Plant Biosecurity Regulations 2016

The Regulations orient around a handful of legal and administrative concepts that convert the Act’s broad biosecurity powers into specific, operational duties.

Prescribed material (reg 6). This is the core regulatory hook. The Regulations list particular classes of material as “prescribed materials” for Division 1 of Part 2 of the Act, including: any plant or plant product of the genus Vitis; used agricultural equipment and used packages linked to Vitis; earth material from properties growing Vitis; root vegetables, bulbs, nursery plants or seedlings grown in soil or soil-contacting mediums; used equipment and packages linked to those root items; earth material in which such items were grown; and hosts of pests or diseases for a declared restricted area (reg 6(a)-(i)). The instrument therefore targets vectors of established high‑risk pests (grape phylloxera, potato cyst nematode, and others by reference to restricted area orders).

Documentary assurance (reg 8, reg 12). The Regulations operationalise the Act’s requirement that certain consignments be accompanied by an assurance certificate, plant health certificate or plant health declaration and prescribe the minimum particulars for those documents: particulars must identify the prescribed material to which the certificate or declaration relates (reg 12). Regulation 8 further sets out which prescribed material must comply with the requirement to send and possess certificate or declaration, and specifies exceptions (reg 8(2)), including material originating from phylloxera exclusion zones, material for which an area freedom certificate has been issued, and plants in tissue culture. An area freedom certificate must state the pest or disease, describe the area free of that pest or disease, bear the issuing officer’s name and position, and the issuing department or agency (reg 8(3)).

Inspection and prescribed place (regs 9-11). If a person lacks compliant documentation or holds documents that do not meet the Act’s statutory standards (sections 11-13 of the Act), reg 9 requires presentation of the prescribed material for inspection, examination or treatment. Reg 10 requires presentation of accompanying certificates or declarations for inspection and attaches a penalty (5 penalty units). The Regulations designate a single prescribed place for inspection under s 8(1C)(b)(ii) of the Act: the Melbourne Wholesale Fruit, Vegetable and Flower Market at Cooper Street, Epping (reg 11).

Marking, warnings and property identification (regs 13-15, Schs 1-3). The Regulations identify plants subject to property identification codes (Sch 1) and prescribe fruit and vegetables for marking locality under s 46(3)(b) of the Act (Sch 2). They prescribe the form of a warning label to be attached to seized/detained material (Sch 3) and criminalise detaching, defacing or obscuring such a label without written consent of the inspector (reg 15(2), penalty 10 penalty units).

Fees, compliance agreements and who pays (reg 16). Inspectors may impose fees and charges at amounts fixed or determined by the Minister under s 55 of the Act for inspection, inspection of land, supervision of treatment and supervision of destruction/disposal (reg 16(1)(a)-(d)). The owner or person in charge of the consignment must pay the relevant fee (reg 16(2)). Fees are also imposed for preparation and enforcement of compliance agreements; the requester pays preparation fees; parties to compliance agreements other than the Crown must pay enforcement fees (regs 16(3)-(6)).

Infringement scheme (reg 17 and Sch 4). The Regulations nominate which offences under the Act may be dealt with by infringement notice and prescribe the infringement penalty amounts (reg 17(1)-(2), Sch 4). Schedule 4 defines “relevant prescribed material” for the purposes of multiple listed items and sets out penalties with differentiation between natural persons and bodies corporate for many offences (for example, item 1: s 8(1) , 2 penalty units for a natural person, 10 for a body corporate).

Statutory linkages. The instrument repeatedly references particular sections of the Act , for example, it operationalises sections 11-13 (certificate particulars) via reg 12 and links s 46(3)(b) (marking) to reg 14 and Sch 2. It is made under s 141 and relies on ministerial fee‑setting under s 55; the Act’s infringement procedures are given effect through reg 17 and Sch 4.

Definitions and thresholds. The Definitions at reg 5 expand and specify terms used throughout: “plant or plant product of the genus Vitis” is explicitly defined to include grapevines, potted vines, cuttings, rootlings, leaves, stems, grapes, juice and diagnostic samples; “phylloxera exclusion zone” is defined; “potato cyst nematode” is named. Schedule 1 sets thresholds for application of property identification codes: chestnuts where growing area has not less than 20 chestnut plants; grapevines where growing area is not less than 0.5 hectares.

Together these concepts create a layered regulatory approach: targeted identification of high‑risk materials, mandatory documentation and inspection, prescribed locations for inspection, a fee and compliance agreement regime, and a calibrated infringement penalty schedule.

The Regulations impose duties and potential liabilities on distinct groups; in plain terms they affect growers, packers, transporters, wholesalers, importers/receivers of certain plant material, vendors of used agricultural equipment and used packaging, owners and persons apparently in charge of consignments, inspectors and the Minister.

