39 Remuneration, benefits and allowances
> > (1) The remuneration package of a NSW Police Force senior executive must be within the range determined under the [Statutory and Other Offices Remuneration Act 1975](/view/html/inforce/current/act-1976-004) for the band in which the executive is employed, except as provided by subsection (2).

> > (2) The Commissioner may, in accordance with parameters agreed on by the Commissioner and the Public Service Commissioner, determine a remuneration package for a NSW Police Force senior executive or class of NSW Police Force senior executives that is within a range higher than the range determined under the [Statutory and Other Offices Remuneration Act 1975](/view/html/inforce/current/act-1976-004) for the band in which the executive or class of executives is employed.

> > (3) The kinds and value of employment benefits and the allowances for a NSW Police Force senior executive are to be determined by the Commissioner. In making any such determination, the Commissioner is to have regard to any similar determinations that apply to Public Service senior executives.

> > (4) A NSW Police Force senior executive is only entitled to the remuneration, employment benefits or allowances provided in the executive’s contract of employment.

> > (5) For the purposes of this section, employment benefits for a NSW Police Force senior executive are—
> >
> > > (a) contributions by the executive’s employer to a superannuation scheme or fund of the executive, and
> >
> > > (b) other benefits provided to the executive at the cost of the executive’s employer that are of a private nature.
