#### 172 Grounds for suspension or cancellation
172 Grounds for suspension or cancellation
> > (1) The Secretary must suspend or cancel a licence or authority on the occurrence of one or more of the following—
> >
> > > (a) the holder of the licence or authority requests or agrees in writing to the suspension or cancellation of the licence or authority,
> >
> > > (b) the holder of the licence or authority is convicted of a serious offence against the [Drug Misuse and Trafficking Act 1985](/view/html/inforce/current/act-1985-226) or any regulation in force under that Act,
> >
> > > (c) the Secretary forms the opinion that the holder of the licence or authority is no longer a fit and proper person to hold the licence or authority,
> >
> > > (d) in the case of a licence or authority to supply methadone or buprenorphine, the Secretary forms the opinion that the supply of methadone or buprenorphine has a significant adverse effect on the amenity of the area in which the premises from which it is being supplied are situated.

> > (2) The Secretary may, at the Secretary’s discretion, suspend or cancel a licence or authority on any one or more of the following grounds—
> >
> > > (a) the holder of the licence or authority contravenes any condition of the licence or authority,
> >
> > > (b) the holder of the licence or authority is convicted of an offence against the Act or this Regulation, or of an offence (not being a serious offence) against the [Drug Misuse and Trafficking Act 1985](/view/html/inforce/current/act-1985-226) or any regulation in force under that Act,
> >
> > > (c) an order is made under section 10(1) of the [Crimes (Sentencing Procedure) Act 1999](/view/html/inforce/current/act-1999-092) relating to the holder of the licence or authority in respect of an offence against the Act or this Regulation, or an offence against the [Drug Misuse and Trafficking Act 1985](/view/html/inforce/current/act-1985-226) or any regulation in force under that Act,
> >
> > > (d) the holder of the licence or authority has made a representation in connection with the licence or authority (including in connection with an application for the licence or authority) that is false or misleading in a material particular,
> >
> > > (e) the annual fee for the licence is not duly paid.
>
> > (3) In this clause, serious offence means an offence that is punishable by imprisonment for a term of 5 years or more.