Primary private actors affected

• Growers of Vitis species and grapevines operating over at least 0.5 hectares (Sch 1) must ensure consignments comply with documentary and inspection requirements when moving prescribed material. Chestnut growers with at least 20 chestnut plants are similarly captured (Sch 1).
• Producers, harvesters and processors of root vegetables, bulbs, nursery plants and seedlings grown in soil or in media in contact with soil are affected because these items are listed as prescribed materials (reg 6(e)-(h)).
• Operators in the wholesale supply chain who move fruit and vegetables listed in Schedule 2 (a long list that includes apple, avocado, tomato, capsicum, citrus, mango, grape, kiwifruit, strawberry and many others) are affected by marking and locality requirements (reg 14).
• Businesses that own, sell or reuse agricultural equipment, used packages or beehives that have been used with the listed prescribed materials are captured (reg 6(b), (c), (f), (g) and reg 16(1)(a)).
• Owners and persons apparently in charge of consignments are the parties required to pay fees and charges imposed by inspectors (reg 16(2)).

Other stakeholders

• Wholesalers and market operators, particularly the Melbourne Wholesale Fruit, Vegetable and Flower Market, because reg 11 nominates that Market as the prescribed place for inspection, concentrating inspection activity and consequential traffic, logistical and compliance demands at that location.
• Inspection agents and inspectors gain powers to impose fees at Ministerially‑determined rates and to attach prescribed warnings (reg 16 and reg 15), and therefore carry operational responsibilities and discretion in enforcement.
• State and Territory departments responsible for agriculture in other jurisdictions are indirectly affected: they are the issuers of “area freedom certificates” that can exempt material from certain document‑sending requirements, and the Regulations prescribe the minimum contents of those certificates (reg 8(3)).

Who bears costs

• The owner or person apparently in charge of consignments "must pay" fees for inspection, supervision of treatment, supervision of destruction/disposal and compliance agreement enforcement (reg 16(2), (4), (6)). Parties requesting compliance agreements must pay for preparation (reg 16(5)). Therefore commercial entities handling consignments bear monetary costs directly imposed by inspectors.
• Natural persons and bodies corporate face different infringement penalties under Schedule 4 for many offences, with higher monetary exposure for bodies corporate in several items (for example, item 1: s 8(1) , 2 penalty units for a natural person, 10 for a body corporate). The Endnotes quantify a penalty unit at $197.59 for the 2024-25 financial year.

Decision-makers and points of discretion

• Inspectors decide whether documentation is compliant and whether material must be presented for inspection under reg 9, and they impose and collect fees under reg 16 within amounts or rates fixed by the Minister under s 55 of the Act. The Minister determines fee levels under s 55; the Regulations do not specify fee amounts (reg 16(1)-(4)). Inspectors also attach warnings in the prescribed form (reg 15(1) and Sch 3).
• Departments in other States/Territories decide whether to issue area freedom certificates and must include the particulars specified in reg 8(3).

Secondary effects and compliance risk

• Market participants who trade in used agricultural equipment or used packaging that has contained Vitis or root vegetables face transactional friction due to inspection/detention risk under the prescribed material definitions (reg 6).
• Parties that operate interstate must be attentive to whether material originates from a phylloxera exclusion zone or an area with an area freedom certificate, because such origins affect whether the certificate‑sending requirement applies (reg 8(1)-(2)).

The Regulations therefore concentrate costs and decision-making at producers and handlers of Vitis and root vegetables, those operating at the Melbourne wholesale market, and entities that are owners or persons in charge of consignments. Inspectors and the Minister hold regulatory discretion over inspection, fee imposition and the exercise of some enforcement levers.

The Regulations convert statutory powers under the Act into specific duties for holders and handlers of prescribed material, and into rights and obligations for inspectors and ministerial decision-makers. Below are the principal duties and the corollary rights.

