), (2AB)). Advisers must determine which compensation statute governs the claim. The Act does not itself set out the benefits or time limits; those are in the relevant Act. Misidentifying the governing regime can result in missed procedural steps or application of incorrect benefit rules.

3. Provisional payment exceptions (ss 2(1AA), 2(1AB), 2(2AC)). While provisional payments for mental injury are now available, s 2(1AB) excludes claims where the claim was made before the provisional payments amendment commenced or where a claim for the same mental injury has been previously determined. Practitioners need to check whether a claim was lodged prior to 1 July 2021 or whether there has been a prior determination, as that will bar provisional payments. The Act does not fully explain how prior determinations are to be identified; accurate record searches are therefore essential.

4. Average weekly wage is not the claimant’s wage (s 2(2B)). The Act fixes the claimant’s average weekly wage for compensation purposes to the ABS average weekly total earnings figure, not to the claimant’s actual pre-injury earnings. This can limit compensation compared to a claimant’s actual wage, particularly for higher-earning claimants. Advisers should not assume that entitlements will match an individual’s prior income.

5. Double recovery traps (s 2(4)). The Act explicitly forbids recovering both damages in tort and compensation for the same property loss. Where claimants pursue tort claims and also apply for compensation for property damage under s 2(3), they risk repayment obligations. Practitioners must advise clients about the election consequences and ensure careful accounting for any recoveries.

6. Ministerial recovery against tortfeasors (s 4). The Crown may pursue third parties for amounts paid. This can result in cross-claims between claimants, third parties and the Minister. Insurers and parties defending tort claims should be aware that Crown payments do not extinguish civil liability absent settlement.

7. The Act is silent on claim formality and time limits; those appear in the imported Acts (s 3). Users of the Act might assume the Act itself sets procedures or time bars. It does not; one must consult the relevant compensation statute. Missing limitation periods or procedural steps in those Acts can lead to claims being rejected.

8. Definition drift: changes to external Acts affect operation. The Act defines “police officer” by reference to the Victoria Police Act 2013 (s 1A) and relies on the Relationships Act 2008 for relationship matters (s 2(1B)). Amendments to those Acts will change scope and eligibility without amendment to the Police Assistance Compensation Act itself. Practitioners should monitor amendments to those external statutes.

9. Criminal exposure for misleading conduct (s 6). The offence requires wilfulness. However, the existence of a criminal sanction increases the stakes for claimants. Advisers must be cautious when coaching clients on statements, and maintain careful client files and evidentiary records.

10. Property compensation is discretionary for the Minister (s 2(3)). Section 2(3) authorises the Minister to pay compensation for property damage “as the Minister thinks reasonable”. That discretion means property owners may receive different outcomes depending on ministerial assessment unless there is an established practice or delegated policy. Reasons for refusal should be documented, and policy advice or administrative review avenues may be relevant.

11. The Act does not specify who receives provisional payments where a claimant is a minor, or the mechanics for dependants’ claims beyond the definitions provided (s 2(1A)). For children or dependant claims, the relevant compensation statute governs benefit payments; practitioners must check how those Acts handle minors and dependants.

12. VCAT, Magistrates’ Court and County Court jurisdictional carve-outs. Section 3 excludes property damage matters under ss 2(3) and 2(4) from the specified tribunal jurisdictional regime; the Act does not state which courts will decide property matters or the precise procedures. Practitioners should verify the correct forum and procedural steps for property compensation disputes.

In practice these “gotchas” mean careful fact-gathering, immediate identification of the governing compensation statute, precise record-keeping, prompt lodging of claims in the correct forum, attention to relationship evidence for dependants’ claims, and counsel on risks of double recovery and potential Ministerial recoupment.

Compliance under this Act involves both running a claimant’s file in a way that aligns with the Act’s eligibility tests and following the procedural rules of the compensation statute that applies to the date of injury. Below are practical, source-grounded steps for claimants, their advisers and administrators.

For claimants and their advisers

1. Establish the factual predicate under s 2(1). Collect contemporaneous evidence that the claimant assisted or attempted to assist a police officer. Verify whether the police officer requested assistance, or, if there was no explicit request, document evidence supporting a reasonable inference of a request. Useful materials include witness statements, police radio logs, CCTV, photographs, medical records documenting the time of injury, and any police statements or notes about the incident. The Act requires a factual nexus between assistance and injury; documentary contemporaneous evidence is therefore crucial.

