Plumbers Licensing Act 1995

Statutory Board model: The Act establishes the Plumbers Licensing Board as a statutory body (s 59). The Board is not self-contained in its operational detail. Instead the Act provides institutional authority and a list of heads of power for the Governor to make regulations implementing a licensing and disciplinary regime (s 59J; Schedule 3). The Board’s membership numbers and appointment mechanisms are to be prescribed by regulation (s 59A; Schedule 3 items 1-4).

Delegated rulemaking and standards adoption: The Act explicitly contemplates that regulations may adopt, wholly or in part, codes, standards and subsidiary instruments made under other Acts or by standards bodies such as Standards Australia (s 59L(1)-(2)). If a standard or code is adopted, it applies "as in force from time to time" unless the regulations specify a particular text (s 59L(2)). The Act therefore allows the substantive technical requirements that govern plumbing work to be externally sourced and to update automatically unless regulations pin a version.

Licensing and disciplinary functions by regulation: The Board’s licence-related powers and disciplinary processes derive from the regulations. Schedule 3 lists detailed matters for regulations: who may hold a licence; classes of licence and the plumbing work permitted for each class; qualifications and competency requirements; matters the Board must be satisfied about before granting a licence; issue, renewal, suspension and cancellation rules; conditions and restrictions; keeping a register; complaints and disciplinary procedure; conferral of jurisdiction on the State Administrative Tribunal; publication of licence suspension or cancellation; advertising rules for licence holders; and transitional matters (Schedule 3 item 8, subitems a-o). The Act also allows regulations to prohibit persons other than licence holders from carrying out plumbing work (Schedule 3 item 9) and to regulate and control plumbing work generally (items 10-12).

Ministerial oversight and information access: The Minister may give written directions about the performance of the Board’s functions, but there is an important carve out. The Minister must not direct the Board about its licensing or disciplinary decisions in relation to a particular person or particular application, complaint or proceeding (s 59E(1)-(2)). Directions must be laid before Parliament or transmitted to the Clerk when Houses are not sitting, and text of directions must be disclosed in departmental annual reporting (s 59E(3)-(7)). The Minister is entitled to obtain information held by the Board and to make and retain copies of documents, subject to protections for identities of persons involved in complaints (s 59F(1)-(4)).

Integration with financial and administrative frameworks: The Act treats Board activities as services under the control of the administering department for the purposes of the Financial Management Act 2006, and as part of departmental operations (s 59H(1)). Fees charged under regulations are to be credited to the Building Services Account (s 59J(2)-(3)). The department’s annual report is required to report on the number, nature and outcomes of Board investigations and matters brought before the State Administrative Tribunal, outstanding matters, trends and forecasts, and proposals for improvement (s 59H(2)(a)-(e)).

Protections and confidentiality: The Act provides tort protection for persons acting in good faith under the Act (s 60A). It also imposes confidentiality obligations on persons who are or have been Board members or otherwise performed functions under the Act, with limited exceptions and a penalty of $5 000 for improper disclosure (s 60B(1)-(3)).

Regulatory reliance: Many of the Act’s operative consequences depend on regulations. The definitions of key terms such as "plumbing work" and "specified" are delegated to the regulations (s 59I), and Schedule 3 sets out the matters for which regulations may provide. The regulatory head of power also includes the ability to create offences with fines up to $5 000 and to establish infringement notice schemes (s 59K).

Plumbers and persons doing plumbing work: The Act affects anyone who "carries out plumbing work" defined by reference to regulation (s 3; s 59I). Schedule 3 item 9 contemplates that regulations may prohibit persons who are not licence holders from carrying out plumbing work. Because the Act leaves scope and class of plumbing work to the regulations, the set of activities regulated will be determined by subordinate legislation, but the legislative architecture makes licensed status central to lawful performance of plumbing activities.

Prospective licence applicants and current licence holders: Individuals seeking to work as plumbers, and those already working as plumbers, are directly affected. The Act contemplates regulation of the qualifications, competency, training, classes of licence, conditions, duration, renewal, and the publication of suspensions or cancellations (s 59B(1)(a), (c); Schedule 3 item 8 subitems a-g, m). The register (Schedule 3 item 8(g)) will determine what records the Board keeps about licence holders and what particulars will be publicly available under regulation.

