sec.151 Stay of enforcement notice or action notice
An appeal against an enforcement notice or action notice stays the operation of the notice until— a tribunal or the Planning and Environment Court hearing the appeal decides otherwise; or the appeal ends. However, an enforcement notice is not stayed if it is given because of a local government’s belief mentioned in section 143 (2) (a) (i) , (b) or (c). If subsection (2) applies, the enforcement notice must state that the notice is not stayed, even if an appeal is made. (sec.151-ssec.1) An appeal against an enforcement notice or action notice stays the operation of the notice until— a tribunal or the Planning and Environment Court hearing the appeal decides otherwise; or the appeal ends. (sec.151-ssec.2) However, an enforcement notice is not stayed if it is given because of a local government’s belief mentioned in section 143 (2) (a) (i) , (b) or (c). (sec.151-ssec.3) If subsection (2) applies, the enforcement notice must state that the notice is not stayed, even if an appeal is made.
