439 Authorisation to undertake rectification work (1) The territory planning authority may authorise a person (an authorised person) to enter the premises to which a direction under section 437 (Direction to undertake rectification work) applies to undertake the rectification work required by the notice under that section if the work is not completed by the end of the period stated in the notice. (2) However, the territory planning authority must not give the authorisation— (a) until the end of the period for making an application to the ACAT for the review of the decision to make the controlled activity order to which the rectification work relates (the relevant order); or (b) if an application is made to the ACAT for review of the decision to make the relevant order—unless the decision is upheld or the application is withdrawn or dismissed. (3) The territory planning authority is not required to give notice of its intention to authorise a person under subsection (1).
