What it does
This statutory instrument declares, by name, a set of restricted substances to which section 36 of the Poisons Act 1971 applies (s 4(1)). It is an order that operates by reference: it does not itself create separate licensing, offence, or penalty provisions, but attaches the listed substances to the regulatory regime identified by section 36 of the Poisons Act 1971. The list of declared substances is contained in Schedule 1 to the order and includes a wide range of steroids, peptide and protein growth factors, benzodiazepines and related sedatives, stimulants and precursors, and other specified agents (Schedule 1). Some entries in Schedule 1 are followed by the notation “(S4)”, which the order expressly ties to the correspondingly numbered schedule of the Poisons List (s 4(2) and Schedule 1 entries).
Mechanically, the order operates on commencement, that is, on the day its making is notified in the Gazette (s 2). The order was notified in the Gazette on 31 December 2017, which is the communicated date of notification in the instrument as displayed. The Acts Interpretation Act 1931 is declared to apply to the interpretation of this order as if the order were by-laws (s 3). The order also revokes a set of earlier Poisons (Declared Restricted Substances) Orders and amendments listed in Schedule 2 (s 5 and Schedule 2).
The immediate legal change effected by the instrument is therefore classificatory: particular substances listed in Schedule 1 are formally declared to be within the scope of section 36 of the Poisons Act 1971. The order does not itself specify the content of section 36, any procedural requirements flowing from that section, administrative decision‑making processes, licensing conditions, penalties, or enforcement mechanisms; those matters remain within the parent Act and other subordinate instruments. The S4 cross‑references create a direct link between certain listed items and entries in the Poisons List, which must be read alongside the order where relevant (s 4(2); Schedule 1 entries marked S4).
