154 Extraterritorial application
> > (1) A requirement may be imposed under this Act on a person in respect of a matter even though the person is outside the State or the matter occurs or is located outside the State, so long as the matter affects a matter to which this Act relates.

> > (2) Without limiting subsection (1), this Act extends to records in the possession, custody or control of a person even when the records are located outside the State.

> > (3) In this section—

> > > (a) a requirement imposed under a notice, a direction, an order or an exemption under this Act, or

> > > (b) a requirement contained in an undertaking given under this Act, or

> > Section 31 of the [Interpretation Act 1987](/view/html/inforce/current/act-1987-015) applies to this Act and provides that an Act is to be construed as operating to the full extent of, but so as not to exceed, the legislative power of the State. That section also operates to preserve provisions to the extent that they do not exceed legislative power.
