103 Decision on application for waiver for lease transferred or assigned in special circumstances—Act, s 374 (4) (1) On application under section 102, the territory planning authority may waive a noncompliance fee only if satisfied that the lease to which the application applies was transferred or assigned in special circumstances.

(2) In satisfying itself under subsection (1), the territory planning authority may, in writing, ask for further evidence or other information in relation to the application. (4) The period for which a waiver may be approved must not be longer than the period for completing the works under the building and development provision when the lease to which the application relates was granted. special circumstance—see section 102 (1).
