Planning and Development (Western Australian Planning Commission) Regulations 2024

This instrument pivots around a small set of recurring governance concepts: publicity/transparency, exclusion/confidentiality, delegation/subdelegation, appointment and removal controls, procedural formality, and record-keeping. Each concept is expressed in substantive regulatory mechanics.

• Publicity/transparency: The regulations frequently require that documents be made publicly available on the Commission’s website. Examples: the selection process for board and statutory committee appointments (regs 5, 35, 48), board procedures (reg 13(1)(b)), agendas and minutes (reg 13(2)(a),(c); reg 16(2); reg 25(2)). The instrument defines "Commission’s website" expressly as the vehicle for public availability (reg 3).

• Exclusion/confidentiality: The regulations define an "excluded meeting" (reg 4). Excluded meetings include, among others, meetings dealing with significant development applications as defined in s 171H(1) of the Act and applications under s 171X (reg 4(1)(a)). They also include closed meetings the board or committee decides to hold (reg 4(1)(b)), and meetings that would reveal legal advice or commercial, professional or financial affairs of a person, trade secrets, or matter likely to impair law enforcement, security or public safety (reg 4(2)). The definition excludes trade secrets held by the Commission (reg 4(3)). Meetings or parts open to the public may nonetheless be closed pursuant to a recorded decision (regs 18, 27), with the reason required in minutes (regs 18(2), 27(2)).

• Delegation and subdelegation: The Commission is given express power to delegate functions to committees and to direct committees (regs 22-25, 29). For the Swan Valley Statutory Planning Committee the regulations create a specific architecture: the committee may establish subcommittees and subdelegate functions only with Commission approval (reg 41), and members of subcommittees that will exercise subdelegated functions must be either committee members or appointed with Commission approval (regs 42-45). For additional committees, delegations require each member to be a board member or appointed with Ministerial approval, and the Commission cannot delegate to an individual additional‑committee member unless they are a board member or appointed with Ministerial approval (regs 49-50).

• Appointment, selection transparency and Ministerial control: The Minister appoints board members but must determine and publish a selection process first (reg 5). The Minister may remove board members on specified grounds (reg 9). The Commission must publish selection processes for statutory committees and for appointments to additional committees when functions are delegated (regs 35, 48). Some appointments and removals require Ministerial approval (regs 31(2), 49, 50).

• Procedural formality and record‑keeping: The board must adopt written procedures and publish them (reg 13), keep minutes (reg 16(1)) and publish those minutes except for excluded meetings (reg 16(2)-(3)). Committees must keep minutes and deliver them to the Commission within a Commission‑determined time (reg 25(1)), and the Commission must publish minutes of meetings of committees to which it delegates functions (reg 25(2)), again with excluded meeting exceptions (reg 25(3)). Committees and committee members must keep records of any delegated function performance and provide them if directed (reg 29; reg 45 for Swan Valley subcommittees).

• Public access technology requirements and contingencies: The regulations accept audiovisual remote observation as satisfying public access to meetings (reg 17(2), reg 26(2)) and permit remote attendance at board meetings via instantaneous communication (reg 15). They also recognise technological failure as a cause to hold meetings without public observation (reg 17(3), reg 26(3)).

These concepts interact: transparency requirements (publication, open meetings) are balanced by exclusions and by Commission/Ministerial control over appointments and delegations. The regulations therefore create procedural visibility for many decisions while concentrating actual appointment and delegation authority in the Minister and the Commission, and preserving confidential handling of legal/commercial matters and some financial/property committee business (regs 36-37).

Primary actors directly regulated:

• The Western Australian Planning Commission (the Commission): central obligations sit with the Commission , to publish selection processes and procedures on its website (regs 5, 13, 35, 48), to make minutes publicly available (regs 16(2), 25(2) except where excluded), to direct committees and require records (regs 22-25, 29), and to approve certain committee subcommittee establishments and appointments (regs 41-45). The Commission must maintain a website and manage public access functions (reg 3).

• Board members: appointment, tenure and removal mechanics apply to them (regs 5-12). Board members must follow written procedures adopted by the board, attend meetings (absence from three consecutive meetings vacates office , reg 8(d)), and their minutes are generally published (reg 16). The Minister appoints and can remove board members (reg 9). Board members may hold office part‑time by default (reg 6).

• Committee members (statutory committees, Swan Valley committees, additional committees, and subcommittees): subject to appointment, qualification, removal and vacancy rules (regs 30-33, 35-50). Many committee members will be board members; where functions are to be delegated, external appointments are constrained by Ministerial or Commission approvals (regs 43-50).

