What it does
This Act provides a short title (s 1), fixes its commencement to a day to be proclaimed (s 2), records a narrow saving in relation to consequential amendments of regulations (s 3), and, by Parts 2-5, records that the amendments made by this Act to several statutes and subordinate instruments have been incorporated into the authorised versions of those instruments (see the repeated notes in Parts 2-5 and the specific itemised paragraphs 4-16). The text supplied does not reproduce the substantive amended provisions themselves; instead it records that the substantive amendments effected by this Act have been incorporated into the authorised versions of the Poisons Act 1971, the Alcohol and Drug Dependency Act 1968, the Alcohol and Drug Dependency Regulations 1999 and the Poisons Regulations 2008 (see the statements accompanying ss 4-9, 10-11, 12-14 and 15-16).
Mechanically, the Act does three separate things in its text. First, it gives the Act a short title for citation (s 1). Second, it defers the date on which the Act takes full legal effect to a proclamation (s 2), keeping the operative commencement date uncertain until the executive issues that proclamation. Third, it contains a discrete non-substantive saving to make clear that the amendments this Act effects to provisions of any regulations do not lock those provisions against later amendment or rescission by subsequent regulations (s 3). Apart from that saving, the remainder of the document supplied is administrative: each item in Parts 2-5 records that the amendments effected by the Act have been incorporated into the authorised versions of the named Acts and regulations; the document does not itself set out the text of the amendments.
For practical purposes, this Act will be manifested to users and advisers as a pointer to updated, authorised versions of the statutes and regulations it amends. The operative content that practitioners, compliance officers and regulated entities must follow will therefore be found by consulting those authorised versions; this Act functions as the instrument recording the amendment and the commencement mechanism for those changes rather than a vehicle for reprinting the amended provisions within the Act's own text.