Duties imposed on holders, owners and persons in charge

• Possession and sending of certificates: Persons dealing with prescribed material must comply with the Act’s documentation requirements. Regulation 8 requires compliance with the Act’s paragraph (b)(i) of s 8(1C) for all prescribed material unless the material is specified in reg 8(2) (which lists exceptions such as material from phylloxera exclusion zones, material from areas with area freedom certificates, and plants in tissue culture) or reg 9 applies (reg 8(1)-(2)). Practically, this means holders must either hold an assurance certificate, plant health certificate or plant health declaration or be prepared to present the material for inspection (reg 9).
• Presentation for inspection: If the prescribed material is not one of the reg 8(2) exceptions and the person is without a compliant document, or holds a certificate/declaration that does not comply with the statutory requirements of sections 11-13 of the Act, reg 9 requires presentation of the material for inspection, examination or treatment (reg 9(a)-(d)). Reg 10 requires presentation of any accompanying certificate or declaration for inspection, with a penalty of 5 penalty units for non‑compliance.
• Presenting at prescribed place: When the Act requires presentation of material for inspection under s 8(1C)(b)(ii), reg 11 specifies the Melbourne Wholesale Fruit, Vegetable and Flower Market at Cooper Street, Epping as a prescribed place (reg 11).
• Care for attached warnings: If a warning label is attached in the prescribed manner (Sch 3), reg 15(2) criminalises detaching, defacing or obscuring the warning without written consent from the attaching inspector, with a penalty of 10 penalty units for detaching/defacing and a 1 penalty unit infringement available under Sch 4, item 26.
• Payment of fees and charges: The owner or person apparently in charge of the consignment must pay fees and charges an inspector imposes under reg 16(1) for inspection, inspection of land, supervising treatment, and supervising destruction or disposal (reg 16(2)). Parties requesting preparation of compliance agreements must pay the preparation fees (reg 16(5)); parties to compliance agreements other than the Crown must pay enforcement fees (reg 16(6)).

Rights, discretions and obligations of inspectors and the Minister

• Fee-setting and collection: The Minister fixes amounts or rates for fees under s 55 of the Act; inspectors impose those fees in the field (reg 16(1)). Inspectors also determine whether inspection, supervision or destruction is required and collect the corresponding fee from owners/persons in charge (reg 16(2)).
• Attaching warnings: Inspectors have the power to attach the prescribed warning label (Sch 3) to packages, plants or plant products (reg 15(1)). They can require consent in writing before the label is removed and may enforce the offence provisions against persons who detach or deface labels (reg 15(2)).
• Compliance agreements: Inspectors may prepare compliance agreements (s 47 of the Act, operationalised by reg 16(3)-(6)), and charge fees for preparation and for monitoring compliance. The preparation fees are payable by the requester; enforcement-monitoring fees fall on non‑Crown parties to the agreement.
• Enforcement: The Regulations prescribe which offences are subject to infringement notices and set infringement penalties (reg 17 and Sch 4). Inspectors and enforcement agents exercise the statutory power to serve infringement notices in accordance with the Act and these Regulations.

Documentary particulars and third‑party certification

• Prescribed particulars for assurance certificates, plant health certificates and plant health declarations are limited in the Regulations to “details that identify the prescribed material” (reg 12). For area freedom certificates issued by other States/Territories, reg 8(3) requires the pest/disease name, description of the area known to be free of the pest/disease, the signature and position of the issuing officer and the name of the issuing department/authority.

Corollary compliance liabilities

• Failure to comply with these duties attracts penalties either under the Act (the primary offences referenced in Schedule 4) or as infringement penalties set out in Schedule 4 to the Regulations. Many infringement penalties differentiate between natural persons and bodies corporate (Sch 4).

Operational implications

• The duties allocate costs and logistical burden to the private parties handling consignments: they must procure and retain specified certificates, present material and documents when required, pay inspection and supervision fees, comply with attached warnings, and adhere to marking requirements for specified fruit and vegetables (reg 14 and Sch 2). Inspectors and the Minister hold the administrative levers to collect fees, require presentation for inspection, attach warnings and initiate infringement processes under the Act and these Regulations.

The Regulations create a tiered enforcement architecture that combines criminal offences under the Act with an administrative infringement‑notice regime and specified monetary penalties. The instrument both prescribes offences for infringement notices (reg 17(1)) and sets the prescribed infringement penalties (reg 17(2) and Schedule 4).

Infringement scheme (reg 17 and Schedule 4). Regulation 17 declares which offences under the Act are eligible for infringement notices and ties each to a specific penalty amount in Schedule 4. Schedule 4 is precise and itemised. It defines “relevant prescribed material” for the purposes of many listed items and then lists items with the Act section, the offending conduct and the infringement penalty. Many items differentiate liability between natural persons and bodies corporate. Examples include:

• Item 1: s 8(1) (in respect of “relevant prescribed material”) , 2 penalty units for a natural person; 10 penalty units for a body corporate.
• Item 4: s 9(1) (relevant prescribed material) , 2 penalty units for a natural person; 10 penalty units for a body corporate.
• Item 5: s 10(1) , 5 penalty units.
• Item 6: s 15(1) , 2 penalty units.
• Item 26: reg 15(2) , 1 penalty unit (infringement penalty for breaching the rule about detaching/defacing warnings).

Penalty units and dollar values. The Endnotes explain penalty units are defined by the Sentencing Act 1991 and their dollar value is fixed under the Monetary Units Act 2004. For the 2024-25 financial year, a penalty unit is $197.59; the Regulations therefore translate the unit figures in Schedule 4 into dollar amounts by multiplication and rounding rules set out in the monetary units legislation.