• The Minister: the Minister appoints board members (s 11(2)(a) of the Act referenced in regs and reg 5), may remove the chairperson from office under leave provisions (reg 10), and must approve certain committee appointments or Commission removals where specified (reg 31(2); regs 49-50 require Ministerial approval for some appointments). The Minister therefore controls key entry and exit points.

• Applicants and private parties affected by Commission decisions: developers and landowners whose matters the Commission considers will be affected indirectly by openness provisions. Meetings dealing with "determination of a development application" or approvals of subdivision, structure plans and local planning instruments must be open to the public (reg 17(1)(a)-(h)). Conversely, matters defined as excluded meetings (reg 4) permit confidentiality including for significant development applications (referring to s 171H(1)) and applications under s 171X.

• Journalists, civil society and the public: the regulations create new or clarified channels for public observation of meetings (reg 17, reg 26) but also impose a prohibition on private audio‑visual recording with a fine of $10,000 (regs 19(1), 28(1)). The public can observe via audiovisual means (reg 17(2), reg 26(2)), but cannot lawfully record or publish recordings of meetings unless the Commission does so (regs 19(2), 28(2)).

Secondary effects and institutional actors:

• Local governments: where the Commission's decisions involve local planning strategies, local planning scheme reviews, structure plans, local development plans and local planning policies (notes to reg 17 refer to Parts of the Act and the Planning and Development (Local Planning Schemes) Regulations 2015). Local governments are affected by the transparency of Commission decisions (reg 17 notes) and by delegation/subdelegation arrangements affecting how matters may be handled.

• Developers and commercial parties with confidential information: the "excluded meeting" carve‑outs (reg 4(2)(b)) permit the Commission to withhold meetings where disclosure would reveal commercial value or business or financial affairs of a person. That grants these actors a route to confidentiality during Commission or committee consideration.

Who pays and who decides:

• Administrative costs fall on the Commission: website maintenance, preparation and publication of selection processes, procedures, agendas and minutes, operation of audiovisual observation capability and the processes for record‑keeping and responding to Commission directions (regs 3, 5, 13, 16, 25).

• Decision powers are split: the Minister controls board appointments and can remove board members (reg 5, 9); the Commission determines committee procedures, appoints committee members, directs committees and controls delegation/subdelegation (regs 22-25, 29, 46-50). Committees make determinations subject to delegation limits and must report to the Commission (reg 32(1)(h)).

Behavioural changes the regulations incentivise:

• Commission and board will formalise governance documentation: written procedures, published selection processes, agendas and minutes (regs 5, 13, 16).

• Committees will centralise reporting and be more responsive to Commission direction because they must provide records and minutes and can have delegated functions revoked (regs 23-25, 29).

• Prospective appointees who are not board members will need Ministerial or Commission approval to obtain delegated authority in many instances, which reduces the scope for purely external expert membership with delegated powers (regs 43-50).

• Members and observers will avoid recording meetings because of the $10,000 fine, shifting public scrutiny to the Commission’s own published recordings and minutes (regs 19, 28).

This section summarises specific duties imposed and rights created by the regulations, with direct citations.

Duties on the Minister:

• Publish a selection process for appointment of board members and only appoint under that process (reg 5(a)-(b)). The selection document must be made publicly available on the Commission’s website (reg 5(b)).

• Remove board members where statutorily satisfied of incompetence, misconduct, incapacity, code of conduct breach or convictions attracting 12 months imprisonment or more (reg 9). The instrument gives the Minister an express removal power subject to those grounds.

Duties on the Commission:

• Adopt and publish written procedures for board meetings (reg 13(1)(a)-(b)). Procedures must include publication of agendas before meetings, how a non‑member may apply to attend/participate/make submissions or watch and listen, and publication of minutes after meetings (reg 13(2)(a)-(c)).

• Make minutes of board meetings publicly available on the Commission’s website (reg 16(2)), except minutes of excluded meetings (reg 16(3)).

• Determine selection processes and publish them before appointing members of statutory committees and additional committees where delegated functions are involved (regs 35(1), 48(1)). The Commission must not appoint members to certain committees unless a selection process is determined and published.

• Make minutes of committee meetings to which the Commission delegates any function publicly available (reg 25(2)), subject to excluded meeting exceptions (reg 25(3)). Committees must deliver minutes to the Commission within a Commission‑determined time or within a reasonable time (reg 25(1)).

