What it does
This Act prohibits retailers from providing a defined category of lightweight polyethylene shopping bags to customers for the purpose of carrying goods from the retailer's premises, establishes criminal penalties for supplying such bags and for providing false or misleading information about the composition of bags, and gives an administrative officer (the Director) powers to require evidence about whether bags are biodegradable. The operative prohibitions are in section 4: a retailer must not provide a "plastic shopping bag" for the stated purpose (s 4(1)), and must not give false or misleading information about the composition of a plastic shopping bag (s 4(2)). The Director may, by written notice, require a retailer to supply evidence, within a specified period not less than 30 days, as to whether a bag on the retailer's premises is a "biodegradable bag" (s 5(1)-(3)). Penalties for contraventions are set out in those provisions (s 4 and s 5).
The Act defines the controlled item, "plastic shopping bag", by reference to composition and thickness: a bag with handles that is made, in whole or in part, of polyethylene with thickness of less than 35 microns, or a type prescribed by regulation (s 3). The definition expressly excludes biodegradable bags (which are themselves defined by reference to a relevant Standards Australia standard), bags that are integral parts of sealed packaging, barrier bags used for unpackaged perishable food, and other types the regulations may exclude (s 3). The Act directs that the term "relevant standard" is Australian Standard AS 4736-2006 Biodegradable plastics… suitable for composting (s 3). Regulations may adopt Standards Australia standards, or their amendments, and may permit the Director to determine matters under the regulations (s 7(5)-(6), s 7(4)).
Administratively, until reassignment by an Administrative Arrangements order, the Act is assigned to the Minister for Environment, Parks and Heritage and administered by the Department of Primary Industries, Parks, Water and Environment (s 8). The Act is to be read together with the Environmental Management and Pollution Control Act 1994 (EMPC Act): defined expressions from the EMPC Act apply unless contrary intention appears, authorised officers under the EMPC Act may exercise their powers for purposes of administering and enforcing this Act, and where the two Acts conflict the provisions of this Act prevail (s 6).
