29 Sales of certain substances by correspondence

(1) [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] *[Section 29 Subsection (1) amended by No. 95 of 1973, s. 11 and Sched. 1 ]*Where a person (in this subsection referred to as "the seller") sells or supplies a hazardous poison to another person (in this subsection referred to as "the buyer") as the result of a written communication received by the seller from the buyer, the seller must preserve that communication for a period of at least 5 years after the day on which it is received by him, and shall enter in the poisons book a memorandum specifying–

(b) [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] from whom that communication was sent; and
(c) [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] the quantity and particulars of the hazardous poison ordered in that communication.
Penalty: [Section 29 Subsection (1) amended by No. 15 of 2017, s. 13, Applied:13 Jun 2017] Fine not exceeding 20 penalty units.
(2) [Section 29 Subsection (2) amended by No. 95 of 1973, s. 11 and Sched. 1 ][Section 29 Subsection (2) substituted by No. 15 of 2017, s. 13, Applied:13 Jun 2017] A person (in this subsection referred to as "the seller") must not, unless the Secretary approves otherwise, sell or supply to another person (in this subsection referred to as "the buyer") a hazardous poison as the result of written communication received by the seller from the buyer, unless the written communication is signed by the buyer.
