264 Lease conditional on approval for stated development (1) This section applies to a lease granted under section 263 if— (a) a provision of the lease requires the lessee to obtain the approval of the territory planning authority to undertake development on the land described in the lease; and (b) the development is exempt development. (2) The lessee does not require the territory planning authority’s approval for the development.
