sec.53 Evidence of planning instruments or designations

A certified copy of a planning instrument or designation notice is evidence of the content of the instrument or notice. The P&E Court must take judicial notice of a certified copy of a planning instrument or designation notice. A copy of the gazette or newspaper containing a notice about the making of a planning instrument or designation is evidence of the matters stated in the notice. In this section— certified copy , of a document, see the Planning Act , schedule 2 . designation see the Planning Act , section 35 (1) . designation notice means a notice under the Planning Act , section 38 (2) (b) or (c) .
