sch.11-sec.5 Application of part
This part applies in relation to a development application for development to the extent the development— is in an identified koala broad-hectare area; and is— assessable development under a planning scheme or TLPI; or reconfiguring a lot that is assessable development under schedule 10 , part 14 , division 1 , section 21 . However, this part does not apply— if the development results in a total area on the premises of 500m 2 or less of 1 or more koala habitat areas being cleared of native vegetation since 7 February 2020; or to the extent the development is for an extractive industry. sch 11 s 5 sub 2020 SL No. 9 s 32 (sch.11-sec.5-ssec.1) This part applies in relation to a development application for development to the extent the development— is in an identified koala broad-hectare area; and is— assessable development under a planning scheme or TLPI; or reconfiguring a lot that is assessable development under schedule 10 , part 14 , division 1 , section 21 . - (a) is in an identified koala broad-hectare area; and
- (b) is— (i) assessable development under a planning scheme or TLPI; or (ii) reconfiguring a lot that is assessable development under schedule 10 , part 14 , division 1 , section 21 .
- (i) assessable development under a planning scheme or TLPI; or
- (ii) reconfiguring a lot that is assessable development under schedule 10 , part 14 , division 1 , section 21 .
- (i) assessable development under a planning scheme or TLPI; or

- (a) if the development results in a total area on the premises of 500m 2 or less of 1 or more koala habitat areas being cleared of native vegetation since 7 February 2020; or
- (b) to the extent the development is for an extractive industry.
