### 69A Time for instituting prosecutions
> *\[Section 69A Inserted by No. 95 of 1973, s. 7 \]*

> > (1) A prosecution for an offence against this Act (not being a prosecution for a contravention of [section 47](#GS47@EN) [(1)](#GS47@Gs1@EN) or [(3)](#GS47@Gs3@EN) ) may be instituted at any time within 2 years after the commission of the offence.
>
> > (2) Notwithstanding anything in [subsection (1)](#GS69A@Gs1@EN) , where a prosecution for an offence to which this section applies is instituted more than 6 months after the commission of the offence, the court may dismiss the charge if it considers that in the circumstances of the case it would be unjust, having regard to the period of time which has elapsed since the commission of the offence, to proceed with the prosecution.
