136 Nature of proceedings for offences
> > (1) Proceedings for an offence under this Act or the regulations may be dealt with—
> >
> > > (a) summarily before the Local Court, or
> >
> > > (b) summarily before the Supreme Court in its summary jurisdiction.
>
> > (2) Proceedings for a Category 1 offence under Part 2 committed by an individual may be taken on indictment.
>
> > (3) If proceedings are brought in the Local Court, the maximum monetary penalty that the Local Court may impose for the offence is $50,000, despite any higher maximum monetary penalty provided in respect of the offence.
>
> > (4) Despite the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209) or any other Act, proceedings for an offence under this Act or the regulations may be commenced not later than 2 years after the offence first comes to the notice of the Commissioner.
>
> > (5) Proceedings for an offence under this Act (other than an offence dealt with on indictment) may be taken by the Commissioner or any other person permitted to do so by section 14 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209).
>
> > (6) The Commissioner is taken to be a public officer for the purposes of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209).