• Direct committees as to procedures and records and enforce those directions (regs 23-25, 29). The Commission’s power to direct is stated not to be limited by these regulations (reg 22).

Duties on the board and committees:

• Keep minutes of proceedings (regs 16(1), 25(1)(a)).

• Adopt and follow meeting procedures for the board (reg 13(1)(a),(c)).

• Ensure meetings that deal with specified planning determinations are open to the public unless they are excluded meetings (reg 17(1); reg 26(1) for committees subject to delegation).

• If deciding to close a meeting, record the decision and reason in the minutes (regs 18(2), 27(2)).

• Keep records of the performance of delegated functions and give those records to the Commission if directed (reg 29(1); reg 45(1) for Swan Valley subcommittees).

• Ensure committees and subcommittees comply with qualification rules and appointment procedures where specified (regs 34(2)(e), 46-50).

Rights and exceptions:

• Public right to observe certain meetings: Meetings listed in reg 17(1) (development applications, planning control area approvals, subdivision approvals, endorsement of local planning strategies, agreement with recommendations in local government reviews, approval of local planning policies, structure plans and local development plans) must be open to the public; audiovisual observation satisfies this requirement (reg 17(2)). Equivalent rule for committees with delegated functions appears at reg 26(1)-(2).

• Right of board and committee to close meetings: Both the board and committees may decide to close meetings to the public (regs 18(1), 27(1)), but must record the decision and reason in minutes (regs 18(2), 27(2)).

• Exclusions for confidentiality: Excluded meetings cover legal advice, trade secrets or commercial/financial affairs of persons, matters that could impair law enforcement or security, and significant development applications or s 171X applications (reg 4). For trade secrets, protection does not cover trade secrets held by the Commission itself (reg 4(3)).

• Remote participation: Board members’ presence at meetings may be via instantaneous communication technologies (reg 15), and public observation via audiovisual means suffices for openness (regs 17(2), 26(2)).

Specific constraints created:

• Prohibition on private recordings: Private individuals must not make or publish audio or visual recordings of Commission board meetings or committee meetings, with an express punishment of a fine of $10,000 (regs 19(1), 28(1)). The Commission is exempted (regs 19(2), 28(2)).

• Delegation constraints: Where the Commission delegates functions to additional committees, any member to whom a function is delegated must be a board member or appointed with Ministerial approval (regs 49-50). For Swan Valley subcommittees with subdelegated Commission functions specific approval and appointment qualifications apply (regs 41-45).

• Appointment/removal conditionality: If a committee member was appointed with Ministerial approval, the Commission cannot remove that member without Ministerial approval (reg 31(2)). This creates a two‑step control in some appointments.

Administrative rights and obligations for continuity:

• Term expiry continuity: Board members continue in office beyond term expiry until a replacement is appointed or 6 months elapse (reg 7(2)). This reduces gaps in membership that could impede decision‑making.

• Vacancies for absences: Office becomes vacant if a member is absent from three consecutive meetings without leave; for the chairperson leave is granted by the Minister and for other members by the chairperson (reg 8(d); reg 10). Leave of absence procedures exist (reg 10).

These duties and rights shape operational behaviour by insisting on a mix of public documentation and centralised oversight. The Commission bears the operational burden of publication and technological provision, while the Minister and Commission retain decisive appointment, removal and delegation authorities.

The regulations contain limited express penal sanctions and primarily rely on administrative enforcement through appointment/removal powers, requirements to publish records, and directions.

Express monetary penalty:

• Recording prohibition: Two parallel prohibitions bar private persons from making or publishing audio or visual recordings of board and committee meetings. A contravention attracts a fine of $10,000 (regs 19(1), 28(1)). The Commission is explicitly exempted from these prohibitions (regs 19(2), 28(2)). The regulations do not provide further criminal penalties, imprisonment, enforcement mechanisms or procedural details, so enforcement of the monetary penalty will rely on the statutory enforcement framework applicable to contraventions in WA legislation (not set out in these regulations).

Administrative enforcement and controls:

• Removal powers: The Minister can remove board members under reg 9 where satisfied of incompetence, misbehaviour, neglect, incapacity, code of conduct breach or certain convictions. The Commission can remove committee members for similar grounds (reg 31(1)). Where a committee member was appointed with Ministerial approval, the Commission may only remove them with Ministerial approval (reg 31(2)). These removal powers are the instrument’s principal enforcement levers to address misconduct or incapacity.