Board members and Board staff: The Board itself, its appointed members and committee members, are regulated by the Act. Membership size is capped at nine and appointment details are to be set in regulations (s 59A; Schedule 3 items 1-4). Members and persons performing functions under the Act are subject to confidentiality obligations (s 60B(1)-(2)). The Board may delegate functions to its members and committees, and with Ministerial approval to other persons (s 59D).

The Minister and department: The Minister has supervisory functions and a statutory right to direct the Board on general performance of its functions (s 59E(1)), subject to prohibitions on directing particular licensing or disciplinary decisions (s 59E(2)). The administering department is treated as the body principally assisting the Minister and is responsible for annual reporting that must include detailed information about the Board’s investigations and State Administrative Tribunal matters (s 59H(1)-(2)). The department will also facilitate Ministerial access to Board information (s 59F(2)-(3)).

Other State agencies and public servants: The Board may use Public Service officers and State agency staff and facilities by arrangement (s 59G). Those employers and employees are therefore potential service providers to the Board and will be affected by any arrangements and costs agreed between parties (s 59G(1)-(3)).

Standards bodies and code authors: The Act permits regulations to adopt external standards such as Standards Australia codes either as they stand or as amended from time to time (s 59L). Bodies producing those standards will therefore influence the de facto technical rules applied to plumbing work.

Persons subject to inspections or disciplinary action: Schedule 3 item 12 envisages the appointment of inspectors with powers, including powers of entry, to inspect plumbing work and investigate complaints. Persons operating premises or performing plumbing work may therefore be inspected and investigated under subordinate instruments.

Consumers and building owners: End users of plumbing services, building owners and developers are indirectly affected by the licensing, competency standards, inspection and disciplinary regimes because those mechanisms determine who may lawfully perform plumbing work, and the technical and safety standards that work must meet as enforced by inspectors and a licencing regime.

Entities paying or collecting fees: The Act requires fees charged under regulations to be credited to the Building Services Account (s 59J(2)-(3)). Entities that pay licensing or regulatory fees will be financially affected. The Building Services Account is the destination for fees and will be the pool used for complaint resolution and administration as defined under the Building Services (Complaint Resolution and Administration) Act 2011 (s 59J(3)).

Adjudicative bodies: The Act contemplates conferral of disciplinary jurisdiction and review jurisdiction to the State Administrative Tribunal by regulation (Schedule 3 item 8(j)-(k)). If regulations confer that jurisdiction, the Tribunal will be the forum for disciplinary hearings and review of Board decisions.

Board duties and powers: The core statutory duties of the Board are to monitor training and qualification matters and provide advice about them, to advise the Minister on licensing and regulation, to administer licensing schemes provided by regulations, and to perform licensing, disciplinary and other regulatory functions as created by regulation (s 59B(1)(a)-(d)). The Board has all powers necessary to perform its functions (s 59C). The Board may delegate most functions by instrument, including to members and committees and, with Ministerial approval, to other persons (s 59D). Delegates are treated as performing the functions of the Board (s 59D(3)).

Licensing regime by regulation: The Act places the obligation to specify the content of the licensing regime on subordinate regulations. Regulations can set who may hold a licence, classes of licence, the plumbing work permitted to each class, qualifications and competency requirements, matters the Board must be satisfied of before granting a licence, issue, duration, renewal, suspension and cancellation conditions, conditions and restrictions on licences, and register-keeping requirements (Schedule 3 item 8(a)-(g)). Regulations may also set complaint and disciplinary procedure, and may confer disciplinary and review jurisdiction on the State Administrative Tribunal (Schedule 3 item 8(h)-(k)).

Ministerial rights and duties: The Minister has the right to give directions in writing to the Board about the performance of its functions generally or about particular matters, and the Board must give effect to any such direction (s 59E(1)). The Minister must not direct the Board regarding licensing or disciplinary functions in respect of a particular person or particular application, complaint or proceeding (s 59E(2)). The Minister must cause a copy of any direction to be laid before Parliament within 14 days or transmit it to the Clerk if a House is not sitting, and the text must be included in the department’s annual report (s 59E(3)-(7)).

Minister’s access to information: The Minister is statutorily entitled to ask the Board for information and to make and retain copies of documents in the Board’s possession relating to its functions (s 59F(1)-(2)). The Board must comply with such requests and make its staff and facilities available to the Minister for that purpose (s 59F(3)). However, the Minister is not entitled to information in a form that discloses the identity of a person involved in a complaint unless that person consents (s 59F(4)).

