What it does
The Planning Legislation Amendment Act 2026 (ACT), Act No. A2026-8, makes targeted amendments to five ACT laws: the Planning Act 2023, the Planning (Exempt Development) Regulation 2023, the Planning (General) Regulation 2023, the Recovery of Lands Act 1929 and the Surveyors Act 2007. Its provisions are mostly specific changes to planning consultation, exempt development rules and terminology. It does not replace the planning framework or set out a general new approval process.
In the Planning Act 2023, section 4 corrects the term “draft major planning amendment” in section 61 to “draft major plan amendment”. Section 5 adds a requirement for the territory planning authority to give a consultation notice to each person prescribed by regulation for a prescribed draft major plan amendment. Section 6 adjusts the exception in section 63(2) so that both the ordinary notification requirement in subsection (1) and the new requirement in subsection (1A) can be disapplied when the authority is satisfied of the relevant condition.
The changes to the Planning (Exempt Development) Regulation 2023 add a category for step-free access paths to single dwellings that comply with a specified design standard, replace the definition of “swimming pool”, and revise a shadowing criterion for certain encroachments. The Act also changes the heading of section 10 of the Planning (General) Regulation 2023, substitutes gendered words in two provisions of the Recovery of Lands Act 1929, and corrects an office-holder reference in a note to the Surveyors Act 2007.
The Act was notified on 15 May 2026. Section 2 provides for commencement on the seventh day after notification, which is 22 May 2026. The source does not include explanatory material setting out a broader policy purpose or quantified costs.
