#### 7 Land excluded from operation of Act 7 Land excluded from operation of Act > > (1) This Act does not apply to the following land— > > > > > (a) land that is within a local government area (or part of a local government area) specified in Part 1 of Schedule 1, > > > > > (b) land described in Part 2 of Schedule 1 that is subject to an environmental planning instrument (within the meaning of the [Environmental Planning and Assessment Act 1979](/view/html/inforce/current/act-1979-203)), > > > > > (c) land that is dedicated or set apart as a flora reserve under the [Forestry Act 2012](/view/html/inforce/current/act-2012-096) or declared to be a special management zone under that Act, > > > > > (d) land that is declared as wilderness area under the [Wilderness Act 1987](/view/html/inforce/current/act-1987-196) or the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080), > > > > > (e) land that is dedicated or reserved under the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080), > > > > > (f) land that is subject to a conservation agreement entered into under Division 7 of Part 4 of the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080), > > > > > (g) land that is subject to an interim protection order made under Part 6A of the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080), > > > > > (h) land that is declared as a marine park or an aquatic reserve under the [Marine Estate Management Act 2014](/view/html/inforce/current/act-2014-072), > > > > > (i) land that is critical habitat under Part 7A of the [Fisheries Management Act 1994](/view/html/inforce/current/act-1994-038), > > > > > (j) land to which an interim heritage order or listing on the State Heritage Register under the [Heritage Act 1977](/view/html/inforce/current/act-1977-136) applies, > > > > > (k) Lord Howe Island, > > > > > (l) land in a declared area of outstanding biodiversity value within the meaning of the [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063). > > > (2) The regulations may amend Schedule 1. > > > (3) This Act does not cease to apply to an authorised plantation merely because the land becomes land referred to in subsection (1) after the authorisation was granted. > > **s 7:** Am 2012 No 96, Sch 4.29 \[1\]; 2014 No 72, Sch 4.12; 2023 No 7, Sch 1.16\[1\] \[2\].