• Direction and withholding of delegated functions: The Commission may direct committees and committee members not to perform delegated functions (reg 29(2)) and may require committees to give records and information (reg 24). Compliance is mandatory: committees "must give effect" to the direction (reg 23(2), reg 24(2), reg 29(3)). This is an administrative enforcement mechanism to control committee behaviour and enforce procedural compliance.

• Vacancy and attendance rules: Offices become vacant for non‑attendance (regs 8(d), 30(1)(c)), for insolvency (regs 8(c), 30(1)(b)), and for resignation (regs 8(b), 30(1)(a)). These provisions operate as automatic enforcement mechanisms to ensure active participation.

• Publication requirements and reputational enforcement: The regulations impose public disclosure duties (selection processes, procedures, agendas, minutes). Failure to publish will attract reputational and potentially judicial scrutiny but the regulations do not specify a statutory penalty for non‑publication. The practical enforcement mechanism is public accountability and possible administrative review or parliamentary scrutiny rather than a specified fine in the regulation text.

Enforcement risks and operational uncertainties:

• The regulations give a fine for unauthorised recording but do not set out who enforces that fine, who may issue it, or the process for prosecution. The implementing enforcement route would follow general enforcement mechanisms in WA law, but the regulations themselves do not provide procedural particulars.

• Commission and Minister discretion in removal and direction creates a governance enforcement model that depends on those actors exercising judgment. The regulations do not specify timeframes for directions, nor do they establish an independent complaints or oversight body; oversight is internal to the Commission and Ministerial control.

• The Commission’s power to require records and direct committees (regs 23-25, 29) is expressed in broad terms. Non‑compliance is met by the statutory obligation to "give effect", and ultimate enforcement resort may be removal powers or administrative remedies, but detailed procedural steps for contesting or enforcing such directions are not provided in the regulations.

In short, the instrument mixes a single explicit monetary sanction for private recordings with stronger administrative enforcement via appointment, removal and directional powers. The operational effectiveness of these enforcement mechanisms depends on administrative capacity, internal compliance processes, the Commission’s willingness to exercise removal and direction powers, and external accountability through publicity of minutes and selection processes.

The regulations are made under and operate alongside the Planning and Development Act 2005 (the Act) and intersect with other named instruments. The regulations cross‑refer to specific Act provisions and to other planning regulations.

Direct cross‑references to the Act and other instruments:

• Act provisions referenced: The regulations link to the Act at several points. "Excluded meeting" includes consideration of a "significant development application as defined in section 171H(1) of the Act" and "an application under section 171X of the Act" (reg 4(1)(a)). Regulation 5 is framed under section 11(2)(a) of the Act (heading of Part 2 states s 11(1) and reg 5 references s 11(2)(a)). Part 3 is expressly made under section 19(3) of the Act. The regulations acknowledge Schedule 2 clauses of the Act concerning committees , e.g. Executive, Finance and Property Committee established under Schedule 2 clause 3, Statutory Planning Committee under Schedule 2 clause 4 (reg 21 definitions and reg 35). Regulation 51(1) references the "new board" defined in section 301(1) of the Act.

• Planning and Development Amendment Act 2023: Regulation 53 cross‑maps documents prepared under the Act before 1 July 2024 to the new sections of the Act as inserted by section 39 of the 2023 amendment Act. It ensures continuity for documents prepared under former section 14(b) or 14(c) by treating them as if prepared under the newly numbered or restructured subsections of section 14 (reg 53(2)-(5)).

• Other subordinate instruments: The notes to regulation 17 explicitly reference other regulations governing local planning instruments: the Planning and Development (Local Planning Schemes) Regulations 2015 , specifically regulation 15 (local planning strategy endorsement), regulation 67 (local planning scheme review recommendations), Schedule 2 Part 2 Division 2 clause 4(3A) (local planning policy approval), Schedule 2 Part 4 clause 22 (structure plan approval), and Schedule 2 Part 6 clause 52(1A) (local development plan approval). Regulation 53(6) cross‑references definitions of "public planning document" in three separate instruments: the Planning and Development (Planning Codes) Regulations 2024 regulation 4, the Planning and Development (Region Planning Schemes) Regulations 2023 regulation 3, and the Planning and Development (State Planning Policies) Regulations 2024 regulation 4.

Operational intersections and consequences:

• Transparency obligations under these regulations feed into broader planning transparency regimes. The requirement that certain meetings be open to the public (reg 17) ties directly into statutory decision categories in the Act and local planning regulations referenced in the notes to reg 17. For practitioners, this means that decisions on development approvals and local planning instruments , already governed by scheme/regulation requirements , will also be subject to Commission meeting openness rules where the Commission is deciding.