Use of public servants and facilities: The Board may, by arrangement with the relevant employer, make use of the services of Public Service officers or employees of State agencies either full-time or part-time, and may use departmental facilities (s 59G(1)-(2)). Arrangements are to be on terms agreed by the parties (s 59G(3)).

Financial and reporting obligations: Acts and things done by the Board are to be regarded as services under the control of the administering department for the purposes of the Financial Management Act 2006 and as part of the department’s operations (s 59H(1)). The department must include in its annual report specified details of Board investigations and State Administrative Tribunal matters, outstanding matters, trends, forecasts and proposals for improvement (s 59H(2)(a)-(e)).

Offences and penalties: Regulations may create offences and provide for fines not exceeding $5 000, and may establish an infringement notice scheme with modified penalties and an appointing mechanism (s 59K). The confidentiality provision (s 60B) imposes a penalty of $5 000 for unauthorised disclosure of information obtained in the course of duty, with enumerated exceptions.

Liability protection and disclosure limits: Individuals and the Board acting in good faith in the performance or purported performance of functions under the Act are protected from tort actions (s 60A(1)-(3)). Persons who are or have been Board members or have performed functions under the Act must not disclose or use information obtained in the course of duty except for authorised purposes, with a statutory penalty for breach (s 60B(1)-(3)).

Regulatory discretion: Because the Act leaves most substantive rules to be prescribed in regulations, the practical duties of plumbers, inspectors and licence applicants will depend on content that is not contained in the Act itself. This design gives the Board and the Governor broad scope to set rules for competence, inspection powers, fees, advertising rules and transitional arrangements under delegated legislation (s 59J; Schedule 3). The Act therefore creates structural duties and rights while delegating many operational details to the executive via regulations.

Penalty creation by regulation: The Act authorises regulations to create offences and to prescribe fines up to $5 000 per offence (s 59K(a)). Regulations may also establish an infringement notice regime, prescribe modified penalties and appoint persons to administer that scheme (s 59K(b)). The Act itself does not specify the particular conduct that will attract these regulatory offences; those elements are to be specified in the regulations under the heads of power in Schedule 3.

Confidentiality offence: The Act prescribes an express statutory criminal or civil penalty for unauthorised disclosure of information obtained in the course of duty by persons who have been a Coordinator of Water Services, Board member, or person performing functions under the Act (s 60B(1)-(2)). The penalty is $5 000. Exceptions are provided for authorised uses including performance of functions, other written law, written consent of the person concerned, or other prescribed circumstances; statistical or summary information that cannot reasonably be expected to identify persons is excluded from the prohibition (s 60B(2)-(3)).

Disciplinary sanctions via regulation and tribunal: Schedule 3 contemplates disciplinary regulation and conferred jurisdiction on the State Administrative Tribunal. Item 8(i) permits regulations to address disciplinary matters and the practice and procedure for their investigation. Item 8(j) specifically contemplates conferring jurisdiction on the State Administrative Tribunal for disciplinary matters and setting out orders that the Tribunal may make, including disciplinary penalties. Item 8(k) contemplates conferring jurisdiction on the Tribunal to hear applications for review of Board decisions or committee decisions. The Act itself does not list possible disciplinary orders or penalties. If regulations confer jurisdiction on the Tribunal, its orders and penalties will be the enforcement mechanism for disciplinary breaches (Schedule 3 item 8(j)-(k); s 59H(2)(a)(ii) references matters brought before the State Administrative Tribunal).

Inspection and entry powers: Schedule 3 item 12 lists appointment or authorisation of persons to inspect plumbing work and investigate complaints, and grants them powers including powers of entry "for the purposes of such inspection or investigation". The specifics of those powers, including any limits or warrant requirements, must be set by regulation. The Act therefore authorises inspectors and entry powers but leaves the details to subordinate instruments.

Tort and Crown immunity: Section 60A provides that an action in tort does not lie against a person for anything done in good faith in the performance or purported performance of a function under the Act. The section extends protection to the Board and the Crown for liability that may otherwise have arisen from another person’s actions as described (s 60A(1)-(2)). The protection applies even if the act could have been done irrespective of the Act’s existence (s 60A(3)). The Act treats errors made in good faith as shielded from tort action, subject to the statutory good faith standard.

