Western Australia regulation
**What these Regulations do (mechanics first)
Set out the detailed procedures, forms and model clauses that local governments and the Western Australian Planning Commission (the Commission) must follow when preparing, advertising, adopting, amending, reviewing and publishing local planning schemes, local planning strategies, structure plans and local development plans. (See Regulations 8–10, Parts 3–6 and Schedules 1 & 2.)
Prescribe ‘deemed provisions’ (Schedule 2) and model scheme text (Schedule 1) that automatically apply to every local planning scheme unless the Minister allows otherwise; where those deemed provisions conflict with local scheme text, the deemed provisions prevail. (Regulation 10(1)–(6).)
Create a three‑track process for amendments to a local planning scheme (basic, standard, complex), with different notice, consultation and Commission/Minister referral steps and statutory timeframes for each track. This sets who must advertise an amendment, who may be consulted, how long submissions run for, and deadlines for Commission advice and Minister decisions. (Regulations 34–36 and Parts 5 Division 2–4.)
Require local governments to prepare and advertise a local planning strategy for each scheme, and to get Commission certification before advertising. The Commission endorses or requires changes before final adoption. (Part 3, regs 11–16.)
Prescribe processes for structure plans, local development plans and activity/precinct plans: what must be contained, how they are advertised, timelines for reporting to the Commission and decision steps including review rights to the State Administrative Tribunal. (Schedule 2 Part 4 & Part 6.)

21A. Submission of local planning scheme for advertising approval 14
Define when development approval is required and list many classes of development that are exempt from approval (and the conditions for exemption). It sets application, advertising and decision‑making procedures for development approvals, including time limits for decisions and rights of review. (Schedule 2 Part 7–9, clauses 60–76.)
Introduce specific regulatory tools and topics: development contribution areas/plans and how contributions are set and collected (Part 7, regs 70–73); payment‑in‑lieu and shared parking schemes in metropolitan/Peel areas (Schedule 2 Part 9A, cls 77A–77Q); bushfire risk rules for certain development (Part 10A, cls 78A–78F); emergency exemptions from planning requirements (Part 10B, cls 78H–78J); and heritage protections (Schedule 2 Part 3).
Require publication and ongoing online availability of key documents and set minimum advertising practices (regulation 76A and Schedule 2 clause 87), while allowing the Commission to approve tailored publication arrangements where impractical (regulation 76B / clause 88).
Provide administrative detail: who may be an authorised person, delegation rules for local governments and CEOs, forms to use, how fees and publication costs may be charged, and transitional provisions for older instruments and staged amendments. (Regs 3–7, Part 10 Division 2, Schedule 2 clauses 81–86 and Part 9.)
Who is affected
Local governments: greatest operational burden — must follow the procedural steps, hold advertising periods, prepare reports, publish documents, and interact with the Commission and Minister (numerous provisions across Parts 3–6 and Schedule 2).
Landowners and developers: affected by the classification of amendments, the advertising and submission processes, costs of advertising (regs 22, 38, 47 etc.), the development approval rules and exemptions (Schedule 2 cl. 61), parking payment/ shared parking regimes (cls 77A–77Q), and development contribution plans (regs 70–73).
The Western Australian Planning Commission and the Minister: exercise multiple gatekeeping and decision functions (e.g. certification, endorsement, directions to advertise, time extensions, approval/refusal/modification of schemes and amendments — regs 12, 15, 21A, 29, 31–33, 45, 55, 60 etc.).
Public authorities and statutory consultees (EPA, heritage bodies, utilities): formal consultation and environmental/heritage statements and conditions feed into amendment and scheme processes (see regs 25, 27, Schedule 2 clauses on heritage and environmental incorporation).
Residents, neighbours and community stakeholders: have structured opportunities to make submissions on strategies, schemes, amendments, development applications and planning policies (various advertising clauses — regs 13, 22, 38, 47; Schedule 2 clauses 18, 50, 64).
Why it matters (official purpose and practical testing)
Officially, the Regulations provide consistent statewide rules so that local planning schemes operate within a single, predictable framework. They aim to ensure public notice, consultation, environmental and heritage protection, orderly and proper planning, and clear decision timeframes. (See Regulation 10 and Schedule 2 clauses 2, 67.)
Practical trade‑offs and what to watch for:
Concrete behavioural changes created by the Regulations
Local governments must follow prescriptive steps and publish documents online (regulation 76A); they will allocate staff time to compliance and may recover some costs from proponents (regs 23, 39, 48, 64A, 74).
Developers must factor in advertising periods, possible referral delays and the potential for required modifications, environmental conditions, contributions and payments‑in‑lieu (see regs 22, 25, 27, 73, Schedule 2 cls 77H–77I).
Landowners can ask the Commission for advice on whether an amendment is basic/standard/complex (regulation 36), and may be required to accept heritage notices or compensatory processes (Schedule 2 cls 13, 75).
Key sections to consult: Regulation 10 (deemed/model provisions), Regulation 76A (publication), Regulation 34 (amendment classification), Part 5 (amendment procedures), Part 7 (development contribution plans), Schedule 2 clause 61 (development approval exemptions) and clauses 77A–77Q (parking/payment in lieu), Parts 10A and 10B (bushfire & emergency exemptions).