2. Determine which compensation Act applies. Check the date of injury and apply s 2(2), s 2(2A) and s 2(2AB) to determine whether the Workers Compensation Act 1958, the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013 governs. Once identified, consult that Act for forms, claim lodgement steps, limitation periods, benefit rates and dispute-resolution processes. The Police Assistance Compensation Act imports those regimes for calculation and process.

3. Mental injury provisional payments. If the claim is for a mental injury, consult s 2(1AA) and s 2(1AB) to confirm eligibility for provisional payments and whether an exclusion applies. Remember that s 2(1AB)(a) excludes claims where the claim was made before the commencement of s 11 of the Workplace Injury Rehabilitation and Compensation Amendment (Provisional Payments) Act 2021, and s 2(1AB)(b) excludes claims where a claim relating to the same mental injury and circumstances has previously been determined. If provisional payments may apply, consult the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013 for procedural steps.

4. Property damage claims. If claiming compensation for property damage under s 2(3), the claimant should seek Ministerial authorisation and document the property ownership or control and show how the damage arose out of assisting police. Beware the double recovery prohibition in s 2(4); take legal advice before accepting damages in tort for the same property loss.

5. Avoid false statements. Given s 6 criminalises wilful false statements or wilful misleading conduct, ensure all statements to the Minister, courts and tribunals are accurate and supported by evidence. Keep thorough records and avoid speculative statements without supporting facts.

6. Prepare for the ABS wage assessment. For assessment purposes the Act treats the claimant as a Crown worker over 21 at an average weekly wage set by s 2(2B). Where a claimant’s actual pre-injury earnings are higher, advise them that the statutory fiction may limit weekly wage replacement benefits. Plan alternative relief avenues only where appropriate or necessary.

7. Engage early with the administrative body. The Act does not set detailed claim forms; follow the mechanics established under the relevant compensation Act and the administrative office handling Police Assistance Compensation claims. Timely submission and compliance with the compensation Act’s procedural rules are essential.

For the Minister and administrators

1. Authorisation and documentation for property payments. The Minister has discretion under s 2(3) to authorise payments for property damage. Develop clear delegation and internal policy for assessing “reasonable” compensation, document decisions thoroughly, and ensure processes exist to identify where a claimant has received tort damages to avoid double payments and to trigger s 2(4) recovery where necessary.

2. Recoveries from third parties. Where there is a liable third party, pursue recovery under s 4. Establish administrative coordination with the Crown Law or the relevant prosecuting authority to manage subrogated recovery while ensuring prompt compensation to injured persons from the Consolidated Fund as required by s 5.

3. Provisional payments administration. Implement procedures to process provisional payments for mental injury claims consistent with the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, including the exceptions in s 2(1AB). Ensure staff are trained on the exclusions and on how prior determinations will be identified.

4. Record keeping and fraud prevention. Because s 6 enables criminal sanction for wilful false statements, ensure that investigative protocols and evidentiary standards for referring matters for prosecution are clear, and that administrative processes minimise erroneous payments without unduly delaying legitimate claims.

5. Liaise with police agencies. Since the eligibility test turns on a police officer’s conduct and requests, maintain channels with police commands to obtain contemporaneous incident reports, statements and any relevant operational notes, while respecting privacy and evidence-handling rules.

For courts and tribunals

• Apply the relevant compensation Act provisions when exercising jurisdiction under s 3. The Act instructs tribunals to apply the same provisions as for the Workers Compensation Act 1958, the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013, as the case requires, with necessary adaptations. Decision-makers should prepare to adapt those provisions when adjudicating matters that arise under this Act.

General compliance checklist

• Confirm claimant identity and status as a non-police person.

• Establish whether assistance was requested or could reasonably have been inferred.

• Determine the correct governing compensation statute by injury date.

• For mental injury claims, check eligibility for provisional payments and potential exceptions.

• For property claims, seek Ministerial authorisation, document ownership/control and ensure no overlapping tort recovery.

• Monitor potential third-party liability and document facts for subrogated recovery.

• Keep contemporaneous and corroborative evidence to mitigate criminal exposure under s 6.

• Apply the procedural rules and time limits in the relevant compensation statute, not the Police Assistance Compensation Act, for filing and disputes.

Following these steps aligns practice with the Act’s mechanics and with the procedural regimes it imports. Practitioners should refer to the relevant compensation Act and to administrative guidelines in any implementing department for detailed forms and time frames.
