### 42 Power to prohibit the sale, &c., of a new drug
> > (1) *\[Section 42 Subsection (1) amended by No. 27 of 1984, s. 18 \]*The Minister may at any time, by order, prohibit the sale or supply of any new drug, either absolutely or except on and subject to such conditions as are specified in the order.

> > (2) [*\[Section 42 Subsection (2) amended by No. 23 of 2022, s. 33, Applied:24 Oct 2022\]*](/view/html/inforce/2022-10-24/act-2022-023#GS33@EN) *\[Section 42 Subsection (2) amended by No. 27 of 1984, s. 18 \]*Notwithstanding the provisions of [sections 40](#GS40@EN) and [41](#GS41@EN) , where application is made under [section 40](#GS40@EN) for the classification of a new drug the Minister may, before the new drug is classified, authorise the sale or supply of that drug to any person or public institution, but such a sale or supply shall be made only in compliance with such conditions as the Minister thinks fit, and as are specified by the Minister in writing.