Fee collection and account-crediting: Section 59J(2) requires that fees paid or recovered under regulations made under the Act be credited to the Building Services Account. That mechanism centralises fee revenue into a statutory account used for building services complaint resolution and administration. This affects enforcement capability because regulatory enforcement and complaint resolution activity may be funded from the consolidated Building Services Account rather than a bespoke Board fund.

Reporting and parliamentary oversight: Ministerial directions must be laid before Parliament and included in the department’s annual report (s 59E(3)-(7); s 59H(2)(e)). The requirement to report the number, nature and outcome of investigations and matters brought before the State Administrative Tribunal (s 59H(2)(a)(i)-(ii)) creates a public enforcement accountability mechanism.

Limits on delegation and Ministerial reach: The Board may delegate most functions (s 59D(1)) but the power of delegation itself and any disciplinary power conferred by regulations or another written law cannot be delegated (s 59D(1)). The Minister cannot direct the Board in relation to particular licensing or disciplinary matters (s 59E(2)). These restrictions shape enforcement accountability by ensuring certain core adjudicative functions remain with the Board or are statutorily protected from private executive micromanagement.

Financial Management Act 2006: The Act ties Board activity into the Financial Management Act 2006 framework. Section 59H(1) requires that acts and things done by the Board be regarded as services under the control of the administering department for the purposes of s 52 of the Financial Management Act 2006, and part of the department’s operations for the purposes of Part 5 of that Act. This subjects Board expenditures and reporting to departmental financial controls and requires the department’s annual report to include specified Board-related information (s 59H(1)-(2)).

Building Services (Complaint Resolution and Administration) Act 2011: Section 59J(3) defines the Building Services Account as the account referred to in s 92(1) of the Building Services (Complaint Resolution and Administration) Act 2011. The Act therefore links fee revenue collected under plumbing regulations to the Building Services Account, centralising fee flows into a statutory account used for complaint resolution and administration (s 59J(2)-(3)).

State Administrative Tribunal Act and conferral of jurisdiction: Schedule 3 explicitly contemplates conferring disciplinary and review jurisdiction on the State Administrative Tribunal (Schedule 3 item 8(j)-(k)). The compilation notes also reference the State Administrative Tribunal conferral amendments and transitional arrangements (see compilation notes and Schedule 3 references). Where regulations confer jurisdiction, disciplinary proceedings and reviews will proceed under the State Administrative Tribunal Act and its procedural rules.

Adopted codes and standards: The regulations may adopt rules, regulations, codes, or other subsidiary legislation made under other Acts, Commonwealth Acts, or standards produced by Standards Australia or similar bodies (s 59L(1)). Adopted instruments apply as in force from time to time unless regulations specify a particular text (s 59L(2)). This creates a cross-reference mechanism that imports technical and safety requirements from external regulatory regimes without amending the Act.

Other removed or prior roles: The Act contains references to offices and provisions that have been deleted, and the compilation notes explain the historical evolution of the Act’s title and content from the Water Services Coordination Act 1995 through name changes and deletions (Compilation table and notes). For example, the definition of "Coordinator of Water Services" appears in s 60B(1)(a) even though earlier parts dealing with that office are marked deleted. The compilation and notes must be consulted to track historical functions transferred to other authorities, such as the Economic Regulation Authority and the State Administrative Tribunal, and how transitional protections operate (compilation notes).

Interpretation Act and transitional provisions: The compilation notes include a Schedule 3 from the Economic Regulation Authority Act 2003 dealing with transitional and saving provisions that affect how references to former officials, decisions, and records operate post-reform. These transitional mechanisms interact with the Act where former functions were transferred; the compilation notes state that continuing acts, decisions and immunities persist as if they were done by the successor authority (compilation notes, Schedule 3 clauses 6-13).

Regulatory hierarchy and Governor’s power: Section 61 confers power on the Governor to make regulations necessary or convenient for giving effect to the Act. That regulation-making power interacts with other subordinate instruments adopted under other Acts when the regulations adopt or reference them (s 59L). The Act’s reliance on subordinate instruments means that the specifics of regulation enforcement, criminal penalties and technical standards are implemented through the wider regulatory landscape.

Criminal law and administrative penalties: The Act authorises delegated creation of offences and infringement notice regimes (s 59K). Where regulations create criminal offences, those offences will operate alongside general criminal law and administrative penalty regimes. The content and interaction will depend on how regulations are drafted and which offences are created.