Criminal offences and maximum penalties. The Regulations themselves impose some offences by reference to the Act’s sections (for example, reg 10 attaches a penalty of 5 penalty units to failing to present documents for inspection). Other offences remain in the Act and are subject to enforcement by infringement notice where Schedule 4 permits that route. The Regulations do not change the maximum criminal penalties contained in the Act; rather they provide an administrative, lower‑cost enforcement option by specifying infringement penalties for some offending conduct.

Enforcement actors and procedures. Inspectors and inspection agents have powers to inspect, examine, treat or detain prescribed material, attach warnings in the prescribed format (Sch 3), and impose fees under reg 16. They may also serve infringement notices for prescribed offences under reg 17(1). The Minister sets the fee levels under s 55 of the Act; inspectors apply those fees in the field (reg 16(1)).

Attachment and protection of warnings. Regulation 15 prescribes the form of warnings (Sch 3) and makes it an offence to detach, deface or obscure a warning attached by an inspector without the inspector’s written consent (reg 15(2)). That offence carries a penalty of 10 penalty units under reg 15(2), and Schedule 4 provides an infringement option for removal/defacement at item 26 (1 penalty unit).

Who pays for enforcement. Owners and those apparently in charge of consignments must pay inspectors’ fees for inspection, supervision of treatment, and supervision of destruction/disposal (reg 16(2)). The Regulations also make the requester of a compliance agreement responsible for preparation fees and require non‑Crown parties to compliance agreements to pay fees to ensure compliance (reg 16(3)-(6)). This means private parties frequently bear the direct costs of enforcement operations and compliance monitoring.

Practical consequences of the penalty design. The schedule differentiates between natural persons and bodies corporate on many items, often with a fivefold increase for corporate entities (for example, 2 units v 10 units). This introduces a compliance‑cost asymmetry that may redirect regulatory attention toward corporate operators as targets for enforcement revenue or deterrence. The Regulations also concentrate inspection activity at the Melbourne wholesale market (reg 11), which could make that location a focal point for inspectors enforcing detentions and serving infringement notices.

Limits and scope. The Regulations do not set criminal penalty maximums beyond the specified infringement figures; they only designate which offences can be dealt with by infringement and define the infringement amounts. Where offences are not listed in Schedule 4, enforcement remains available through the Act’s standard criminal prosecution mechanisms.

The Regulations are a subordinate instrument made under the Plant Biosecurity Act 2010 (reg 2). They operate as an implementation layer that prescribes particulars, fees, places, and administrative penalties for the Act’s powers. Key interaction points with other legislation and administrative instruments are as follows.

Plant Biosecurity Act 2010

• Enabling and specification: The Regulations are made under s 141 of the Act (reg 2) and repeatedly reference specific Act provisions. They prescribe materials for the purposes of Division 1 of Part 2 of the Act (reg 6), specify particulars for assurance certificates and plant health certificates for the purposes of sections 11(b), 12(b) and 13(b) of the Act (reg 12), identify prescribed fruit and vegetables for the marking requirement in s 46(3)(b) of the Act (reg 14), and prescribe offences that can be enforced by infringement notices under s 119(1) and (2) of the Act (reg 17).
• Fees: The Regulations rely on the Minister’s power under s 55 of the Act to fix fee amounts or rates and permit inspectors to impose fees and charges at those amounts or rates (reg 16(1)). The Regulations do not themselves set fee levels.

Other Victorian statutes referenced in the Endnotes

• Sentencing Act 1991: The Regulations refer to the concept of “penalty units” as defined in the Sentencing Act and calculate monetary values using the Monetary Units Act 2004 (Endnotes; Penalty Units). The Endnotes specify that the value of a penalty unit for 2024-25 is $197.59 and that future values will be fixed by the Treasurer under the Monetary Units Act 2004.
• Monetary Units Act 2004: The Endnotes state the calculation and publication mechanism for penalty unit values (Monetary Units Act 2004 and Treasurer actions).

Corresponding laws in other States and Territories

• Area freedom certificates: Regulation 5 and reg 8 treat area freedom certificates issued by other State/Territory departments responsible for agriculture as relevant to whether materials must be accompanied by certain certificates. The term “department responsible for agriculture in another State or Territory” is defined to include departments administering corresponding laws (reg 5). Regulation 8(3) prescribes the required particulars of an area freedom certificate issued by another State or Territory. Thus the Regulations interact with corresponding State/Territory biosecurity regimes and rely on intergovernmental recognition of area freedom certificates.

Subordinate legislation and amendments

• Revocation and amendment history: Regulation 4 revokes the Plant Biosecurity Regulations 2012 and subsequent amending instruments (reg 4). The Endnotes list the Plant Biosecurity Amendment Regulations 2024, S.R. No. 113/2024, which made multiple amendments throughout the instrument (see Table of Amendments and explanatory details). Users must consult the consolidated version incorporating those amendments (the version provided here incorporates amendments as at 22 October 2024).