• Delegation and subdelegation constraints will alter how functions are exercised across the Act’s delegation framework. The Commission’s power to direct committees (reg 22) is stated not to limit Schedule 2 clause 1(5) of the Act (reg 22), which preserves the Commission’s statutory power beyond the regulations. In practice, committees exercising delegated functions under the Act will now operate within the procedural and record‑keeping envelope created by these regulations.

• Transitional preservation of pre‑1 July 2024 documents (reg 53) avoids a legal gap by treating documents prepared under the old section 14 as if prepared under the new section numbering and allowing them to be revoked or amended under the new framework. That reduces legal uncertainty about the continuity of planning documents when the Act’s subsections were amended by the 2023 Act.

• The regulations do not displace other statutory duties or rights under administrative law. Removal powers, delegation revocation and directions from the Commission remain subject to general administrative law principles, judicial review and the Act’s own procedural constraints, none of which are overridden by the regulations. The regulations do not set aside judicial review or other legal routes.

Potential friction points:

• Executive, Finance and Property Committee exceptions (regs 36-37) carve out transparency for specific committee business. That interacts with the default requirement for committee meeting openess (reg 26) and may create operational distinctions among committees for which separate confidentiality protocols and public messaging will be required.

• Recording prohibition sits alongside freedom of information and other transparency laws. The regulation prohibits private audiovisual recording for board and committee meetings, but does not address how that interacts with freedom of information access to minutes and records that are required to be published (regs 16, 25). Practitioners should treat the prohibition as a meeting conduct rule; public records and minutes remain available as required.

• Ministerial approval requirements for certain appointments and removals (regs 31(2), 49-50) overlap with the Commission’s internal appointment powers and the Act’s own appointing provisions, potentially slowing appointments to committees where Ministerial approval is required.

In short, the regulations implement procedural governance within the existing Act architecture and cross‑refer to the broader suite of planning regulations. They add transparency and record‑keeping obligations while preserving confidentiality exceptions and central administrative control via the Commission and Minister. Users should read the regulations in tandem with the specified clauses of the Act and with the other planning regulations cited in the notes to reg 17 and reg 53.

The regulations are newly made and the compilation table in the instrument records initial publication and commencement. Relevant points from the compilation and text:

• Source citation: The instrument is cited as the Planning and Development (Western Australian Planning Commission) Regulations 2024, published as SL 2024/100 (Compilation table).

• Publication and commencement dates: Part 1 (other than regulations 3 and 4) commenced on publication of the regulations on the WA legislation website, which the compilation table records as 12 June 2024 (reg 2(a) and compilation table). All other regulations came into operation on 1 July 2024 (reg 2(b) and compilation table), aligning the main operational changes with the start of the 2024-25 financial year.

• Connection to the 2023 Amendment Act: The regulations expressly reference the Planning and Development Amendment Act 2023 in regulation 53(1) and use that Act’s amendments (section 39 of the 2023 amendment Act) to map pre‑1 July 2024 planning documents across to newly structured subsections of section 14 of the Act (reg 53(3)-(5)). That indicates these regulations are the subordinate instrument establishing operational detail required by legislative amendments made in 2023.

• Transitional provisions: Regulations 51-53 serve as transitional machinery. Regulation 51 extends the regulations to the "new board" defined in section 301(1) of the Act and to committees established before 1 July 2024, while also validating resolutions that established committees prior to that date even if they did not comply with the new requirements of regulation 46(1) (reg 51(2)-(4)). Regulation 52 allows committees to complete the performance of functions that were started before 1 July 2024. Regulation 53 preserves pre‑1 July planning documents by treating them as prepared under the new structure and maps public consultation status for the purposes of other subordinate regulations (reg 53(6)).

• No subsequent amendments recorded in the provided text: The instrument as provided presents a single compilation. There are no later amendment entries or notes of variation in the text supplied. Any future amendments would be captured by subsequent compilations on the WA legislation website.

• Notes on legal continuity: The transition clauses ensure legal continuity for functions, memberships and planning documents enacted or commenced under prior arrangements. The instrument therefore functions not only as a governance code moving forward but also as a continuity device to prevent invalidity of actions taken before the regulatory regime changed.

Practitioners should therefore treat the instrument as the initial 2024 subordinate regulation package implementing changes arising from the 2023 Amendment Act, with key dates to note being 12 June 2024 for Part 1 publication effect and 1 July 2024 for the operation of the substantive regulatory provisions.

