#### 12 Primary duty of care of passenger service providers 12 Primary duty of care of passenger service providers > > (1) The provider of a passenger service must ensure, so far as is reasonably practicable, the health and safety of drivers and other persons while they are engaged in providing the service and of passengers or other persons in connection with the provision of the service. > > > (2) Without limiting subsection (1), the provider of a passenger service must— > > > > > (a) eliminate risks to safety, so far as is reasonably practicable, and > > > > > (b) if it is not reasonably practicable to eliminate risks to safety, minimise those risks so far as is reasonably practicable.