Privacy and public disclosure regimes: The Minister’s entitlement to Board information (s 59F) is limited where disclosure would identify persons involved in complaints without consent, but other reporting obligations require the release of aggregate and specified information in departmental annual reports (s 59E(7); s 59H(2)). The confidentiality offence under s 60B coexists with other written laws that may require disclosure. Regulations may also specify circumstances in which the publication of suspension or cancellation must occur (Schedule 3 item 8(m)).

The Act’s title, structure and content have been substantially amended since assent. The compilation table and in-text amendment notes record the changes. Key milestones recorded in the source are:

• Original enactment and early names: The short title was initially the Water Services Coordination Act 1995, later changed to the Water Services Licensing Act 1995, and now known as the Plumbers Licensing Act 1995 (note under s 1).

• 1999 reforms: Part 5A and the Plumbers Licensing Board provisions were inserted by the Water Services Coordination Amendment Act 1999 (No. 39 of 1999). Sections 59 and following are noted as inserted by No. 39 of 1999 s 7 (see s 59, s 59A, s 59B, s 59C, s 59D, s 59E, s 59F, s 59G, s 59H, s 59I, s 59J, s 59K, s 59L).

• 2003 amendments: Provisions were amended by the Economic Regulation Authority Act 2003 (No. 67 of 2003), with some sections changed by Sch. 2 (see amendment notes for s 59B and s 59H). The compilation records the Economic Regulation Authority Act 2003 Sch. 2 Div. 18 as assented 5 Dec 2003 and commencing 1 Jan 2004.

• 2004-2006 administrative adjustments: The State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 and the Financial Administration Legislation Amendment Act 2005 introduced modifications affecting conferral of jurisdiction and alignment with financial reporting obligations. The compilation table records the State Administrative Tribunal conferral amendments effective from 1 Jan 2005 and the Financial Administration Legislation Amendment Act effective 1 Jan 2006.

• 2011 linkage to Building Services Account: The Building Services (Complaint Resolution and Administration) Act 2011 s 130 amended the Act to credit fees under its regulations to the Building Services Account, reflected in the inserted definition of Building Services Account in s 59J(3) and the reprint dated 29 Aug 2011.

• 2012 structural deletions: The Water Services Legislation Amendment and Repeal Act 2012 made substantial deletions across the Act, with many earlier parts removed. The compilation notes indicate large deletions in 2012 and the reprint dated 18 Nov 2013.

• 2025 minor amendments and repeals: The Statutes (Repeals and Minor Amendments) Act 2025 (No. 14 of 2025) is recorded in the compilation table, with amendments to s 60A noted (see s 60A amended: No. 14 of 2025 s 31(2); and deletion of s 60C: No. 14 of 2025 s 31(3)). The compilation table records assent 25 Sep 2025 and commencement 26 Sep 2025 for that amending Act.

Specific in-text amendment markers show where particular sections were altered. For example:

• Section 3 was amended by No. 39 of 1999 s 5 and subsequent acts (No. 67 of 2003 Sch. 2 cl. 91; No. 25 of 2005 s 64; No. 25 of 2012 s 194).

• Section 59B was inserted by No. 39 of 1999 s 7 and later amended by No. 67 of 2003 Sch. 2 cl. 108.

• Sections 59E and 59F were inserted by No. 39 of 1999 s 7 and later amended by several statutes including No. 5 of 2005 s 46, No. 77 of 2006 Sch. 1 cl. 178(1), and No. 8 of 2009 s 133(4) and (5).

• Section 59H was inserted in 1999 and later amended by No. 55 of 2004 s 1303, No. 77 of 2006 Sch. 1 cl. 178(2), and No. 16 of 2011 s 130(2).

• Section 59J was inserted by No. 39 of 1999 and later amended by No. 16 of 2011 s 130(3) and (4) to link to the Building Services Account.

The compilation table lists the sequence of reprints and the Acts contributing amendments. The text also records numerous deletions of earlier parts, for example Parts 2, 3, 4 and many sections marked deleted at various amendment dates (see the notes under Part 1 and the bracketed deletion notes). These deletions indicate the Act’s move to a more focused licensing and board-based structure, with many prior provisions removed or relocated by later statute.

