Plant Health Regulations 2022

The Regulations operate through a small set of concrete regulatory levers: mandatory labelling, documentary controls for propagation material, accreditation and registration as vehicles to authorise particular activities, discretionary exemptions and fee waivers, and formal recognition of interstate correspondence.

Key defined and functional concepts in the text include:

• Act: defined as the Plant Health Act 2009 (r 3(1)). The Regulations are subordinate instruments under that Act and repeatedly reference powers and definitions in it (for example, sections 12, 13, 17, 20, 27 and 28 of the Act are invoked in the Regulations; see rr 5-8).
• ICA and operational procedure: ICA is the Interstate Certification Assurance scheme developed by the States under the 1999 MOU; “operational procedure” is an operational procedure agreed under the ICA and included in the published list maintained by the Domestic Quarantine Market Access Working Group (r 3(1)). The Regulations require labelling to identify which ICA operational procedures have been followed for produce packed by accredited persons (r 5(1)(b)(v)).
• IP number: a unique identifier assigned to an accredited person (r 3(1)). The IP number is a required label element for produce packed by accredited persons (r 5(1)(b)(iii)).
• Plant Quarantine Standard: the Regulations treat a particular Plant Quarantine Standard as the operative document for quarantine‑related documentary requirements; the default is the Plant Quarantine Standard South Australia adopted by notice in 2006 but the Minister may adopt another standard by notice under the Act (r 3(2)).
• Prescribed plant: plants listed in Schedule 1 (Citrus spp; Phoenix dactylifera offshoots; Vitis spp; Pinus spp; Solanum lycopersicum for tomato). A prescribed plant sold for propagation that has been brought or introduced into the State must be accompanied by an assurance certificate or plant health certificate and any other documents required by the Minister and set out in the Plant Quarantine Standard (r 6(1)-(2); Schedule 1).
• Accreditation and registration: the Regulations do not set fixed national protocols in the text but make the “prescribed protocols and operational procedures” those specified by the Minister in respect of the particular authority conferred by each accreditation or registration (rr 7-8). Regulation 7(2) prescribes that two categories of conditions in the Act (s 20(2)(e) and s 20(2)(i) of the Act) are prescribed conditions for accreditation.
• Exemptions and fees: the Minister can exempt classes of persons or activities from the Act or parts of it by Gazette notice (r 9); the Minister can waive fees on application or own initiative (r 10(1)); certain importer registration and annual fees are explicitly exempt where the applicant/importer is an accredited person or a Crown agency (r 10(2)(a)-(c)).

The Regulations therefore embed a framework in which national/interstate standards (ICA and Plant Quarantine Standard) and Minister/Chief Inspector approvals and codes (for date codes, grower/packer codes) operate as external authorities whose specifications are incorporated by reference. Compliance depends on adhering to the textual label and documentary requirements and on obtaining accreditations and registrations that carry Minister‑specified protocols.

The Regulations directly impose requirements and create obligations for specific categories of private actors and public officers and indirectly affect broader supply-chain participants.

Primary affected groups named in the text:

• Packers of fruit, vegetables and nuts: any person who “packs for sale” produce must label packaging in accordance with r 5(1). This obliges the packer whether or not they are also the grower.
• Accredited persons: persons who hold accreditation under the Act who are assigned an IP number (r 3(1)). Accredited packers must include the IP number on labels and identify the ICA operational procedures followed (r 5(1)(b)(iii)-(v)). Accredited persons are also beneficiaries of fee exemptions for importer registration and annual importer fees (r 10(2)(a)-(c)).
• Growers: where the packer is not accredited the label must include the district of production and either the name/address/postcode of both grower and packer or Chief Inspector‑approved codes identifying packer and grower (r 5(1)(c)(iii)-(iv)). Growers will therefore need to provide identifying information or accept use of approved codes.
• Sellers of used packaging: persons packing or selling produce in used packaging are treated as subject to the same labelling and hygiene requirements (r 5(2)), unless approved by the Chief Inspector to receive bulk loads for processing (r 5(3)). This affects second‑hand packaging suppliers and processors who reuse containers in the fresh produce chain.
• Persons selling plants for propagation: any person who sells a plant listed in Schedule 1 that has been brought or introduced into the State must supply the plant with an assurance certificate or plant health certificate and any other documents required by the Minister and set out in the Plant Quarantine Standard (r 6(2)). This affects nurseries, wholesalers and retailers dealing in the Schedule 1 species.
• Registered importers: registration requirements and the protocols that attach to registration are to be specified by the Minister in respect of the authority conferred by registration (r 8). Registered importers must therefore comply with Minister‑specified protocols and operational procedures.
• Chief Inspector and Minister: the Chief Inspector has approval functions (e.g. approving codes and date codes, r 5(1)(b)(iv), r 5(4)); the Minister specifies operational procedures for accreditations and registrations (rr 7-8), may adopt a different Plant Quarantine Standard (r 3(2)), may exempt classes by Gazette notice (r 9) and may waive fees (r 10).
• Agencies or instrumentalities of the Crown: specifically identified as exempt from certain fees when applying for importer registration or paying annual importer fees (r 10(2)(a)-(c)).

