36 Constitution of Tribunal (1) The Tribunal is constituted by: (a) the Chairperson; (b) the Minister's nominee; and (c) the Police Association's nominee. (2) The Minister may, by notice in the Gazette, appoint: (a) a person to be the Chairperson; (b) a person to be the Minister's nominee; and (c) a person to be the Police Association's nominee. Police Administration Act 1978 29 (3) The Minister must not appoint a person to be the Chairperson unless the person: (a) is a member of the Australian Industrial Relations Commission established by the Workplace Relations Act 1996 of the Commonwealth whose appointment to the Tribunal has been agreed to by the President of the Commission; or (b) is a person who, in the opinion of the Minister, has suitable qualifications and experience to be appointed Chairperson.