Users should consult the compilation table and notes for precise commencement dates of amendments and reprints. The Act contains internal amendment notes on individual sections that identify the amending instrument and clause, which should be consulted when tracing the legislative history of a particular provision.

The text of the Act supplied contains no case law, judicial decisions or references to litigation regarding this Act. The Act does, however, create potential adjudicative pathways and references to external tribunals and bodies that would be the likely venues for future disputes if regulations confer jurisdiction accordingly.

State Administrative Tribunal: Schedule 3 item 8(j) and (k) permits regulations to confer jurisdiction on the State Administrative Tribunal to deal with disciplinary matters and with applications for review of Board or committee decisions. If regulations do so, disciplinary proceedings and reviews will proceed before the Tribunal in accordance with its governing legislation and rules. The Act further requires the department’s annual report to include details of matters brought before the State Administrative Tribunal under this Act (s 59H(2)(a)(ii)). The Act therefore anticipates Tribunal involvement but leaves the conferral of jurisdiction to regulation.

Transitional and saving provision references: The compilation notes reproduce transitional and saving provisions from other Acts such as the Economic Regulation Authority Act 2003. Those transitional clauses outline how decisions, records and liabilities of former officials continue and how immunity transfers to successor authorities. Where disputes concern decisions made during transitions, the compilation notes indicate that the successor authority is to be taken as having done former officials’ acts and that immunity continues in favour of the Authority for acts done before transition (compilation notes, Schedule 3 clauses 6 and 13). These transitional provisions may be relevant in litigation involving decisions made by legacy offices, but the Act text supplied does not identify particular cases.

No judicial interpretations rendered: Because the provided source does not include reported decisions or statutory interpretation notes, readers should not assume existing judicial construction. Any litigation touching on meaning of "good faith" in s 60A, definition of "plumbing work" where left to regulations under s 59I, the scope of Ministerial powers under s 59E, or the application of adopted external standards under s 59L will depend on later cases or administrative determinations not present in this source.

Recommendation for researchers: To compile a litigation history beyond the Act text, users need to search State and Federal law reporting services, the State Administrative Tribunal decisions database once regulations confer jurisdiction, and registries for judicial review in the Supreme Court of Western Australia. The Act directs that disciplinary and review matters may be handled by the State Administrative Tribunal if regulations confer that jurisdiction (Schedule 3 item 8), so Tribunal decisions will be an important source of litigation history after the regulations and Tribunal conferral are in force.

Regulatory blank cheque for core operational detail: The Act confers broad and detailed rulemaking powers to the Governor and regulations (s 59J; Schedule 3). Important operational definitions and limits, including what counts as "plumbing work" and the classes of licence, are not in the Act but are left to subordinate instruments (s 59I; Schedule 3 item 8). Practitioners should not assume the Act sets substantive standards , instead the regulations and any adopted external standards determine precisely what activities require a licence, what qualifications are needed, and what inspection and entry powers apply. This design creates legal uncertainty until regulations are examined.

Adoption of external standards as in force: Regulations may adopt external codes and standards "as in force from time to time" unless the regulations adopt a particular text (s 59L(2)). That approach has two operational consequences. First, it can cause standards to update automatically with little or no parliamentary oversight, potentially altering compliance obligations over time. Second, it raises the risk of differences in the legal text in force and the industry guidance practitioners expect unless regulations pin a specific version. The Act provides the mechanism for automatic updates; it does not require versioning.

Ministerial access balanced by identity protection: The Minister has a broad entitlement to information held by the Board, including the right to copies of documents (s 59F(1)-(2)). However, identity-protecting limits apply where disclosure would identify persons involved in complaints without consent (s 59F(4)). Practically, that means the Minister can obtain most operational information while still being blocked from receiving identifiable complainant information without consent. The boundary between aggregate operational data and person-identifying information may be contested in practice.

Delegation and non-delegable disciplinary power: The Board may delegate functions but may not delegate the power of delegation itself or any disciplinary power conferred by the regulations or another written law (s 59D(1)). In consequence, disciplinary powers must remain exercised by the Board itself or by a body that cannot be a delegate under s 59D(1). The provision preserves a degree of institutional centrality for disciplinary decisions, but it also means that the effective speed and resourcing of disciplinary processes will depend on the Board’s own capacity.