The regulations themselves are newly made and the text does not record any litigation. There are no cases, judgments or administrative review decisions cited in the material provided.

Potential legal contestation points identifiable from the regulations (text‑grounded, not predictive):

• Closure decisions and excluded meetings: The instrument allows the board or a committee to close meetings or parts of meetings to the public and sets out categories for excluded meetings (reg 4, regs 18 and 27). A party or member of the public might seek administrative review in circumstances where a closure decision appears not to fit the statutory categories, or where the reason recorded in the minutes (regs 18(2), 27(2)) does not appear substantiated. Challenges would be grounded in administrative law principles such as jurisdictional error or failure to follow procedural fairness, but the regulations themselves provide the categories and recording requirement , the scope for review will depend on the factual application of those categories.

• Removal and appointment disputes: The Minister’s removal power over board members (reg 9) and the Commission’s power to remove committee members with certain approval constraints (reg 31) create points of potential legal contest. Where removal is alleged to contravene procedural fairness or be otherwise unlawful, an affected member could seek review. For committee members appointed with Ministerial approval, removal by the Commission requires Ministerial approval (reg 31(2)), a procedural safeguard that could itself be contested if not observed.

• Delegation and subdelegation boundaries: The regulations set detailed limits on who can be delegated functions and under what approvals (regs 41-45, 49-50). Disputes could arise where the Commission delegates a function in a way that appears to contravene these constraints, or where a committee subdelegates without Commission approval in the Swan Valley context (reg 41(2)). The regulations require records of delegated function performance and allow the Commission to direct cessation of performance (reg 29(2)-(3)). Litigation could involve claims that a delegation or subdelegation was invalid, although the regulations provide clear rules to test.

• Recording prohibition enforcement: The $10,000 fine for unauthorised recording (regs 19(1), 28(1)) raises enforcement questions. Litigation could arise as to whether a purported recording falls within the prohibitions, whether an action amounted to "publishing" a recording, or whether the Commission’s exemption (regs 19(2), 28(2)) was applicable. The regulations themselves do not set out enforcement procedure; legal disputes could therefore focus on procedural fairness in any enforcement action.

• Publication obligations and failures: The regulations impose public publication duties on the Commission (regs 5, 13, 16, 25). If the Commission fails to publish selection processes, procedures, agendas or minutes as required, affected parties could seek relief through administrative law remedies or orders compelling publication. The regulations, however, do not specify a statutory private right of action, so judicial remedies would follow general administrative law processes.

Because the regulations are administrative in nature and interact with appointment, removal and delegation powers, the most likely forms of challenge would be administrative law proceedings alleging jurisdictional error, procedural unfairness, or non‑compliance with the explicit regulatory rules. The source text does not document any judicial or tribunal decisions; practitioners should monitor administrative law registries for any developing authorities applying these regulations once disputes arise in practice.

This section flags discrete operational traps and features that commonly catch practitioners and officials when new governance rules take effect. Each item is grounded in the specific regulation citation.

1. Recording prohibition: Private individuals are prohibited from making or publishing audio or visual recordings of board or committee meetings and face a $10,000 fine (regs 19(1), 28(1)). The Commission is exempted (regs 19(2), 28(2)). Failure to advise attendees and the public of this prohibition is an operational risk; organisations should provide clear signage and entry notices. Note the regulations do not set out enforcement procedure.

2. Excluded meetings are broad and include significant development applications: The definition of excluded meeting explicitly includes significant development applications under s 171H(1) and applications under s 171X of the Act (reg 4(1)(a)). That means meetings involving high‑profile developments can lawfully be closed, reducing public observation precisely where public interest may be high. The "commercial affairs" carve‑out (reg 4(2)(b)) is also broad and can encompass much commercial information.

3. Executive, Finance and Property Committee confidentiality carve-out: Despite the general rule that committee meetings with delegated functions must be open and have minutes published (regs 25(2), 26(1)), the Executive, Finance and Property Committee is excepted , the Commission is not required to publish its minutes and its meetings are not required to be open (regs 36-37). That creates a procedural exception for financial and property matters which may concentrate confidential decision‑making.

4. Delegation constrained to board members or Minister‑approved appointees: The Commission cannot delegate functions to additional committees or to members of additional committees unless each member is a member of the board or was appointed with Ministerial approval (regs 49-50). This prevents the Commission from simply delegating substantive decision‑making to external expert committees without Minister involvement.

