98 Considerations for transfer of leases—Act, s 373 The following matters are prescribed: (a) the proposed transferee’s financial ability to comply with the lease’s building and development provision; (b) the proposed transferee’s history of compliance with building and development provisions in relation to leases in which the proposed assignee or transferee has, or has had, an interest; (c) the lessee’s history of compliance with building and development provisions in relation to leases in which the lessee has, or has had, an interest; (d) the time remaining for compliance with the lease’s building and development provision when the application to the territory planning authority for its approval of the transfer of the lease is made; (e) a written undertaking from the proposed transferee that the transferee will comply with the lease’s building and development provision.
