28 Restriction on dispensing of narcotic substances

(1)  [Regulation 28 Subregulation (1) substituted by S.R. 2026, No. 4, Applied:16 Feb 2026] A person must not dispense more of a narcotic substance than is sufficient for 2 days' treatment, if used in accordance with the instructions on the prescription for the narcotic substance, unless that person has verified that the prescription is authentic.

Penalty:  Fine not exceeding 10 penalty units.

(2)  [Regulation 28 Subregulation (2) amended by S.R. 2026, No. 4, Applied:16 Feb 2026] For the purposes of subregulation (1) , a person is taken to have verified the authenticity of a prescription for a narcotic substance if that person –

(a) is familiar with the handwriting of the purported prescriber and is satisfied that the prescription is in that handwriting; or

(b) [Regulation 28 Subregulation (2) amended by S.R. 2026, No. 4, Applied:16 Feb 2026] verifies with the purported prescriber that the purported prescriber wrote the prescription; or

(c) [Regulation 28 Subregulation (2) amended by S.R. 2026, No. 4, Applied:16 Feb 2026] is satisfied on reasonable grounds that the prescription is authentic and the person makes a record of the information relied upon in deciding that the prescription is authentic.
