#### 40 Proof of certificate of an analyst 40 Proof of certificate of an analyst > > (1) Any analyst analysing any substance submitted to him or her may give a certificate of the result of the analysis. > > > (2) In any legal proceedings under this Act or the regulations, the production of a certificate, purporting to be signed by an analyst, shall be prima facie evidence of the identity of the substance analysed, and of the result of the analysis, without proof of the signature, employment or appointment of the person appearing to have signed the certificate. > > > (3) (Repealed) > > **s 40:** Am 1972 No 14, sec 59 (1) (d); 1996 No 2, Sch 1 \[29\] \[30\].