5. Ministerial and Commission approval gates: Several appointment and removal mechanisms require Ministerial approval or Commission approval (regs 5, 31(2), 41(2), 42(1), 43-44, 49-50). Administrative delay and political intervention risk are practical consequences. Where a committee member is appointed with Ministerial approval, the Commission cannot remove them without that approval (reg 31(2)).

6. Publication demands and timing undefined: While the board must publish procedures, agendas and minutes (reg 13(2), reg 16), the regulations do not prescribe precise timing for agenda publication before meetings or for minutes publication after meetings (except that committees must provide minutes to the Commission within a time determined by the Commission or within a "reasonable time" , reg 25(1)(b)). That leaves timing to internal policy and creates potential compliance uncertainty.

7. Attendance and vacancy rules: A member loses office if absent from three consecutive meetings without leave (reg 8(d), reg 30(1)(c)). For the chairperson, only the Minister can grant leave (reg 10(1)); for others the chairperson grants leave (reg 10(3)). Failure to track attendance may lead to unintentional vacancies.

8. Remote attendance counts as presence but public observation depends on audiovisual capability: Remote attendance is permitted (reg 15) and public observation by audiovisual communication satisfies openness requirements (regs 17(2), 26(2)). However, technological failures permit non‑public meetings (regs 17(3), 26(3)). Commission must therefore ensure robust audiovisual capability and contingency plans.

9. Written resolution outside a meeting has a narrow form: Reg 20 requires at least 7 days’ notice before the voting deadline, specified thresholds of assenting members depending on board size (five of nine or four otherwise), and that no member votes against in writing. The absence of a requirement for an absolute majority or for recorded dissent beyond "no member has voted against" may create practical drafting traps for those relying on written resolutions for urgent items.

10. Transitional validation of pre‑existing committees and documents: The regulations validate committees established before 1 July 2024 even if their establishing resolutions did not comply with the new requirements of reg 46(1) (reg 51(3)-(4)). That is helpful from a continuity standpoint but may mask underlying governance deficiencies in older committees.

11. Swan Valley subcommittee subdelegation constraints: Swan Valley Statutory Planning Committee subcommittees to which Commission functions are subdelegated must have members who are committee members or approved by the Commission (regs 41-45). Failure to secure Commission approval before subdelegation invalidates the process on the face of the regulations.

12. Records and direction obligations are broad: The Commission can direct committees to provide any records or information (reg 24(1)) and committees must comply (reg 24(2)). This includes performance records of delegated functions (reg 29). Committees unfamiliar with these obligations may be caught out by requests for detailed files or work product.

Overall, the gotchas cluster around confidentiality vs transparency, delegation constraints, Ministerial approval gates and technological and administrative compliance requirements. Each is directly traceable to the cited regulation; practitioners should plan operational controls and checklists to avoid inadvertent breaches.

This section offers concrete, step‑by‑step compliance actions tied to the relevant regulations. The recommendations follow the instrument’s enumerated obligations.

Governance and publication (regs 5, 13, 35, 48, 16, 25)

1. Publish selection processes before appointments:

   • Minister and Commission must determine and publish selection process documents for board and for statutory/additional committee appointments where required (regs 5, 35, 48). Draft and publish selection process documents on the Commission’s website and time appointments only after publication. Maintain version control and a public URL for each selection process.

2. Adopt and publish written board procedures:

   • Board should adopt written procedures that at minimum address agendas publication, how third parties may apply to attend/participate/make submissions or watch/listen, and minutes publication (reg 13(2)). Post these procedures on the Commission’s website (reg 13(1)(b)) and ensure they are followed.

3. Agenda and minutes workflow:

   • Implement an internal workflow for agenda publication before meetings and for minutes publication after meetings (reg 13(2)(a),(c); reg 16(2)). Specify lead times internally (since the regs do not prescribe exact timelines). For committees with delegated functions, capture minutes and deliver them to the Commission within the Commission‑determined time or a reasonable time (reg 25(1)). Ensure the Commission’s website team posts minutes promptly and retains archived versions.

Meeting conduct and technology (regs 15, 17, 26, 18, 27, 19, 28)

4. Audiovisual capability and contingency planning:

   • Equip meeting venues (and remote meeting platforms) with reliable audiovisual streaming so members of the public can observe remotely (regs 17(2), 26(2)). Establish continuity plans for technological failure (regs 17(3), 26(3)) and script a standard response (e.g., postpone or close part of the meeting, record the decision in minutes).

