#### 60 Certain persons not to acquire PBR (1) A person must not apply for, or otherwise acquire, except than by will or by operation of law, PBR in a plant variety or an interest in such right if the person has during the 12 months before the application, held, or performed the duties of: (b) the office of Registrar of Plant Breeder’s Rights; or (c) an office in the Department the duties of which involve providing assistance to the Registrar. Penalty: 60 penalty units. (2) A grant of PBR applied for in contravention of subsection (1) or an acquisition of PBR in contravention of that subsection is void.
