#### 48 Plantation operations not subject to certain provisions of National Parks and Wildlife Act 1974 and Biodiversity Conservation Act 2016 48 Plantation operations not subject to certain provisions of [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080) and [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063) > > (1) A person carrying out plantation operations on an authorised plantation is exempt from the [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063), sections 2.1–2.4. > > > (2) Subsection (1) exempts the person only— > > > > > (a) if the operations are carried out in accordance with the conditions of authorisation and the provisions of the Code applying to the plantation, and > > > > > (b) in relation to things that are reasonably connected with the carrying out of the operations. > > > (3) The following orders must not be made to prevent or interfere with the carrying out of plantation operations on an authorised plantation— > > > > > (a) a stop work order or interim protection order within the meaning of the [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063), Part 11, > > > > > (b) a stop work order under the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080), Part 6A, Division 1, > > > > > (c) an interim protection order within the meaning of the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080). > > > (4) (Repealed) > > Note— > > See section 55 for continuation of power to make orders to protect relics or Aboriginal places within the meaning of the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080). > > **s 48:** Am 2023 No 7, Sch 1.16\[9\]–\[11\].