Administrative instruments and ministerial determinations

• Fee determinations: Fee amounts and rates are not specified in the Regulations; instead they are fixed or determined by the Minister under s 55 of the Act and applied by inspectors under reg 16. This makes the Regulations operationally dependent on separate ministerial determinations or instruments that set fee schedules.

Other regulatory interfaces and operational points

• Market rules and local government: By designating the Melbourne Wholesale Fruit, Vegetable and Flower Market as the prescribed place for inspection (reg 11), the Regulations interact with market operating rules, leases, safety and traffic controls at that facility. They could also interact with local government regulatory regimes for waste disposal or environmental approvals where supervised destruction or disposal is required under reg 16(1)(d).
• Civil liability and contractual allocation: The Regulations’ cost‑imposition on owners/persons in charge (reg 16(2)) creates a contract and commercial interface. Commercial parties may allocate responsibility for certificates, inspection attendance and fees by contract; the Regulations do not preclude private contractual risk‑allocation, but statutory liability to pay fees rests on the identified persons.

Sunset and legislative lifecycle

• Subordinate Legislation Act 1994: The Endnotes state the Regulations will sunset ten years after making on 31 May 2026 unless extended, per s 5 of the Subordinate Legislation Act 1994. This places a statutory time limit on these specific delegated settings unless the legislature or executive extends or remakes them.

Overall, the Regulations are a detailed subordinate instrument that depends on ministerial fee instruments, State/Territory area freedom certificates, and the Act’s enforcement machinery. They intersect with other administrative regimes (market operations, local government) and with private contractual arrangements that parties will use to allocate compliance costs and responsibilities.

The instrument itself incorporates amendments up to 22 October 2024 (Version No. 002 as at that date). The Regulations were originally made on 31 May 2016 (reg 3) and commenced 1 June 2016. Regulation 4 expressly revokes the earlier Plant Biosecurity Regulations 2012 and the two subsequent amending instruments (reg 4). The Endnotes and the Table of Amendments identify later amendments incorporated into the consolidated text.

Key amendment instrument

• Plant Biosecurity Amendment Regulations 2024, S.R. No. 113/2024. According to the Table of Amendments in the Endnotes the 2024 amending instrument was made and commenced on 22 October 2024. The explanatory details indicate multiple regulations were amended by S.R. No. 113/2024, including but not limited to changes to definitions at reg 5, adjustments to regs 6-12, 15, 16 and Schedule changes (see the in‑text annotations such as “Reg. 5 def. of plant or plant product of the genus Vitis substituted by S.R. No. 113/2024 reg. 4” and several similar “amended by S.R. No. 113/2024” markers throughout the text).

Specific amendment signposts in the consolidated text

• Definitions: The definition of “plant or plant product of the genus Vitis” was substituted by S.R. No. 113/2024 reg 4 (reg 5).
• Prescribed materials and prescribed states: Reg 7 and reg 6 amendments are signalled as amended by the 2024 amending rules (regs 5 and 6 of the amending instrument).
• Regs 8-12: Several sub‑paragraphs and subregulations were amended (see editorial notes such as “Reg. 8(1) amended by S.R. No. 113/2024 reg. 6(2)” and “Reg. 8(2)(c) amended by S.R. No. 113/2024 reg. 6(3)”). These changes include adjustments to which prescribed materials are specified in reg 8(2) as exceptions and to the contents required in area freedom certificates (reg 8(3)).
• Fees and penalties: Reg 16(1)(a), (c), (d) and reg 16(2) have amendment notes indicating the 2024 amending instrument updated the text and possibly the scope of fees and chargeable activities (see annotation “Reg. 16(1)(a) amended by S.R. No. 113/2024 reg. 9(1)”, and similar annotations for 16(1)(c),(d) and 16(2)).
• Schedule amendments: Schedule 2 (prescribed fruit and vegetables) and Schedule 4 (infringement offences and penalties) were amended by S.R. No. 113/2024 (see “Sch. 2 amended by S.R. No. 113/2024 reg. 10” and “Sch. 4 amended by S.R. No. 113/2024 reg. 11”).

Revocations and retrospection

• Regulation 4 revokes the Plant Biosecurity Regulations 2012 and subsequent modification instruments (reg 4). The 2016 Regulations therefore replaced the earlier regime, and the 2024 amending instrument updated particular provisions within the 2016 Regulations.

Sunset notice

• The Endnotes state the Regulations will sunset 10 years after making on 31 May 2026 (Subordinate Legislation Act 1994 reference). That is a process constraint: unless the instrument is remade or extended, the Regulations would lapse around that date. Stakeholders should monitor whether any sunset extension, remaking, or replacement instrument occurs.