Secondary and indirect impacts:

• Retailers and intermediate distributors will receive produce in labelled packaging meeting the Regs and must rely on those labels for traceability information.
• Exporters and interstate suppliers may be affected by the corresponding‑laws declaration (r 4) as it frames interstate cooperation and recognition for quarantine measures for cross‑jurisdictional trade.
• Processors who receive bulk loads are affected by the Chief Inspector’s approval power (r 5(3)), which can relieve them from labelling obligations in certain circumstances.

Who pays: private packers, sellers and importers bear compliance costs for labelling, certification and any accreditation or registration fees unless exempted or waived by the Minister (r 10). Who decides: Minister determines operational procedures tied to accreditations and registrations, may waive fees and grant exemptions (rr 7-10); Chief Inspector approves codes and date codes (r 5(1)(b)(iv), r 5(4), r 5(3)). Who is penalised: persons who fail to comply with labelling requirements or to accompany prescribed plants with required certificates face maximum penalties and expiation fees specified in regs 5 and 6.

The Regulations create a discrete set of duties for those packing produce, selling propagation plants, and for those seeking accreditation or registration. They also create Ministerial and Chief Inspector decision rights and some fee‑related rights.

Duties placed on packers of fruit, vegetables and nuts (r 5):

• Label content and format: labels must be legible in English in permanent ink with letters at least 5 mm high and clearly visible on the outside of packaging (r 5(1)(a)(i)-(ii)). This is a precise formatting duty.
• If packer is accredited, label must include: the packing date or an approved date code (r 5(1)(b)(i)); brief description of contents (r 5(1)(b)(ii)); IP number of the accredited person (r 5(1)(b)(iii)); either a Chief Inspector‑approved code indicating place of production or the postcode of the town nearest the place of production (r 5(1)(b)(iv)); and the words “meets ICA” followed by the identifying number of the ICA operational procedures followed (r 5(1)(b)(v)). This duty links documentation to ICA procedural compliance.
• If packer is not accredited, label must include: date or date code (r 5(1)(c)(i)); brief description (r 5(1)(c)(ii)); district of production (r 5(1)(c)(iii)); and either name, address and postcode of grower and packer or Chief Inspector‑approved codes for grower and packer (r 5(1)(c)(iv)).
• Used packaging: must be in good repair, clean and free of extraneous visible matter, free of objectionable odour, and labelled in accordance with r 5(1) (r 5(2)(a)-(d)). There is an exception for persons approved by the Chief Inspector to receive bulk loads for processing (r 5(3)).

Duties relating to prescribed plants for propagation (r 6):

• For plants listed in Schedule 1, a person must not sell plants for propagation that have been brought or introduced into the State unless they are accompanied by an assurance certificate or plant health certificate and any other documents required by the Minister and set out in the Plant Quarantine Standard (r 6(2)(a)-(b)).

Accreditation and registration duties and rights (rr 7-8):

• The Regulations specify that the “prescribed protocols and operational procedures” for the purposes of the Act’s accreditation and importer‑registration provisions are those protocols and operational procedures specified by the Minister in respect of the particular authority conferred by the accreditation or registration (rr 7(1), 8). This means accreditation and registration will carry Minister‑specified operational requirements tailored to the authority granted.
• Regulation 7(2) prescribes that conditions under s 20(2)(e) and s 20(2)(i) of the Act are prescribed conditions for accreditation. The content of those Act provisions is not reproduced in the Regulations, but the Regulations incorporate them as prescribed conditions.