Ministerial directions and limits: The Minister may direct the Board in writing about performance of its functions and the Board must give effect to such directions (s 59E(1)). But the Minister cannot direct the Board on licensing or disciplinary functions in relation to a particular person or application (s 59E(2)). The carve-out limits political interference in individual regulatory decisions while allowing general policy direction. Practically, the line between general policy direction and direction concerning a "particular application" could be litigated.

Reporting obligations centralise accountability: Acts and things done by the Board are to be regarded as services under the control of the department for financial management purposes (s 59H(1)). The department’s annual report must include detailed account of investigations and State Administrative Tribunal matters (s 59H(2)(a)-(e)). The Board’s activities are therefore folded into departmental accountability channels, which affects transparency and where scrutiny occurs.

Tort immunity with "good faith" qualifier: Section 60A shields persons from tort actions for things done "in good faith" in the performance or purported performance of functions under the Act (s 60A(1)). The statutory good faith threshold will be central to any civil claim, and its legal contours may need judicial clarification. The provision also relieves the Board and the Crown of liability arising from such acts (s 60A(2)). Practitioners should note that the immunity covers acts and omissions and applies even if the act could have been done without the Act (s 60A(3)-(4)).

Penalty levels are modest in a contemporary regulatory context: The Act caps fines that regulations may prescribe at $5 000 for offences created under the regulations (s 59K(a)). The same $5 000 figure is the penalty in s 60B for unauthorised disclosure. For economic regulators and compliance planners, a $5 000 cap may be low relative to the safety, rectification, or consumer protection interests at stake in plumbing work, and may affect deterrence and enforcement strategies. However, regulation can also establish infringement notice schemes and disciplinary sanctions if conferring jurisdiction to the Tribunal (s 59K(b); Schedule 3 item 8(j)).

Privacy and publication tension: Schedule 3 item 8(m) gives regulations power to provide for publication in specified circumstances of information relating to cancellation or suspension of a licence. Section 59F(4) protects the identity of persons involved in a complaint unless that person consents. The Act therefore authorises publication of regulatory outcomes while protecting complainant identity, but without more detailed rules in the Act, the exact balance depends on regulations.

Reliance on departmental staff and facilities: The Board may make use of public service staff and departmental facilities by arrangement (s 59G). That arrangement is to be on mutually agreed terms (s 59G(3)). In practice, this means the Board’s operational capacity may depend on inter-agency agreements and departmental resourcing decisions, which has implications for the pace and cost of licensing, inspections, and disciplinary work.

High dependence on regulations for enforcement architecture: The Act’s enforcement architecture , including what conduct is an offence, the powers of inspectors, the terms of disciplinary procedure, and the details of licensing classes , is predominantly in the hands of regulations under Schedule 3. Until those regulations are published and examined, it will be hard to advise on specific compliance obligations, risk of criminal liability, and precise administrative processes.

Transitional and deleted provisions create textual complexity: Many earlier sections and Parts are marked as deleted in the Act text and compilation notes. The historical residue such as references to the Coordinator of Water Services in s 60B(1)(a) may be a legislative artefact. Practitioners should check the compilation table and commencement dates to understand which provisions are current and which are historical, especially in relation to transitional immunity and vesting of decisions under earlier regimes.

Understand and track the regulations first: The Act delegates the definition of "plumbing work", the classes of licence, competency requirements, disciplinary procedures and inspection powers to regulations (s 59I; s 59J; Schedule 3). The first compliance step for a practitioner advising a plumber or operator is to obtain and review the current regulations and any standards adopted under s 59L to determine: what activities are regulated, which class of licence is required, the qualifications and experience required, and any transitional arrangements for existing practitioners.

Licensing: Apply for and maintain the appropriate licence class as prescribed in regulations. Regulations may set the matters of which the Board must be satisfied before granting a licence (Schedule 3 item 8(d)). They will also set conditions on issue, duration, renewal, suspension or cancellation (Schedule 3 item 8(e)). Practitioners should maintain documentary evidence of qualifications, competency, training and experience likely to be required by regulation, and implement internal procedures for licence renewal and compliance with any conditions.

Register obligations and information accuracy: Regulations may require the keeping of a register and prescribe specified information to be recorded (Schedule 3 item 8(g)). Licence holders should ensure register particulars are complete and accurate, and have processes to correct or update records in line with regulation. Errors in register information may be grounds for regulatory action; the Act gives the Board power to regulate accuracy and amendment of the register via regulation.