5. Notices on recording prohibition:

   • Publish clear signage and a written notice at meeting commencements that private audio/visual recordings of meetings are prohibited and subject to a $10,000 fine, and that the Commission may publish official recordings or minutes (regs 19(1)-(2), 28(1)-(2)). Consider including this notice on the Commission’s website meeting pages and in digital meeting invitations.

Delegation, committees and Swan Valley requirements (regs 22-25, 29, 34, 41-45, 46-50)

6. Delegation checklists and approvals:

   • Before any delegation or subdelegation of Commission functions, run a checklist confirming compliance with appointment and approval requirements:
     • For additional committees and subcommittees with delegated functions, ensure each member is a board member or was appointed with Ministerial approval (regs 49-50).
     • For the Swan Valley Statutory Planning Committee, obtain Commission approval before establishing a subcommittee with subdelegated functions and ensure members meet the qualifications or are Commission‑approved (regs 41-44).
   • Document decisions and approvals in the Commission’s records.

7. Record performance of delegated functions:

   • Require committees and subcommittees to keep contemporaneous records of the performance of any delegated or subdelegated functions (regs 29(1), 45(1)). Include templates for records (who made the decision, basis, documents relied upon, conflicts of interest). Ensure the Commission has authority to request and receive these records within stated timeframes (reg 29(1)(b); reg 45(1)(b)).

Appointments, tenure and removal procedures (regs 6-12, 30-31)

8. Appointment documents and terms:

   • Issue clear instruments of appointment specifying whether the office is part‑time (default) or full‑time (reg 6). Specify terms not exceeding five years and include reappointment eligibility (reg 7(1)). Publish appointment decisions and the instrumental terms where appropriate on the Commission’s website.

9. Maintain attendance, leave and vacancy records:

   • Track member attendance and leave authorisations to avoid accidental vacancies triggered after three consecutive absences (regs 8(d), 30(1)(c)). Implement a simple leave request and approval workflow: the Minister may grant leave to the chairperson; the chairperson may grant leave to other members (reg 10).

10. Removal process protocols:

    • Develop internal procedures for assessing and documenting grounds for removal (incompetence, misbehaviour, incapacity, code of conduct breaches, convictions) for both the Minister (board removals, reg 9) and the Commission (committee removals, reg 31). Where Ministerial approval is required to remove a committee member who was appointed with Ministerial approval, ensure you secure that approval (reg 31(2)).

Operational transparency and public engagement (regs 13, 16, 17, 25)

11. Public participation pathway:

    • Implement and publish an application process for members of the public to attend, participate or make submissions at meetings as required in reg 13(2)(b). Make the application form and rules available on the Commission’s website and include clear deadlines and formats for submissions.

12. Sensitive information handling:

    • Build a protocol to identify whether a meeting or part of a meeting is an excluded meeting (reg 4) and whether legal advice, trade secrets, commercial information or law enforcement/security concerns apply (reg 4(2)). If closing a meeting, document the decision and the statutory basis for closure in the minutes (regs 18(2), 27(2)). For trade secrets, remember reg 4(3) excludes trade secrets held by the Commission from the trade secret protection.

Written resolutions and out‑of‑meeting decisions (reg 20)

13. Written resolution templates:
    • Implement a template for written resolutions which includes the notice specifying the voting deadline that is at least seven days away, a clear record of assents, and an explicit statement that no member has voted against in writing (reg 20(1)). Confirm thresholds , five assents if the board has nine members, otherwise four (reg 20(1)(b)). Archive such resolutions in the Commission minutes and records.

Transitional and document continuity (reg 51-53)

14. Inventory of existing documents and committees:
    • Compile an inventory of committees, subcommittees and planning documents that existed before 1 July 2024 to apply transitional rules properly (reg 51-53). For planning documents prepared before 1 July 2024, note whether public consultation occurred to classify them as public planning documents under the cited subordinate regulations (reg 53(6)).

Audit and compliance monitoring

15. Compliance register and audits:

    • Maintain a compliance register capturing publication obligations, appointment timelines, minutes publication, delegation records, records produced under directions and decisions to close meetings. Conduct periodic internal audits to ensure minutes are posted and selection processes and procedures remain up to date.

16. Training for members and staff:

    • Provide training touching on the recording prohibition, public access rules, excluded meeting categories, delegation boundaries, and the requirement to keep records of delegated function performance. Ensure staff understand who may lawfully close a meeting and how to record those decisions in minutes.

By following these concrete steps and mapping them to the cited regulations, the Commission, board, committees, and officials can operationalise the instrument’s transparency, delegation and record‑keeping duties while respecting confidentiality and appointment constraints.