Ministerial and Chief Inspector decision rights:

• Minister may adopt a different Plant Quarantine Standard by notice (r 3(2)), determine protocols and operational procedures attached to accreditations and registrations (rr 7-8), exempt classes by Gazette notice (r 9), and waive or exempt fees in whole or part, on application or on the Minister’s own initiative (r 10(1)-(2)).
• Chief Inspector can approve codes used on labels, approve date codes and grant approval to receive bulk loads for processing (r 5(1)(b)(iv), r 5(4); r 5(3)).

Rights and entitlements:

• Accredited persons and Crown agencies have explicit fee exemptions for importer registration applications, variations to registration, and annual importer fees (r 10(2)(a)-(c)).
• The Minister retains an express power to waive prescribed fees (r 10(1)), which is a discretionary entitlement the Minister can grant to applicants or on the Minister’s own initiative.

Sanctions and remedial rights:

• The Regulations specify maximum penalties and expiation fees for contraventions of the labelling and propagation certificate requirements (r 5(1)-(2); r 6). The Regulations do not specify other enforcement mechanisms such as seizure or administrative suspension; those would be found in the parent Act where applicable.

Record and documentary duties are implicit: adherence to ICA operational procedures requires identification of the particular procedures followed on the label (r 5(1)(b)(v)), and prescribed plants require accompanying certificates and any documents required by the Plant Quarantine Standard (r 6(2)(a)-(b)), which implies a duty to obtain and retain those documents.

The Regulations themselves set out civil monetary penalties for specific contraventions and an expiation regime for certain offences; they do not reproduce the broader enforcement or inspection powers that may reside in the Plant Health Act 2009, but they make the following enforcement mechanisms explicit.

Monetary penalties and expiation:

• For failure to comply with the labelling requirements for produce packed for sale (r 5(1)), the maximum penalty is $5,000 and an expiation fee of $315 is available (r 5(1) heading). The same maximum penalty and expiation fee apply to packing for sale or selling produce in used packaging that does not meet the repair, cleanliness, odour and labelling requirements (r 5(2)).
• For the obligation not to sell prescribed plants for propagation brought or introduced into the State without the required certificates and other documents required by the Minister and set out in the Plant Quarantine Standard (r 6(2)), the maximum penalty is $5,000 and the expiation fee is $315 (r 6(2) heading).

Scope of enforcement in the Regulations:

• The Regulations catalogue the monetary exposure for breaches of particular labelling and documentary duties. They do not in the text provide details of investigatory powers, seizure, detention, order‑making, suspension of accreditation, or appeal routes. Those operational enforcement mechanisms are likely to be found in the parent Act (the Regulations reference sections of the Act such as s 17, s 20, s 27 and s 28 for accreditation and importer registration mechanics), but the Regulations themselves are limited to establishing offences and penalties for the specified contraventions.

Administrative discretion and remedial options:

• The Minister has power to grant exemptions by Gazette notice (r 9) which can operate as a legal remedy for classes of persons, plants, plant‑related products or activities, and can waive prescribed fees on application or of the Minister’s own initiative (r 10(1)). These powers act as regulatory relief mechanisms outside the penalty/enforcement framework.
• Accredited persons and Crown agencies are explicitly exempt from certain importer registration fees and annual fees (r 10(2)), which reduces exposure to fee‑related enforcement action.

Certificatory obligations:

• The requirement that prescribed plants be accompanied by an assurance certificate or plant health certificate and any other documents required in the Plant Quarantine Standard (r 6(2)) creates an evidential duty. Non‑production of such documents in an enforcement context would be the basis for charging the specified offence attracting the penalty/expiation.

Practical enforcement implication:

• Enforcement under the Regulations will focus on labelling, documentary compliance and cleanliness/condition of used packaging. The specified expiation fee provides an out‑of‑court monetary settlement for these contraventions; the Regulations do not set out procedures for prosecution or the manner in which an expiation notice is to be issued , those mechanisms are normally provided under the primary Act or general expiation statutes.

