#### 184A Consultation with LECC before certain action is taken 184A Consultation with LECC before certain action is taken > > (1) Before— > > > > > (a) making an order under section 173 (2) or (3) or 181D (1) with respect to a police officer under LECC investigation, or > > > > > (b) commencing or authorising the commencement of criminal proceedings against a police officer under LECC investigation, > > > > the Commissioner must consult with the LECC. > > > (2) Failure to comply with subsection (1) with respect to any order under section 173 (2) or (3) or 181D (1) does not affect the validity of the order. > > > (3) In this section, police officer under LECC investigation means a police officer in respect of whom the LECC has notified the Commissioner that an investigation of serious misconduct or officer maladministration that is serious maladministration is being carried out under the [Law Enforcement Conduct Commission Act 2016](/view/html/inforce/current/act-2016-061). > > **s 184A:** Ins 2005 No 64, Sch 1.26 \[2\].