Practical effect of amendments

• Several amendments in 2024 appear to expand or clarify the scope of prescribed materials and the documentary exceptions (reg 8), rework feeable activities (reg 16), and adjust penalties and the lists in Schedules 2 and 4. The consolidated text includes these changes, and references to the amending instrument are embedded throughout. Those operating in affected sectors should refer to the consolidated instrument incorporating S.R. No. 113/2024 for current obligations.

Record and publication

• The Endnotes direct users to the official legislation website for consolidated versions and provide the Table of Amendments listing S.R. No. 113/2024 as a recent amending instrument. The Explanatory details in the Endnotes specify the amending instruments and dates. Anyone relying on these Regulations should confirm that they are consulting the consolidated and up‑to‑date version, especially within the shadow of the approaching sunset date.

The text of the Regulations and the Endnotes provided here do not name any court cases, published decisions, or judicial consideration of the Plant Biosecurity Regulations 2016. The instrument itself contains no litigation history, no references to judicial interpretation, and the Endnotes do not list any court decisions. There are therefore no cases identified in the instrument to illustrate contested points of law or enforcement practice.

What the absence of litigation‑references signals and what it does not

• It signals only that the Regulations, as a subordinate instrument, do not purport to cite or summarise judicial decisions. Lack of case references in the instrument is not evidence that enforcement has not occurred or that disputes have not arisen. It simply means this statutory instrument does not contain a litigation history.
• Practitioners should not infer from the instrument alone that the enforcement regime has not been litigated. Challenges would be prosecuted under the Act in the ordinary way, and records of any judicial consideration would be found in tribunal or court databases, or in public enforcement agency documentation, not in the Regulations themselves.

Practical implications for lawyers and compliance officers

• Because the instrument sets out specific administrative details (inspection place, fee responsibilities, infringement penalty amounts and forms of certificates and warnings), many practical disputes are likely to be administrative (for example, disputes about whether a consignment was correctly detained, whether a certificate met the minimal particulars, or whether an inspector properly imposed a fee). Those disputes can generate merits reviews in administrative tribunals, judicial review applications on grounds such as jurisdictional error, or prosecutions for breaches of the Act.
• Absent cases named in the instrument, professionals should look to primary court and tribunal databases for case law on the Act and associated subordinate instruments. The Act’s enforcement provisions, and interpretation of terms such as “prescribed material” or “restricted area order”, may have been the subject of litigation external to the instrument.

Where to look for litigation and precedents

• Court decisions applying or interpreting the Plant Biosecurity Act 2010 and related Regulations will be in Victorian courts and possibly federal or other state courts where cross‑jurisdictional issues arise. Administrative review decisions may also be held in state tribunals.
• For fee disputes, parties may also challenge the ministerial determinations under the Administrative Law framework if the Minister’s instrument exceeds power or is procedurally defective.

In short, the Regulations themselves do not record a litigation history. Practitioners should search case law and tribunal decisions for any judicial treatment of the Act and its implementing instruments to identify precedent on questions of interpretation, enforcement discretion, or procedural fairness in the exercise of inspection and fee powers.

The Regulations include a number of settings and drafting features that produce practical compliance traps and notable administrative frictions. These are concrete items to watch for operationally; they are described exactly according to the Regulations.

1. Narrow defined exemptions can be overlooked

• Regulation 8(1) requires compliance with the documentation requirements in s 8(1C) of the Act “in respect of all prescribed material, unless” the material falls within the exceptions in reg 8(2) or reg 9 applies. Reg 8(2) lists specific exceptions such as material from phylloxera exclusion zones, material from areas for which an area freedom certificate has been issued (for grape phylloxera or potato cyst nematode, reg 8(2)(d)-(e)), and plants in tissue culture (reg 8(2)(f)). Missing the precise wording of these exceptions can lead a holder to assume an exemption applies when it does not.

2. Minimal prescribed particulars for certificates

• Regulation 12 prescribes the particulars for assurance certificates, plant health certificates and plant health declarations as merely “details that identify the prescribed material to which the certificate or declaration relates.” There is no prescribed list of traceability fields beyond identity. This minimal requirement (reg 12) may be insufficient for practical traceability or for satisfying importing jurisdictions, and holders relying on minimal particulars may find inspectors require additional evidence or treatment.

3. Concentration of inspection at one physical site

• Regulation 11 prescribes the Melbourne Wholesale Fruit, Vegetable and Flower Market, Cooper Street, Epping as the prescribed place for inspection under s 8(1C)(b)(ii). That creates a logistical chokepoint: consignments may need to be transported to Epping for inspection, adding time and cost and potentially increasing the risk of perishable spoilage or supply-chain disruption. Parties operating outside Melbourne must plan for transport and timing accordingly.