The Regulations are explicitly tied to multiple external instruments and statutes. The interaction is effected by declaration, incorporation by reference, and Ministerial powers to adopt or exempt.

Declared corresponding laws (r 4):

• For the purposes of the definition of “corresponding law” in s 3(1) of the Act, the Regulations declare the following Acts to be corresponding: Pest Plants and Animals Act 2005 (ACT), Biosecurity and Agriculture Management Act 2007 (WA), Biosecurity Act 2015 (NSW), Plant Health Act 2008 (NT), Plant Biosecurity Act 2010 (VIC), Biosecurity Act 2014 (QLD), Plant Quarantine Act 1997 (TAS) (r 4). This establishes formal recognition of interstate/territorial statutes for cross‑jurisdictional measures under the Act.

Plant Quarantine Standard (r 3(2)):

• The Regulations treat the Plant Quarantine Standard South Australia (adopted by notice in 2006) as the operative Standard for references to “Plant Quarantine Standard” unless the Minister adopts another plant quarantine standard by notice under the Act (r 3(2)). Thus, the Plant Quarantine Standard, while external to these Regulations, is incorporated by reference into documentary requirements for imported propagation materials (r 6(2)) and into the scope of Ministerial duties.

Interstate certification scheme (ICA) (r 3(1), r 5):

• The ICA scheme and its operational procedures (as maintained by the Domestic Quarantine Market Access Working Group) are incorporated into the labelling regime for accredited packers. Labels for produce packed by accredited persons must state “meets ICA” followed by the ICA operational procedure number that has been followed and met for the produce (r 5(1)(b)(v)). This creates an operational dependence on a national scheme and a published list of operational procedures.

Parent Act references (rr 5-8, 10):

• The Regulations repeatedly reference particular powers and procedural hooks in the Plant Health Act 2009. For example, r 5 is framed “for the purposes of section 12(1)(d) of the Act”, r 6 “for the purposes of section 13 of the Act”, r 7 for the purposes of sections 17(1)(c) and 20(2)(f), r 8 for the purposes of sections 27(1)(c) and 28(2)(c). The practical effect is that these Regulations supply the particular rules that operationalise those provisions of the Act.

Ministerial and Chief Inspector instruments:

• The Regulations give the Minister and Chief Inspector powers to adopt codes, approve date codes and grant exemptions or waivers (rr 3(2), 5(1)(b)(iv), 5(4), 9-10). Those instruments and approvals will interact with administrative law principles and may be subject to any review or appeal mechanisms set out in the Act or general administrative law.

Repeal of earlier regulations (Schedule 2):

• The Plant Health Regulations 2009 are expressly repealed (Schedule 2). The legislative history provides the Gazette reference and commencement date (1.8.2022: r 2). This produces a clean supersession; any transitional arrangements would need to be checked in the primary Act or the repealed instrument but are not provided in these Regulations.

Fee exemptions and Crown immunity:

• The Regulations exempt accredited persons and agencies/instrumentalities of the Crown from specific importer registration and annual fees (r 10(2)). This intersects with other financial administration laws in that it reduces the fiscal obligations that would otherwise be payable under fee regimes established pursuant to the Act.

Limitations and gaps:

• The Regulations do not reproduce or restate inspection, seizure, quarantine detention or appeal mechanisms; those must be sought in the Plant Health Act 2009 and the adopted Plant Quarantine Standard. The Regulations therefore operate as an implementing schedule of duties and penalties that work alongside the primary Act and external standards.

The Regulations themselves are new principal regulations for 2022 and include an express repeal of the 2009 regulations (Schedule 2). The legislative history recorded in the text provides the Gazette reference for the instrument’s making and its commencement date:

• Citation and commencement: The Instrument is cited as the Plant Health Regulations 2022 (r 1) and commenced on 1 August 2022 (r 2). The principal regulations entry in the Legislative history records “2022 No 53 Gazette 7.7.2022 p2135” with commencement 1.8.2022 (Legislative history notes).

• Repeal: Schedule 2 expressly repeals the Plant Health Regulations 2009 (Schedule 2).