Compliance with adopted standards and codes: If regulations adopt external standards, compliance requires monitoring those standards. Where the regulations adopt standards "as in force from time to time" (s 59L(2)), compliance programs should include ongoing monitoring of standards bodies for updates, and procedures to update workplace practices and documentation accordingly. Where regulations pin a specific text, ensure the workplace conforms to that version.

Responding to inspections and complaints: Regulations may appoint inspectors with entry powers (Schedule 3 item 12). Licence holders should establish protocols for interacting with inspectors, including verifying the inspector’s authority, cooperating with lawful inspections, promptly remedying defects identified, and documenting communications. Maintain records of work, qualifications and training to produce when requested.

Disciplinary exposure and Tribunal procedure: Because regulations may confer disciplinary jurisdiction on the State Administrative Tribunal (Schedule 3 item 8(j)-(k)), prepare for potential Tribunal proceedings by preserving documentary evidence, workmanship records, complaint handling logs and remedial actions taken. Maintain professional indemnity or appropriate insurance given the potential for professional discipline even if tort immunity for regulators exists.

Confidentiality and information handling: Persons who are or have been Board members, the Coordinator of Water Services or persons performing functions under the Act are subject to the confidentiality prohibition in s 60B. Private businesses engaging with the Board should treat Board-held complaint information as potentially confidential and must not disclose such information except for permitted purposes. For businesses, ensure staff receiving Board information are trained on when disclosure is permitted, and implement document handling rules to avoid the $5 000 penalty risk under s 60B.

Ministerial and departmental reporting interactions: Board members and staff should expect that Ministerial directions will be publicly tabled and included in departmental annual reporting (s 59E(3)-(7); s 59H(2)(e)). Administrators should plan for transparency and recordkeeping so that directions and departmental reporting obligations can be met with auditable evidence of compliance.

Fee payment and accounting: Fees payable under regulations are to be credited to the Building Services Account (s 59J(2)-(3)). Businesses and practitioners should confirm fee schedules in the regulations, budget for licensing, renewal and inspection fees, and ensure timely payment. Firms offering services should include any required licence numbers in advertising as prescribed by regulation (Schedule 3 item 8(n)).

Contracting and advertising compliance: Regulations may impose conditions on how licence holders advertise or publicise that they carry out plumbing work (Schedule 3 item 8(n)). Businesses should ensure contracts, advertising and tender documents include accurate licence details and do not misrepresent licence class or permitted scope of work.

Transition planning for staff and resources: Because the Board may make use of public service staff and State agency facilities by arrangement (s 59G), compliance planning should account for potential constraints around resourcing and response times. If the Board’s capacity depends on departmental arrangements, businesses should factor possible delays in licensing and inspections into project timelines and contractual commitments.

Monitor Tribunal and regulatory developments: Because the Act anticipates conferral of Tribunal jurisdiction and leaves many matters to regulation, compliance must include active monitoring of regulatory instruments, Gazette notices, Board determinations and State Administrative Tribunal rules once jurisdiction is conferred. Set up a regulatory watch for updates to regulations, ministerial directions, adopted standards and guidance documents.

Seek pre-emptive clarification and record consent where needed: For matters involving disclosure of complainant identity or sensitive records, obtain written consent where appropriate to avoid triggering confidentiality restrictions under s 59F(4) and s 60B. Where the practical boundary between permissible and impermissible disclosure is uncertain, seek written advice or clarification from the Board or the administering department.

Legal review of contracts and insurance: Given the interaction between potential disciplinary sanctions, modest fine caps for regulatory offences, and tort immunity for regulators, businesses should review contractual indemnities, subcontractor oversight, and insurance coverage. Ensure that contractual obligations to clients are consistent with licensing status and that subcontractors engaged to perform plumbing work hold appropriate licences as will be required by regulations (Schedule 3 item 9).

Document retention and audit trails: Maintain robust records of training, competency assessments, licences, inspections, remedial actions and correspondence with the Board or inspectors. Because disciplinary matters and Tribunal proceedings may be triggered by records or omissions, an auditable retention policy will support compliance and defence.

In sum, compliance under this Act is heavily dependent on subordinate instruments. Practitioners must obtain the current regulations and any adopted standards, implement licensing and recordkeeping systems that align with regulatory requirements, and maintain ongoing monitoring of standards and rules adopted from external bodies.