4. Owner/person-in-charge monetary liability

• Inspectors may impose fees for inspection, supervision of treatment, and supervision of destruction or disposal, and the owner or person apparently in charge of the consignment “must pay” the fee (reg 16(1)-(2)). Commercial contracts may allocate responsibility differently, but statutory liability remains with the owner/person in charge. Failure to account for these fees in contracting can create unexpected costs.

5. Differentiated infringement penalties for bodies corporate

• Schedule 4 often prescribes higher infringement penalties for bodies corporate than for natural persons (for example, item 1: 2 penalty units for natural persons, 10 penalty units for corporates for s 8(1) breaches). Corporates therefore face markedly greater monetary exposure via infringement notices even where the underlying contravention is the same.

6. “Relevant prescribed material” nuance

• Schedule 4 defines “relevant prescribed material” as material prescribed under reg 6(a), (b), (d), (e), (f), (h) or (i), other than material specified in reg 8(2). That means that whether an infringement penalty applies at the stated rates depends on both the material’s category and whether it’s one of the reg 8(2) specified exceptions. Misclassifying material or misunderstanding the interplay between regs 6, 8 and Sch 4 can lead to misapplied enforcement expectations.

7. Warnings are prescribed in form and protected

• The Regulations prescribe an exact warning label (Sch 3) and make it an offence to detach or deface without written consent of the attaching inspector (reg 15(2)). Removing a warning to sell or move product without the inspector’s written consent is an offence (reg 15(2), penalty 10 penalty units). Sites that handle detained consignments must have recordkeeping and permission processes so they do not inadvertently commit an offence.

8. Compliance agreements can incur fees on requesters and non‑Crown parties

• A requester pays for preparation of a compliance agreement (reg 16(5)). Parties to a compliance agreement other than the Crown must pay fees to ensure compliance (reg 16(6)). Commercial parties that enter compliance agreements should budget for these fees and ensure the agreement states which party bears them.

9. Minimal prescription for area freedom certificates from other jurisdictions

• An area freedom certificate issued by another State/Territory must include specific details (reg 8(3)), but the Regulation does not prescribe a central validation process. Parties relying on area freedom certificates should ensure the issuing authority’s identity and officer signature/position are correct and verifiable on the face of the certificate.

10. Sunset and regulatory uncertainty

• The Endnotes record that the Regulations were subject to a 10‑year sunset, scheduled to operate on 31 May 2026. If the instrument lapses or is remade with altered requirements, compliance obligations could change materially. Parties should monitor for remaking or extension.

11. Broad list of marked fruit and vegetables

• Schedule 2 includes a wide variety of fruit and vegetables (from abiu to wax jambu), meaning marking obligations under s 46(3)(b) (operationalised by reg 14) can apply to many growers and distributors. Failure to mark locality as required may attract enforcement.

12. Penalty-unit value volatility

• Monetary exposure in Schedule 4 depends on penalty units; those values change annually and are fixed by the Treasurer under the Monetary Units Act 2004. For 2024-25 one unit is $197.59, but alterations to the unit value change the dollar figure for each infringement quickly and automatically.

Failure to account for these specific drafting features and their operational consequences is the principal “gotcha” risk. Practical mitigation involves careful classification of material, confirmation of certificate particulars and area freedom certificates, contractual allocation of fee liabilities, logistical planning for inspections at Epping, and active monitoring of ministerial fee instruments and the instrument’s sunset status.

This section sets out practical, source‑grounded steps for entities (growers, packers, transporters, market operators, equipment sellers) to comply with the Regulations. Each step links to the specific regulatory source where relevant.

1. Determine whether the material is “prescribed material” (reg 6)

• Read reg 6 carefully. Any Vitis plant or plant product, used agricultural equipment/packages associated with Vitis, earth material from vineyards, root vegetables/bulbs/nursery plants/seedlings grown in soil or soil-contacting media, used equipment/packages associated with those items, earth material in which those items were grown, and hosts to an exotic pest under a restricted area order are prescribed. If your material matches any of these descriptions, proceed to the following steps.

2. Identify whether the material falls within reg 8(2) exceptions (reg 8)

• Check reg 8(2) to see if the material comes from a phylloxera exclusion zone, a region for which an area freedom certificate in relation to grape phylloxera or potato cyst nematode has been issued, or is a plant in tissue culture. If the material meets those precise criteria, the requirement to send and possess certain certificates may not apply. If in doubt, treat the material as prescribed and carry the certificate or present for inspection.

3. Secure and maintain appropriate certificates or declarations (regs 8, 12)

• Ensure consignments of prescribed material are accompanied by an assurance certificate, plant health certificate or plant health declaration as required by the Act and regional rules. Regulation 12 prescribes that particulars must identify the prescribed material. Practically, include:
  • clear description of the commodity and quantity;
  • origin property or locality details sufficient for traceability;
  • consignment identifiers (lot numbers) where available.
• Maintain copies and make them available for inspection; reg 10 requires presentation of accompanying certificates for inspection (penalty 5 penalty units if you fail to present).