No other amendments, variations, or historical versions are recorded in the text supplied. The Regulations incorporate external documents by reference and allow the Minister to adopt other Plant Quarantine Standards by notice (r 3(2)), which creates a mechanism for future changes in operative standards without amending the Regulations themselves. The Minister also has ongoing discretion to modify the operational protocols and conditions attaching to individual accreditations and registrations (rr 7-8), and to make exemptions or waive fees (rr 9-10). Those powers create ongoing administrative amendment potential without statutory amendment of the Regulations.

Where to look for subsequent changes:

• Future changes to the operative Plant Quarantine Standard will be effected by Ministerial notice under the Act (r 3(2)) rather than by amendment to the Regulations.
• Ministerial determinations of the prescribed protocols and operational procedures for individual accreditations and registrations are made in the exercise of the Minister’s statutory powers (rr 7-8) and are therefore recorded in administrative decisions rather than in these Regulations.
• Exemptions and fee waivers are effected by Gazette notice (r 9) or by Ministerial action (r 10(1)) and thus will be identifiable in Government Gazettes and Ministerial records rather than by regulatory amendment.

In short, the statutory amendment history captured in the instrument itself is limited to the 2022 commencement and repeal of the prior regulations; the design of the instrument delegates much of the variable content to Ministerial and Chief Inspector instruments and national standards which can change administratively.

The text of the Regulations contains no case law, judicial decisions, or recorded litigation history. The Legislative history included in the Regulations is administrative (Gazette citation, commencement date) and does not report any judicial proceedings. Consequently, there is no litigation history contained in the instrument to cite.

Practical observations about potential litigation pathways, based on the Regulations’ content:

• Compliance disputes that might give rise to litigation would typically relate to whether labelling and documentary requirements in rr 5 and 6 were met, or to whether an entity was rightly granted an exemption or a fee waiver under rr 9-10. Any judicial review of Ministerial or Chief Inspector decisions (for example decisions about codes, approvals, or the content of operational procedures attached to an accreditation or registration) would rely on administrative law principles but no such cases are recorded in the text.
• Prosecutions for contraventions of the specified offences (r 5 and r 6) would be commenced under the Act and Regulations; none are recorded here.
• Challenges might arise over the incorporation by reference of external standards (ICA operational procedures and the Plant Quarantine Standard), such as disputes about whether a particular operative procedure was properly followed or whether the documents required by the Plant Quarantine Standard were correctly specified. The Regulations require identification of the ICA operational procedure number on labels for accredited packers (r 5(1)(b)(v)) and require prescribed plants to be accompanied by certificates and any other documents required by the Plant Quarantine Standard (r 6(2)). Litigation could centre on the evidentiary sufficiency of such documents or on the lawfulness of administrative determinations implementing those standards, but no decisions are reported in the instrument.

Because the Regulations are an implementing instrument with discrete, largely technical obligations, litigation, if it occurs, would likely arise from:

• criminal or regulatory prosecutions for failure to label or to produce required certificates (r 5, r 6);
• administrative law challenges to Ministerial or Chief Inspector decisions (rr 3, 5, 7-10);
• disputes about the meaning or applicability of codes approved by the Chief Inspector or operational procedures specified by the Minister (rr 5, 7-8).

None of these hypothetical disputes are reflected in the text provided. Any practitioner needing precedents should therefore consult contemporaneous case law under the Plant Health Act 2009 and related administrative law decisions; those are not included in this instrument.

The Regulations are short and technical but contain several specific points that pose compliance or practical traps if overlooked.

Precise labelling format and content:

• Labels must be legible in English, in permanent ink, and with letters at least 5 mm high, and clearly visible on the outside of packaging (r 5(1)(a)). Failure to meet any of these formatting elements triggers an offence with a $5,000 maximum penalty and an expiation fee of $315. Small packers or those using handheld labelling devices may inadvertently fail the 5 mm height or permanent ink requirement.

Accredited vs non‑accredited label divergence:

• Different label fields apply depending on whether the packer is accredited (r 5(1)(b)) or not (r 5(1)(c)). Accredited packers must show an IP number and the ICA operational procedure number on the label (r 5(1)(b)(iii), (v)). Non‑accredited packers must show the district of production and either names/addresses or Chief Inspector‑approved codes for grower and packer (r 5(1)(c)). Misclassification of the packer’s status could lead to non‑compliant labelling.

Reliance on external approvals and codes:

• The Chief Inspector approves codes identifying place of production, packer and grower, and approves date codes (r 5(1)(b)(iv), r 5(4), r 5(1)(c)(iv)). Those approvals are not published within the Regulations, so packers must actively obtain or confirm approval codes from the Chief Inspector. Assuming a particular code is acceptable without confirmation invites non‑compliance.

Incorporation by reference of external standards:

• The Plant Quarantine Standard is not set out in the Regulations but is incorporated by reference as the standard whose documentary requirements attach to prescribed plants for propagation (r 6(2)). The default standard is the Plant Quarantine Standard South Australia adopted in 2006 unless the Minister adopts another standard (r 3(2)). Sellers of Schedule 1 plants must therefore check the current Plant Quarantine Standard and any Ministerial notice adopting a different standard; failure to provide ancillary documents required by that Standard is an offence.

Limited list of “prescribed plants”:

• The list in Schedule 1 is limited and specific and includes a botanical synonym for tomato (Solanum lycopersicum (syn. Lycopersicon esculentum)). Operators must check the exact botanical names in the Schedule , omission of a variety because of naming synonyms could lead to confusion about whether the certificate requirement applies.

Used packaging rule nuance:

• Used packaging is permitted only if in good repair, clean, free of extraneous visible matter and objectionable odour and labelled as required (r 5(2)). There is a carve‑out for persons approved by the Chief Inspector to receive bulk loads for processing (r 5(3)). Processors accepting loose loads must therefore obtain Chief Inspector approval or ensure each package meets the conditions; otherwise, the packer or seller of produce in used packaging may be liable.

Ministerial discretion and opacity:

• The Regulations defer significant content to Ministerial determinations (rr 7-8) and to the Plant Quarantine Standard (r 3(2)). This creates two compliance risks: (1) requirements attached to an accreditation or registration will vary with the Minister’s specification, so the specific operational procedure that applies to a person will be defined administratively, not in the Regulations; (2) fee waivers, exemptions and the adoption of different Plant Quarantine Standards are Ministerial powers (rr 3(2), 9-10), which can change the compliance landscape without legislative amendment. Operators must therefore monitor Ministerial notices and Gazette entries.

Fee exemptions conditions:

• Accredited persons and Crown agencies are exempt from certain importer registration and annual fees (r 10(2)), but the exemption scope is narrowly framed. For example, exemptions apply to an application for registration as an importer, to a variation application, and to the annual fee where the importer is an accredited person or Crown agency. Entities that are not accredited persons or Crown agencies should not expect these exemptions automatically.

Ambiguity about enforcement mechanics:

• The Regulations state maximum penalties and expiation fees, but do not specify procedural enforcement mechanisms. Practitioners should not assume which agency conducts inspections, the evidence standard for prosecutions, or particulars of expiation procedures are set out here , those details likely reside in the parent Act or other administrative instruments.

Record‑keeping implied but not specified:

• The Regulations require labels to show operational procedure numbers and certificates for propagation plants, but do not specify retention periods or recordkeeping formats. Practitioners should anticipate that authorities will seek documentary proof of compliance; absence of explicit recordkeeping rules does not excuse lack of records.

These points make clear that compliance requires active interaction with administrative bodies (Chief Inspector, Ministerial office), checking the current Plant Quarantine Standard and ICA operational procedures, and attention to label format minutiae.

To operationalise compliance under the Regulations, affected entities should adopt procedures that ensure labelling, documentary and accreditation/registration requirements are met and that administrative approvals and current standards are checked and recorded.