4. Prepare to present material for inspection when required (regs 9-11)

• If you do not have compliant documentation, reg 9 requires you to present the material for inspection, examination or treatment. The prescribed place for inspection is the Melbourne Wholesale Fruit, Vegetable and Flower Market at Cooper Street, Epping (reg 11). Plan logistics and timing to accommodate potential detentions or inspections at that location. Establish internal procedures for rapid movement to the prescribed place if required.

5. Expect inspectors to attach warnings and treat them as legally binding (reg 15 and Sch 3)

• If an inspector attaches the Schedule 3 warning label to a package or product, do not remove, deface, or obscure it without the inspector’s written consent (reg 15(2); penalty 10 penalty units). Record the inspector’s details, signature, date and time fields on the warning label when it is attached. Maintain internal processes for obtaining written consent before any removal and for storing detained product.

6. Budget for fees and allocate contractual responsibility (reg 16)

• Inspectors may impose fees for inspection, inspection of land, supervision of treatment, and supervision of destruction/disposal at amounts fixed or determined by the Minister under s 55 of the Act (reg 16(1)). The owner or person apparently in charge must pay (reg 16(2)). For compliance agreements:
  • The requester pays preparation fees (reg 16(5)).
  • Parties to compliance agreements other than the Crown must pay fees to ensure compliance (reg 16(6)).
• Ensure commercial contracts allocate these potential fees and that financial systems can pay invoices promptly to avoid enforcement escalation.

7. Verify area freedom certificates issued by another State/Territory (reg 8(3))

• If relying on an area freedom certificate to avoid some documentation requirements, ensure the certificate contains the required particulars: the pest/disease name; description of the area known not to have the pest/disease; signature and position of the issuing officer; and the issuing State/Territory department/authority name (reg 8(3)). Keep a verifiable copy and, where necessary, confirm authenticity with the issuing agency.

8. Use property identification codes and marking where required (reg 13 and reg 14; Sch 1 and Sch 2)

• If you grow chestnuts on more than the threshold (20 plants) or grapevines on at least 0.5 hectares, check reg 13 and Schedule 1 for property identification code requirements. If you produce fruit/vegetables listed in Schedule 2, apply the locality marking required by s 46(3)(b) as prescribed in reg 14. Integrate marking into packing lines and label control procedures.

9. Keep precise, auditable records

• Retain copies of certificates, area freedom certificates, consignment manifests, movement permits, inspection reports, warning labels and written consents. The Regulations’ enforcement depends significantly on documentary proof (reg 12 minimal particulars). Record who was the owner/person in charge at each stage to evidence fee liability and chain of custody.

10. Train staff and contractors

• Ensure staff understand which materials are prescribed, the need for certificates, the requirement to present materials for inspection, prohibition on removing warning labels without inspector consent, and the procedural steps if inspectors attend. Provide checklists for consignments destined for or passing through the Melbourne Market.

11. Monitor ministerial fee instruments and penalty unit values

• The Regulations do not state fee amounts; these are set by the Minister under s 55 of the Act and applied by inspectors (reg 16). Monitor the Minister’s fee determinations and the Treasurer’s published penalty unit value (Endnotes note $197.59 per unit for 2024-25) to quantify potential financial exposure.

12. Include regulatory contingencies in commercial documents

• Contracts for sale, transport, storage or equipment resale should allocate responsibility for compliance documentation, inspection attendance, fees, detention costs and potential waste/destruction. Consider insurance or indemnities to cover costs arising from statutory inspection or destruction.

13. Prepare for compliance agreements where appropriate

• If operations entail ongoing regulated movement, negotiate compliance agreements under s 47 of the Act and reg 16(3)-(6) to set operational standards. Be aware that the requester covers preparation fees and non‑Crown parties must pay enforcement monitoring fees.

14. Seek clarification for borderline or novel materials

• For non-standard items (used packages suspected of having contained prescribed material, soil samples for diagnostics, plant samples), confirm status with the inspectorate before movement. When in doubt, treat material as prescribed to avoid immediate infringement risks.

15. Maintain a watch on legislative updates and sunset dates

• The Endnotes identify a sunset date (31 May 2026). Track remaking, amendment instruments (for example, S.R. No. 113/2024) and ministerial fee determinations to remain compliant with current regulatory settings.

Following these steps translates statutory obligations in regs 6-16 and Schedules 1-4 into operational controls. They focus on identification, documentation, presentation for inspection, fee and label handling, recordkeeping, contractual allocation of costs, staff training and monitoring of ministerial instruments. These measures reduce the risk of infringement notices and fees, and position businesses to respond rapidly if inspectors exercise detention, treatment or destruction powers under the Act and these Regulations.