Immediate steps for packers of fruit, vegetables and nuts (r 5):

• Ensure label legibility: use permanent ink, English language, and font or hand letter height of at least 5 mm; place label clearly on the outside of packaging (r 5(1)(a)). Implement a labelling template and SOP that enforces these formatting rules at packing stations.
• Distinguish accredited status: determine whether the packer operates as an accredited person. If accredited, ensure the IP number is current and included on the label (r 5(1)(b)(iii)); include the date or approved date code (r 5(1)(b)(i)); include a brief description of contents (r 5(1)(b)(ii)); include either the Chief Inspector‑approved production place code or the nearest town postcode (r 5(1)(b)(iv)); and include “meets ICA” and the ICA operational procedure number that was followed (r 5(1)(b)(v)). Maintain documentation proving compliance with the specified ICA operational procedure.
• If not accredited, include the date or date code, a brief description, district of production and either names/addresses/postcodes or the Chief Inspector‑approved grower/packer codes (r 5(1)(c)). Ensure chains of custody capture grower and packer contact details so labels can be completed.
• Used packaging: where used packaging is involved, institute cleaning and inspection steps to verify good repair, absence of extraneous visible matter and no objectionable odour; ensure such packaging is labelled per r 5(1). Where bulk processing is intended, seek Chief Inspector approval to receive bulk loads for processing if you wish to avoid individual pack labelling (r 5(3)).

Document and records management:

• Retain records of IP numbers, accreditation documents, the specific ICA operational procedures followed, and the date codes used. While the Regulations do not specify retention periods, records will be required to demonstrate compliance under r 5(1)(b)(v) and r 5(1)(b)(i).
• For date codes, obtain any Chief Inspector approved date‑code scheme where used (r 5(4)).

For sellers of plants for propagation (r 6 and Schedule 1):

• Check whether the plant species falls in Schedule 1 (Citrus spp, Phoenix dactylifera offshoots, Vitis spp, Pinus spp, Solanum lycopersicum). If the plant has been brought into the State, ensure it is accompanied by an assurance certificate or plant health certificate and any other documents required by the Minister and set out in the Plant Quarantine Standard (r 6(2)(a)-(b)). Do not sell the plant for propagation in the State without these documents.
• Monitor the current Plant Quarantine Standard and any Ministerial notices adopting a different standard (r 3(2)) to ensure you supply all ancillary documents the Standard requires.

Accreditation and registration (rr 7-8):

• When applying for accreditation, seek clarity from the Minister’s office or the administering agency about the “prescribed protocols and operational procedures” that will attach to the accreditation (r 7(1)). Accreditation may carry conditions prescribed under s 20(2)(e) and s 20(2)(i) of the Act, which the Regulations identify as prescribed conditions (r 7(2)). Obtain those condition texts and integrate them into compliance procedures.
• When registering as an importer, similarly ascertain which protocols and operational procedures the Minister specifies for your registration (r 8).

Fee management (r 10):

• If fee liability is an issue, consider whether you qualify as an accredited person or an agency/instrumentality of the Crown for the exemptions in r 10(2). If not, prepare to pay prescribed fees, but note the Minister’s power to waive fees on application or on the Minister’s own initiative (r 10(1)). Lodge fee‑waiver applications where appropriate and keep copies of any Ministerial waivers.

Engage with the Chief Inspector and Ministerial processes:

• For code approvals (grower/packer/place date codes) and for Chief Inspector approvals to receive bulk loads for processing, apply to the Chief Inspector and obtain written approvals (r 5(1)(b)(iv), r 5(3), r 5(4)). Keep approvals accessible for inspection.
• Monitor Government Gazettes for Ministerial exemption notices under r 9 and Plant Quarantine Standard adoption notices under r 3(2).

Operational checklists and training:

• Draft packing checklists that ensure each package label includes the required fields depending on accreditation status, and assign responsibility for verification at packing lines.
• Train staff on the 5 mm minimum character height, permanent ink requirement, and the content differences for accredited and non‑accredited packing operations.
• Implement traceability and document retention systems to match labels to ICA operational procedures, assurance/plant health certificates, and any Chief Inspector approvals.

Legal and compliance review:

• Have standard operating procedures and compliance checklists reviewed periodically to ensure alignment with any Ministerially adopted changes to operational procedures, the Plant Quarantine Standard or Gazetted exemptions.
• Where uncertainty exists about the specification of protocols or codes, seek written administrative confirmation from the relevant agency to reduce enforcement risk.

These steps will help operationalise the discrete duties in the Regulations and convert the Ministerial and Chief Inspector delegations into concrete compliance actions on the ground.
